    A Porsche driver who allegedly filmed a dying policewoman following a horror Melbourne freeway crash failed to have a charge of outraging public decency thrown out.
    Mortgage broker Richard Pusey faces multiple charges in relation to a crash that left four police officers dead on Melbourne’s Eastern Freeway on April 22.
    Leading Senior Constable Lynette Taylor, Senior Constable Kevin King and constables Glen Humphris and Josh Prestney were killed in the crash involving a truck driven by another man.

    The 42-year-old’s lawyers failed to have the contentious charge of outraging public decency thrown out after claiming it had never been used in Australia.

    However other charges including fail to render assistance, destruction of evidence and two counts of attempting to pervert the course of justice were thrown out by magistrate Donna Bakos in the Melbourne Magistrates Court on Wednesday.
    However, there was enough evidence to support a conviction for the controversial charge of outraging public decency, Ms Bakos found.
    Lawyers for the Porsche driver previously argued they failed to find any case in a hundred years in Australia but prosecutors disagreed.
    The businessman is accused of recording the shock freeway scene on his mobile instead of helping Constable Taylor as she lay dying on the road.
    “Now you’ve f..cked my f..king car,” he allegedly said at the time.
    Mr Pusey is still accused of reckless conduct endangering death, reckless conduct endangering serious injury and possess drug of dependence and other less serious charges.
    In total he is now facing 12 charges.

    The 42-year-old spent almost six months on remand on a string of charges including reckless conduct endangering life and outraging public decency.
    Leading Senior Constable Lynette Taylor, Senior Constable Kevin King and constables Glen Humphris and Josh Prestney were killed in the crash in April, involving a truck driven by another man.

    “I’m of the view very strict and rigorous bail conditions can mitigate the risks so they are not unacceptable,” magistrate Donna Bakos told the Melbourne Magistrates Court on Friday.
    Reasons she cited for granting bail included the onerous conditions in prison, including lockdown, and an “inordinate” delay of up to three years for the trial because of the coronavirus pandemic.
    She said Mr Pusey also had stable accommodation at his home, family support and a “thorough” mental health treatment plan.
    Police argued Mr Pusey should not be granted bail and told the court he was a risk to the public because of his driving and the fear he could intimidate witnesses.
    “He’s a manipulative and controlling man. When he clashes with people, he resorts to all sorts of tactics,” Detective Senior Constable Aaron Price told the court earlier this week.
    However, the magistrate found it was speculation to suggest he could intimidate witnesses.
    “I accept genuine concerns about the behaviour of the applicant, but the suggestion that the applicant will try to find out witnesses is at the best speculative,” Ms Bakos said.

    The businessman will be banned from driving, has to adhere to a curfew, undergo psychiatric treatment, surrender his passport and cannot contact witnesses.
    He has also been barred from using electronic communications and social media to publish anything about or discuss the circumstances in the lead-up to the alleged offending with certain exceptions.
    It comes after a ruling earlier this week that found Mr Pusey could face trial for the “rare” charge of outraging public decency.
    His lawyers previously argued the charge did not exist in Australia, but Ms Bakos disagreed.
    “Could a jury decide that the accused’s conduct was at the highest end of what is disgusting, repugnant, repulsive or offensive? In my view a jury could,” Ms Bakos wrote.
    Mr Pusey was ordered to stand trial in relation to his alleged actions after the crash and he will face court next month.

    A Porsche driver accused of filming a dying policewoman after a horror crash on a Melbourne freeway has been hit with an extra charge over the incident.
    Richard Pusey has been charged with speeding in relation to the Eastern Freeway crash in April 2020, the Melbourne Magistrates Court was told.
    Four police officers were killed when truck driver Mohinder Singh ploughed into the group who pulled Mr Pusey over for allegedly speeding.

    Police allege the 42-year-old was exceeding the 100km/h limit on the Eastern Freeway between Bulleen and Burke roads.
    He exceeded the limit by “more than 45 kilometres per hour” and was allegedly travelling at 147km/h, according to charge sheets released by the court.
    The mortgage broker was hit with the additional charge on February 24.
    Prosecutors asked the charge to be moved to the County Court where he is facing other charges in relation to the crash.

    His lawyer Chris McLennan said there was “no opposition” to this plan.
    The four officers who died in the crash were Leading Senior Constable Lynette Taylor, Senior Constable Kevin King and constables Glen Humphris and Josh Prestney.
    Mr Singh has pleaded guilty to four counts of culpable driving causing death and was on an ice binge before he ran into the officers.
    Mr Pusey is accused of recording the shock freeway scene on his mobile instead of helping Constable Taylor as she lay dying on the road.

    “All I wanted to do was go home and have my sushi,” he allegedly said at the time.

    “Now you’ve f**cked my f**king car.”
    The Porsche driver is facing the rare charge of outraging public decency because he allegedly filmed the fatally injured officer.
    He has also been charged with reckless conduct endangering persons and possession of a drug of dependence.
    He is next expected to face the County Court on March 10.

    Richard Pusey pleaded guilty in the County Court of Victoria on Wednesday to charges relating to the April crash, when a truck driver ploughed into four officers who had pulled Pusey over for speeding.
    “Guilty,” the 42-year-old told Judge Trevor Wraight on Wednesday morning when asked to enter his plea at an arraignment.
    The charges include the rare charge of outraging public decency, brought because he filmed police officer Leading Senior Constable Lynette Taylor as she was dying.
    He reportedly said “now you’ve f***ed my f***ing car” and “all I wanted to do was go home and have some sushi”, and took two video recordings on his phone as the police officer took her final breaths.

    The mortgage broker then left the scene with a witness.
    He also pleaded guilty on Wednesday to possessing a drug of dependence and reckless conduct endangering serious injury.
    Wearing a green prison jumper and a blue mask, he appeared over videolink from the Melbourne Remand Centre, where he remains in custody after his bail was revoked in December.

    On April 22, 2020, Pusey was pulled over for speeding in his Porsche on the Eastern Freeway in Kew, in Melbourne’s East.
    Four police officers attended: Leading Senior Constable Lynette Taylor, First Constable Glen Humphris, Senior Constable Kevin King and Constable Josh Prestney.
    The police officers were standing in the emergency lane while Pusey was urinating on an embankment away from the road.
    About 5.35pm truck driver Mohinder Singh ploughed into the scene in a prime mover, killing the four officers.
    Singh was on an ice bender, hadn’t slept in days, and was hallucinating about a witch, he later told police.

    The truck driver pleaded guilty on December to 10 charges, including four counts of culpable driving causing death, as well as drug trafficking and ammunition charges, and will be sentenced at a later date.
    Connect Logistics boss Simiona Tuteru, who is accused of allowing Singh on the road despite his drug-affected state, is fighting four charges of manslaughter relating to the crash.
    Pusey will next appear for a plea hearing in the County Court on March 31.

    A drugged-up truckie who was “actively psychotic” when he fatally mowed down four police officers should be treated with “sympathy”, a court has been told.
    Mohinder Singh faced the second day of his pre-sentence hearing in the Supreme Court of Victoria on Friday.
    The 48-year-old pleaded guilty to four counts of culpable driving causing the deaths of Leading Senior Constable Lynette Taylor, Senior Constable Kevin King, Constable Glen Humphris and Constable Josh Prestney.
    The group were on the side of the road after pulling over Porsche driver Richard Pusey for allegedly speeding when the truck driver ploughed into them on the Eastern Freeway at Kew in April 2020.
    His lawyer Peter Morrissey SC told the court his client had lived a productive life before the offending and was facing a long stint in jail.
    “He is quite an engaging character, worthy of some interest and some sympathy because, despite the difficulties that he’s faced in his life, he’s lived a rather productive life,” he told the court.

    While he acknowledged it was his client’s decision to get behind the wheel, he said Singh was remorseful, had pleaded guilty at an early stage and was willing to help police.
    “There is a basis to mix justice with mercy and clemency,” Mr Morrissey said.
    Before the fatal crash, Singh had met with his boss for a 44-minute-long “prayer ritual” before he signed a fitness-to-drive form and hopped in his truck for a single delivery.
    He was due to deliver frozen chickens to another business when he drove into the officers.
    “What my client seems uncontroversially to have been hearing is: ‘I want you to drive, you are now healed, now take those chickens to Thomastown’,” Mr Morrissey told the court.
    In a text messages on the morning of the tragedy, Singh raised concerns with his boss that he wasn’t fit to drive on the day and they spoke at the Lyndhurst depot that afternoon.

    Mr Morrissey said it was a “pitiable feature” that Singh’s boss “leaned on him to drive” but acknowledged he had not disclosed his drug use.
    Justice Paul Coghlan pointed out it was a “catch-22” for Singh.
    “If he’d actually revealed that he was under the influence of drugs and had been for many days, he wouldn’t have been allowed to drive,” Justice Coghlan said.
    The judge said the boss who encouraged him to do one more trip did so with “one hand tied behind his back”. His manager Simiona Tuteru is charged with four counts of manslaughter.
    Mr Morrissey told the court his client was “very sorry” and was “instantly shattered” by what he did.
    At the scene, body-worn footage from other police officers captured the driver’s apology, he told the court.
    “I feel so sorry for the police officers. That’s what happened. I wasn’t fit for work,” Singh said after the crash on body-worn footage.
    “I’ve got nothing against any police officer or anything like that; it was the worst possible accident.”
    Mr Morrissey said his client was not fit to be interviewed at the time and was “instantly shattered” by what happened.

    “He was actively psychotic at the time of the offending with the delusional belief he had been cursed,” Mr Morrissey said.
    On Thursday, the court was told Cranbourne driver had only slept five hours in the 72 hours before the crash and was drifting across lanes on the freeway.
    A sleep expert made an estimation the level of impairment due to lack of rest was close to a driver who was six times the drink-driving limit, or a blood-alcohol reading of 0.3.

    Grieving families of the officers gave heart-wrenching testimony about their loss.
    Senior Constable Kevin King’s partner Sharron MacKenzie said she had lost her soulmate and it was a “gut-wrenching pain” to lose him.
    “I felt I could die of a broken heart,” she said.
    Todd Robinson, the partner of Constable Humphris, addressed Singh directly.
    “Mohinder … you took the most important person away from me in the most violent way,” he said.
    He said now seeing a truck on the road was a constant reminder of his partner’s “tragic and violent death”.
    The parents of Constable Joshua Prestney revealed their pain in court and his father Andrew remembers the moment he heard about the crash on the news.
    “Time ticks. What’s going on? Confusion. A sense of dread. Starting to worry now. Time ticks. Nah, it can’t possibly be Josh. He’s only just starting at highway patrol.”

    He ran out of their home when a police car arrived at their neighbour’s home and an inspector stepped out and told him, “Andrew, I am so sorry.”
    “I fall to the footpath and scream, ‘No, not my boy,’” he told the court.
    His wife Belinda said she was left with two images of her son Josh burnt in her mind: the first of him as a baby in his crib; the second of him lying in his casket.
    The husband of Leading Senior Constable Lynette Taylor, Stuart Schulze, said the last words his wife spoke to him were “I love you”.
    He said their life together was a “long, warm summer” and they were moving into their “long, warm autumn”.
    “I now have moved towards a long, cold autumn. My sons and I will always have her in our hearts and will always miss her terribly,” she said.
    Singh will remain in custody until he is sentenced on April 14.

    Three minutes and eight seconds worth of graphic mobile phone footage has been described in detail to a Melbourne court where Porsche driver Richard Pusey is fronting the families of four dead police officers.
    Pusey is appearing via video link at the Victorian County Court for a plea hearing relating to a crash on Melbourne’s Eastern Freeway in April last year.
    The 42-year-old had been pulled over for allegedly driving at 147km/h in a 100km/h zone on April 22 when a prime mover driven by Mohinder Singh veered into the emergency lane and struck the four officers as well as two police cars and Pusey’s Porsche.
    All four officers were killed but Pusey had been urinating behind a guard railing when the crash occurred.
    In court on Wednesday, where Pusey appeared from the Metropolitan Remand Centre, prosecutors outlined for the first time new details about what happened next.
    They say Pusey walked calmly from the bushes, removed two phones from a police vehicle and began filming the dead and dying officers.
    “There you go,” Pusey said in the recording as he filmed Leading Senior Constable Lynette Taylor’s crushed body.

    “Absolutely amazing. Look at that. Look at that. Isn’t it amazing,” he says.
    “I think everyone got cleaned up. There’s four people. Look at that.”
    The court heard Pusey “zoomed in” on the upper body of one officer and said: “Look at that. Oh, he’s smashed. Look at that. Lucky I went and had a piss.”
    Later in the recording, he can be heard saying: “Look at that. Amazing man. That is f***ing justice. Absolutely amazing.”
    As bystanders are seen in the footage rushing to the scene to render assistance, the ask Pusey to stop filming and help.
    “Mate, don’t,” one bystander says to Pusey. But he continues filming.
    “Look at that. That’s f***ing beautiful.”
    When asked to help again, Pusey tells a bystander: “They’re dead.”
    Pusey has pleaded guilty to outraging public decency, driving at speed more than 45km/h over the limit, possessing drugs of dependence, including ketamine and MDMA and reckless conduct endangering injury by driving at high speed on March 21, 2020, a month before the crash.
    The four officers killed in the crash were Senior Constable Taylor, Constable Glen Humphris, Senior Constable Kevin King and Constable Josh Prestney.

    Richard Pusey’s lawyer outlining Porsche driver’s history
    Pusey’s lawyer is outlining reasons his client should be released from prison. He began by acknowledging the families of the victims in court on Wednesday.
    “We wanted to acknowledge with the deepest respect the presence of families of police officers … we recognise the absolute tragedy of their loss,” barrister Dermot Dann QC said.
    He told the court the 42-year-old has a “complex” personality disorder and that his brother took his own life while Pusey was in prison earlier this year.
    He said Pusey worked at McDonald’s when he was young and as a nurse, but there were parts of that job that “he was a complete failure at … including situations where he fainted in the course of persons being treated”.
    Mr Dann says Pusey has “post traumatic stress disorder” from “coming so close to death” on the day of the crash.
    Judge Trevor Wraight described Pusey’s offending as “reprehensible” at an earlier hearing.

    Family members of four police officers killed in a horror crash on the Eastern Freeway have reacted with outrage at the sentence for a man who filmed and mocked them during their last moments.
    Porsche driver Richard Pusey was this morning sentenced to 10 months jail for outraging public decency by filming and swearing at the four Victorian police officers as they lay dying on the side of the road.
    Given time served, the 42-year-old could walk free if he is granted bail on other matters. He has already spent 296 days in prison on remand.

    Pusey’s immediate response was to collect his phones from a police vehicle and film the dying officers instead of helping, responding to witnesses who pleaded with him to do something by saying, “They’re dead”.
    He was later heard saying: “It’s amazing. That is f***ing justice.”
    Outside court, Stuart Schulze, the husband of Sen Constable Taylor, said Pusey’s sentence was “totally inappropriate”.
    “It is difficult to comprehend that the court did not seem to understand that when the evidence of an outraging behaviour was bought before it, it was its duty to set the appropriate standard,” he told reporters said.
    “This is the expectation of the community. It’s a sad reflection on this court finding that this sentence is totally inappropriate.
    “I find it to be outraging public decency that an appropriate sentence was not imposed by this court.”

    Pusey, wearing a green prison tracksuit and a face mask, learned his fate via video link from the Metropolitan Remand Centre this morning.
    Inside the County Court of Victoria Judge Trevor Wraight told Pusey his conduct was “heartless, cruel and disgraceful” but that he accepted Pusey was remorseful.
    “I accept that there is evidence of genuine remorse,” Judge Wraight said. “You said it was ‘horrible’ and that others would view what you did as offensive. You said you were ashamed of the video (you filmed).”
    In sentencing Pusey, Judge Wraight said he took into account the impact of negative publicity on Pusey’s case — publicity that led to Pusey receiving death threats and his family and friends being impacted.
    Judge Wraight also took into account the need for public deterrence and protection of the community.
    Pusey was also fined $1000 and had his license suspended for two years backdated to October 2020, meaning he could be back behind the wheel in less than 18 months.
    Judge Wraight also ordered Pusey to undergo ongoing psychological treatment in the community.
    Pusey, labelled by Judge Wraight “probably the most hated man in Australia”, has served almost 10 months in prison. Prosecutors had called for more jail time.
    The mortgage broker pleaded guilty in March to three charges, including the rare charge of outraging public decency.
    He also admitted to reckless conduct endangering serious injury by speeding, and to possessing MDMA and cannabis.
    The nation was disgusted when Pusey recorded himself making shocking comments like, “Look at that, you c**ts. I guess I’ll be getting a f**king Uber home, huh,” as he walked around the bloody crash site.

    Pusey was heard saying, “It’s amazing, that is f***ing justice. Amazing.”
    A magistrate previously labelled Pusey’s actions “highly intrusive and morally repugnant”.
    On the night of the crash, Pusey sent an email to a Victorian police officer explaining what he had seen.
    “I feel very unwell as what I saw was horrific,” he wrote.
    “I went to the doctors and he asked me to see him in the morning. Three males died instantly. (Sen Const Taylor) was in a state of shock. She was a nice lady. There was a doctor at the scene within seconds. I was behind the steel barrier just moments before the truck came through. I have to sleep now as my head is fuzzy.”
    Pusey has charges pending in the Melbourne Magistrates’ Court for alleged assault from an incident in December last year and August 2019.
    Earlier this month, truck driver Mohinder Singh was sentenced to 22 years in jail on four counts of culpable driving causing death, three drug trafficking charges and drug possession.
    The 48-year-old had barely slept in the days leading up to the crash, and told people he was hallucinating a witch and “stick figures” that weren’t there — but he still got behind the wheel.
    An hour before the crash he was dealing ice out of his truck.
    He was seen veering in and out of lanes by terrified motorists in the lead-up to the fatal minute at 5.36pm.
    His manager at Connect Logistics, Simiona Tuteru, will fight four charges of manslaughter for allowing Singh on the road despite his condition, with the case still before the courts.

    A top Victorian judge has issued a statement amid public backlash over the sentencing of Porsche driver Richard Pusey.
    Pusey was this week sentenced to 10 months jail for outraging public decency by filming one of four dying police officers and swearing following a horror crash on the Eastern Freeway last year.
    Grieving families have blasted the sentence given to the 42-year-old, who could walk out of jail next week if granted bail on other matters.
    He had already spent 296 days in prison on remand.
    On Friday evening County Court chief judge Peter Kidd called the public commentary a “misunderstanding about the justice system”.

    “Some of that commentary perpetuates misunderstandings about both the role of a court when sentencing and the requirements of the rule of law,” he said.
    “It is a fundamental principle of the rule of law that a person is only sentenced on the basis of the offences for which they have been found guilty, or for which they have pleaded guilty.”

    Judge Kidd said Pusey had never been charged or convicted of the deaths of the police officers and a court must sentence in accordance with the law.
    “It is important to remember that Mr Pusey did not stand to be sentenced for their deaths,” he said.
    “The law requires judges to take into account many other factors when determining a sentence. It is not uncommon that some of these factors may conflict with the wishes or interests of those affected by the crime.
    “Denunciation of wrongful conduct in the sentencing process is important, but sentencing is – and must be – a dispassionate exercise, carried out objectively.

    “Justice would not be served if retribution were to prevail over the balanced application of the law. It is a difficult and challenging exercise, but it is what the rule of law demands.”
    Earlier this week, following the sentence, Stuart Schultz, the husband of Leading Senior Constable Lynette Taylor, who died in the crash, broke into tears as he criticised the sentence handed down to Pusey.
    “It is difficult to comprehend that the court did not seem to understand that when the evidence of outrageous behaviour is put before it, it is its duty to set the appropriate standard,” he said.

    Infamous Porsche driver allegedly used horror images for $2.2m claim



    After famously filming the horrific Eastern Freeway collision which killed four police officers, infamous Porsche driver Richard Pusey tried to use the photos to make an insurance claim for $2.2 million, a court has heard.

    Police allege Pusey, 44, distributed graphic pictures of the April 2020 crash – some of which showed the severely injured officers – online in a Google review of a car dealership and for a complaint to the Australian Financial Complaints Authority.
    The former mortgage broker, who identifies as non-binary, will be self-represented throughout the hearing to fight the charges.

    Pusey faced Sunshine Magistrate’s Court in prison greens on Tuesday after pleading not guilty to two charges of using a carriage service in an offensive manner and two charges of breaching their bail by allegedly reoffending.
    Pusey was sentenced to 10 months’ imprisonment on April 28, 2021 after they were found guilty of outraging public decency by filming the deaths of four police officers. Pusey had been pulled over by police for speeding when a truck veered into the emergency lane and fatally hit the four officers.
    The court heard Pusey allegedly published graphic images of the officers online during two separate complaints in relation to the damage to their Porsche sustained during the tragic Eastern Freeway collision.
    In the submission to the AFCA, Pusey said they have been unable to secure an insurance payout for the damage done to their car because “no one wants to own the claim”.
    “A truck mowed down four hero road safety officers … It broke a black Porsche and now these c***s won’t pay up,” they complained to the authority.
    The court heard they asked for $2.2 million in damages for the trauma of seeing the police officers violently killed in the crash.

    However, the senior AFCA manager in charge of the claim, Harry Ganavas, told the court the images attached to the claim were irrelevant and Pusey’s description of events left him “full of revulsion”.
    “I felt repulsed and physically ill, actually, when I viewed the photographs,” he said.
    Police prosecutor Anthony Albore told the court one of the images submitted didn’t even show the damage done to the Porsche.
    The “inappropriate and disrespectful” claim was denied.
    The court heard Pusey also uploaded a one-star Google review about Porsche Centre Melbourne, in which they criticised the company’s insurance policy and level of customer service.
    An investigating police officer told the court the 44-year-old used a graphic photo of one of the bleeding police officers on the roof of the Porsche for their Google profile picture.
    The officer said she felt “angry and outraged” when she saw the horrific image from the fatal tragedy.

    A member of the public alerted police to the Google review, in which they allegedly used a horrific profile picture.

    Mr Albore claimed an Instagram account called “The Richard Pusey Show” contained a non-confronting photo showing the damage to the Porsche, which they could have used for their complaints.
    The prosecutor alleged there were a number of personal details on the Instagram account which proved it was run by Pusey.
    The Porsche driver told the court the prosecution were “telling a story”.
    The hearing continues before Magistrate Michelle Mykytowycz on Wednesday.
