    William do i have to be married to my girlfriend to register a usufruct and can we register usufruct same time as paying for the land and transferring chanote at land office

    Danno - as far as I'm aware, you do not need to be married to your g/f to register a usfruct.

    Doesn't an Usufructure also create a bit of an incentive for a land owner to have you knocked off?...

    For anyone interested in a house usufruct, finally got round to doing one for this house at the land office as we were there anyway about a separate (condo) property. Both our tabien baans are registered to another condo, not this house.

    Took around 40 minutes as the place was heaving before it closes for the New Year break, and cost 75 baht.

    There was no contract or anything like that. Just signed copies of a few personal Edith/Edmond forms, and my personal details are typed and stamped on that back of the chanote as having a usufruct on the property until I die.

    The gist of it is along the lines of the house and land cannot be sold or used as collateral without my legal consent. Duration is listed as until I meet my Lulu.

    Under Thai law, a foreigner can be the statuary heir of Thai land and house, whereby there after, they are required to sell or gift the land to a Thai national within 12 months, if not having done so, the Department of Land take legal right to dispose (sell) said land and property, and retain 5% of the selling price.


    There is no reason at all for a Thai spouse's family (or any Thai) to inherit any land or house that they own, unless the Thai spouse wishes so.

    I found it less straightforward. I used a lawyer to draw up the usufruct agreement then went lawyerless to the Land Office. The chap in charge was pretty hostile and the gf came away saying it was impossible to register. She seems sometimes to be rather docile in front of awkward civil servants. It took some time before she would agree to try again. This time the head honcho made it clear that no farang names were going on any chanotes while he was in charge and if she pushed it he would do it then send the documents to Bangkok with a recommendation that they revoke the chanote. (I don't even know if they can do that.) So she walked away for a second time.
    The third time I used an agent and it sailed through. For a modest fee.
    In principle I have the right to use the land for any purpose until I die. There are uncertainties in everything, still I feel happier with the usufruct than without.

    What are you babbling on about you silly arse. Farang inheriting landed property from a Thai spouse is not the issue under debate. A usufruct protecting a farang intent on enjoying landed property on the death of a Thai spouse until his own demise can be a potent inducement for unscrupulous relatives to hasten his departure.

    I am quite conversant with Thai law as it impinges on Farang and their albeit limited rights.

    You gormless twat.

    ALso, as Shutree has pointed out so vividly in his anecdote exercising one’s rights as a farang can be at the whim of local authorities and some are dead set against dealing with any farang if it gives them any advantage.

    The Thai spouse's relatives are completely excluded from any land inheritance, whether the foreigner dies or not. If the foreigner is the statutory heir.

    Inheriting an estate that has to be disposed of within a year on such arbitrary termsis not a fucking inheritance of any value which is why you take out a fucking usufruct, you dozy knuckle dragging oaf.
    And any Thai knows that such a distressed sale will be sold at a pittance when the deadline approaches making the poor bastard farang practically give it away.

    But the issue remains, a usufructee living alone out in the boonies can be a tempting target for an earlier demise, as indeed has happened on several occasions in the recent past.

    Eddo McCheddo was able to help a fellow TDer in private about getting a usufruct on a Thai house/land.

    Lawyers wanted 10s of thousands.

    We got it sorted for less than 100 baht


    He now has full legal control of land and house until passing. It cannot be sold, transferred or used as collateral without his legal consent, if he agrees to give consent to it being sold, he still has full and complete legal control until he legally removes himself from the chanote usufruct.
