Clayton Wade Law Suit Update...

When I first introduced this topic and explained that Clayton Wade of Premiere International was suing me (about 3 or 4 weeks ago), I held back some information. I didn't tell you at that he was also suing David Crudduck of Paragon Executive Search at nearly the same time. That's right. I was not the first target on Claytons list. Mr Cradduck was served with papers first in Clayton's home town of Pattaya.
Just isn't that interesting? Clayton swore in his testimony inside his legal complaint about me that everything that I had written on the web site was a complete lie 100%, yet he had the notion to sue the other party.... Hum.... How would Clayton know to sue David?
If David told me absolutely nothing and I fabricated the entire story, then it would have been obvious that Crudduck couldn't have been involved and Clayton would have had no reason to suspect that Crudduck contacted me at all.
Rather, in this case, Clayton knew for sure Crudduck had communicated to me because obviously elements of the email that I received must have been true or very close to the truth....
I think suing Crudduck, and then claiming that I personally fabricated a story is going to weight against Clayton....
But there is another problem.... A bigger problem for Clayton. He has to show up first. That weasel didn't even have the nerve and the respect for the Thai court system to show up for the hearing that he called against Mr Crudduck on the 23rd of February. Crudduck rebuffed Wade by default.
The word from Mr Crudduck was that Wade's attorney made an attempt to delay the proceedings by several months.... what the joke.
If Clayton can't take the time to show up at a hearing that he asked for in his own home town, what are the chances that he is going to take a flight and show up 500Km in the Northeast and show me down? I would say about .002%. Even if he did, I think we would squash him like a bug (metaphorically of course).
People, it looks as if we won't really get a good test of the law on this law suit. Wining by default doesn't really tell us anything.
The hearing is scheduled to occur fairly soon and I'll have another update for you when that shakes out. My guess is that this is going to be a Clayton Wade no show / cancellation. This might very well be just a simple example of a loud, foul mouthed farang who tries to take advantage of other farangs by intimidation.

I should mention That Clayton's offices are about 2 kms from the Pattaya court and Paragons about 1km, Clayton would have to go past Paragons office to get to the court.

The court case is a waste of time and Clayton is basically wasting his money on a Thai lawyer who says he can win, which they all do as they don't do cases on a no win no fee, the complaint has to be translated into Thai for the case, ie galts web page, translations in Thailand are very innacurate and can basically be changed to whatever you like as they haven't got the words we would use in English, if galt went to court with a laptop and went to 10 translation pages to translate his page he would have 10 different versions, how can a Thai Judge act on that?

Not to disparage this fine litigant Mr. Wade, but does he have the stature to be truly damaged by libel? The cost of private attorneys (at least in the USA) usually exceeds any damages that an average person might suffer from a libel. Maybe the laws of Thailand are different. I don't know the facts, but this seems to be some sort of old-fashioned pissing match. How did Wade specifically state that he was damaged and how much is he asking for?

I read the complaint document submitted to the court. The translation doesn't look to be very good. The court will of course use the complaint documents as part of their ruling but what is said at the hearing will likely carry more weight. Also, the court may assign English speaking staff to clarify translation if necessary. The separate complaint against Crudduck is to be expected. Even though your blog contained his emails, charges against you are for your comments re Crudduck emails. Crudduck's charges will be only for what he said in his emails.

A few of the comments you made will likely be what Wades lawyer will focus on to convince the court in their favor. My comments on specifics would be imprudent in this thread.

Oh dear Frankie I'm inclined to agree with you on that.

Indeed it is a crime against humanity to wear your phone in such a way. Maybe that's an old picture but for some reason I doubt it.

The court will not assign translaters, translaters for both Wade and Galt will have to be supplied by them as I don't think either of them have good enough Thai speach to do it in Thai, the lawyers will ask the questions in Thai, the translater will translate probably quite badly, the farang answers, the translater translates again, probably quite badly, as you can guess it will be quite a mess, also they need a Thai translation of galts web page, probably they will both get their own translations done, which should the Judge accept as the proper translation?

^^Understand interpreters will be used in court hearing. The translators I refer to are staff within the court. If judges when reviewing the complaint have problems or questions re the Thai documents in the filed complaint.
I saw the complaint document filed by Wade, it already contains a translation of galt's web site. Unless galt has been told differently by the court, doubt he will need to submit a Thai translation unless the one in the complaint is disputed. Expect Galt will be asked in hearing if he agrees with the translation as filed. Would be wise for Galt to have the Thai bits of the complaint translated to English to make sure their are no significant differences.

BTW: I always thought Galt was a Brit. The Wade complaint says Galt's a merkin.

I've been in a Thai court a couple of times over the years. Pain in the ass but nothing to get stressed over. Certainly not a lawyer but if you think I can assist, PM me.
