    Are we finally going to see some total common sense over this hate preacher who has cost this country £ millions in benefits for his 8 children, (some of them convicted terrorists) ?
    Years he has been in the UK spouting vile and yet getting benefits.
    I will not believe he has finally gone until i see it on the news - but his family still will remain here in the UK onbenefits.

    Abu Qatada wins appeal against deportation

    Abu Qatada has been fighting extradition for several years

    Muslim cleric Abu Qatada is to be released on bail shortly, having won his appeal at the Special Immigration Appeals Commission (Siac).

    His appeal was upheld after lawyers claimed he would not get a fair trial in Jordan, where he is accused of plotting bomb attacks.

    He will be released from Long Lartin prison in Worcestershire on Tuesday, and must observe a curfew.

    The government said it would seek to appeal against the ruling.

    The home secretary had been assured by Jordan that no evidence gained through torture would be used against him.

    His bail conditions include being allowed out of his house only between 08:00 and 16:00, having to wear an electronic tag, and being restricted in who he meets.

    However, the judge did not force him to tell the Home Office in advance where he was going if he stepped outside.

    Before his bail was decided, Abu Qatada's lawyer Edward Fitzgerald QC had told the court: "There is no reasonable prospect of lawful removal [deportation] within any reasonable time.

    "There is no justification for continuing to deprive Mr Othman of his liberty.
    "Enough is enough, it has gone on for many many years now," the QC added.

    The decision by Siac means that the legal avenues are finally beginning to narrow - we are now in the end game in the home secretary's battle against Abu Qatada.
    The European Court of Human Rights, echoing the concerns of the UK's own Court of Appeal, said the preacher would be treated well if returned - but there was one big problem.

    In their judgement they said that it doesn't matter what someone has done, modern nations that believe in the rule of law cannot send people back to regimes that torture - and then use that evidence against other suspects.

    Theresa May spent weeks trying to get a new deal with Jordan that would convince judges that the country had reformed and the preacher would get a completely fair trial.

    This defeat is a huge blow to her and to the government's strategy of doing diplomatic deals with countries accused of abusing human rights

    A statement from the Home Office said: "We have obtained assurances not just in relation to the treatment of Qatada himself but about the quality of the legal processes that would be followed throughout his trial.

    "Indeed, today's ruling found that 'the Jordanian judiciary, like their executive counterparts, are determined to ensure that the appellant will receive, and be seen to receive, a fair retrial'.

    "We will therefore seek leave to appeal [Monday's] decision."

    Lawyers can apply for permission at the Court of Appeal to challenge the ruling by Mr Justice Mitting.

    Jordan's acting information minister Nayef al-Fayez said his government did "share the British government's disappointment and concern".

    "We will definitely study this ruling carefully with them to see what steps we can take. We understand there will be an appeal and accordingly we will work with them to be able to bring him back to justice here in Jordan.

    "Concerning the fear of a fair trial for him - there were guarantees for the British government on that, but also our constitution and our judicial system guarantees him that."

    'Huge blow'

    BBC home affairs correspondent Dominic Casciani said the decision left Home Secretary Theresa May in "completely uncharted legal waters".

    "This is an absolutely huge blow to the home secretary - a very, very significant judgement."

    Judges at the European Court in Strasbourg ruled early in 2012 that the cleric would not face ill-treatment if returned to Jordan. They said a special UK-Jordan agreement over Mr Qatada's treatment, called a Memorandum of Understanding, was sound and met European standards of humane treatment.

    Critically however, the judge did not believe he would get a fair trial because a Jordanian court could use evidence against Abu Qatada that had been obtained from the torture of others.

    Despite obtaining additional assurances from the Jordanian authorities, Mr Justice Mitting ruled that he was not satisfied Mr Qatada would be tried fairly.

    Abu Qatada faces a re-trial for allegedly conspiring to cause explosions on Western and Israeli targets in 1998 and 1999. He was found guilty of terrorism offences in his absence in Jordan in 1999.

    The Palestinian-born Jordanian has been described as the spiritual leader of the mujahideen. Security chiefs believe he played a key ideological role in spreading support for suicide bombings.

    He has been subject to lengthy periods of detention since 2001 although he has never been charged with a crime in the UK.

    The prime minister has said he is "completely fed up" about the release on bail of Abu Qatada after the Muslim cleric won his deportation appeal.

    David Cameron said ministers had "moved heaven and earth" to try to send Abu Qatada to Jordan where he is accused of bomb plots.

    Abu Qatada's lawyers told a UK court he would not get a fair trial in Jordan.

    The court approved the appeal after deciding witness evidence obtained by torture might be used at trial.

    Meanwhile, a friend of mine with a UK passport has been told that he can move back there with his two kids 'cos they all have British passports, but that his Thai wife can't go with him unless he holds down a job for five years @ 18,000+ per annum becauseit might cost the UK taxpayers something. He's retired, never claimed benefits, never been a burden on the state. Worked all his life...

    I suppose that if we believe in fair trial and equal justice for all, the decision is correct

    Jordan is well known for it's human rights abuses and unfair legal system, including torture

    As this cleric has done nothing illegal in the Uk (so far?) why is it not reasonable not to deport him?

    Essentially, the decision is all about the British legal system and giving people a fair trial

    yes, I know he will be tried in another country but deportation is also part of our legal system

    This sets a precedent for others who may well be totally innocent and who would fare badly if deported to another country

    Removal men were seen loading possessions on to a van outside the extremist cleric's home yesterday. A satellite dish and what looked to be a cross-trainer were taken from the house.

    It is thought that Qatada will be moving to his new home with his wife and four of his five children.

    Last month lawyers for the hate preacher said Qatada and his family had asked to be relocated.

    It is likely he has demanded more space and is seeking a home where he can escape the constant media presence that was a feature of his old house in Wembley.

    He has lived at the Wembley property since February after his initial release from prison as part of his ongoing fight against deportation to Jordan. The family is reportedly paying £1,900 per month in rent, funded through benefits.

    After his return home earlier this year, he was later detained again but was released by senior immigration judge Mr Justice Mitting in November.

    The Special Immigration Appeals Commission then upheld an appeal by Qatada after his lawyers claimed he would not get a fair trial in Jordan
    Despite requests by lawyers for Theresa May, the Home Secretary, for him to be bailed to a Home Office address, the court refused and returned him to his Wembley home.
    Last week Mrs May applied for permission to appeal against the decision to block his deportation.
    Monitoring Qatada costs £100,000 a week and he is allowed to roam the streets for eight hours a day despite tight bail conditions.
    Around 60 officers from Scotland Yard, MI5 and a private security company are involved with marked police cars outside his home and undercover officers ready to follow him if he leaves his house.
    Anyone visiting his home must be approved by the Home Office and his phone line is monitored constantly.
