    Where can I find a sample Usufruct contract?

    I'm in the process of agreeing the lifetime (my lifetime) rental of a piece of land in Phuket where I'm going to build a small hardwood house for my own use.

    So I need to get an Usufruct contract drawn up by a lawyer etc.

    But initially, both me and the landowner want to see a sample/typical Usufruct contract, so we both understand what legal conditions are contained in this document.

    Does anyone know where we can download/locate a sample Usufruct contract (in Thai or English)?

    I had no replies on TV about this query. Guess I will have to part with my hard-earned cash and get a 'kosher' contract from a lawyer.

    Im not even sure if there is an associated contract? I was under the impression that this is done at the land office for 60 baht and the reverse of the land title document has the name of the person holding the usufruct right added.

    I have a scan of a chanote with a foreingers name on the back. Its on another pc though. I'll go and grab it......

    Perhaps soembody who reads Thai can translate.
    The Thai for "usufruct" is something like "sitthi gap gin talord sheevit" why not visit the local land office and talk to them about it. That link up there want 6000 baht, bah, its 60baht for this thing. The construction company I used to work for here in Khon kaen did loads of them for farangs thats I sold houses to.

    Hi Spin, I know that the Land Office fee for processing the Usufruct is only 60 baht, but there must be a detailed Usufruct contract drawn up which states the various conditions of the 'land-lease'. That's the more expensive part!

    You got the land and any fixtures like a house for life as I understand it.
    When you die it all goes back to the owner.

    Sounds like a good idea unless you put a few million bahts worth of improvements on the land (like a big house) and then the owner wants it back. All that would be standing between the owner and the new improvements would be your life.

    I always stand by the philosophy that in Thailand its better to be worth more alive than dead.

    I have to get back in contact my old boss and get refreshed on this, its about three years ago that I last was involved in this.
    I dont recall a contract being involved that quoted the various conditions of the "land lease" That to me sounds like someone talking about a 30 year lease.
    I do recall talk of a simple inventory that went with the usufruct that outline the "fixtures and fittings" that were in place on the land.
    I'll e-mail him now and come back here with the response.

    That would be the Usufruct that needs to be drawn up, ie what uses the land can be put to, is the usufruct owner allowed to build the worlds biggest sangsom bottle storage of petrol there and other stuff like that.

    Also the landowner may have buildings on the land that are his, or may have trees that he wishes to keep, the Usufruct owner may want to turn the land into the biggest opium den in the world, or maybe nightclub, so yes, a Usufruct document/agreement does have to be drawn up.

    ^ Not always, If I can avoid spending a chunk of money on something like this then great. That cash will pay for a water pump for the house or whatever.
