It is probably one of those deals where the lawyers get 50% if they win but nothing if they lose. But this being a civil case someone may have to pay Elons lawyers. Who will that be? That's going to be a big chunk.

So I googled it up and it seems that the US is the exception to the rule. Most common law jurisdictions automatically award costs against the losing party (English Rule) who then has to pay the winning party's fees. But in the US (American Rule) each party pays their own fees by default. Although in the US individual rulings can still be made where costs are awarded against the losing party.

Whether Unsworth will have to pay costs will not be decided for some time.

Both sides first have to calculate their costs and submit them to the judge, who will then hold a hearing at a date he has yet to decide.

The judge is free to make Unsworth pay Musk’s costs but could also rule that Musk has to pay his own.

Unsworth has not disclosed if he has taken out insurance against the costs of losing.

When ya look at the big picture Unsworth was vindicated when Musk offered up an apology .

When one offers up an apology it's an admission that one has fuked up and any person with a half brain will take it as such and case closed.

But not the silly fukin Unsworth who now thought he was beyond accepting the apology.

Fuk him, roll him over and shove a scuba tank up his ass.

Musk came out of this smelling like roses and Unsworth came out looking like a complete fookin fool.

Love these stories where some touchy bitch little coont gets well sorted.

Makes me feel all happy eh.

And further more Unsworth kicked it off eh so there is one very good reason Unsworth got his cumuppence.

Forget the fact he participated in rescuing those kids , any coont with his talent and knowledge of cave diving would of done exactly the same thing.

    Fookin bitch he is.

The submarine idea was so extremely dumb - unless the submarine also had crawling through waterless cave and hiking up indoor cave hills capability. Of course, once the cave system was fully flooded and all the boys were dead then the little submarine would have been ideal to recover the bodies.

what was that guy thinking suing in the US? this is the US, not Thailand

maybe better luck if he does the same in Thailand, at least they have a case, and they can use the US precedent as some kind of continuance of litigations

    A few points –

    a) 45 minutes of deliberation means the jury didn’t do much deliberation at all – the verdict was unanimous and quick. Really no question at all in the juries minds.

    b) Juries tend to take their jobs very seriously and do not jump to conclusions. They do weigh all the evidence presented to reach their conclusions.

    c) In four days there is a lot of evidence and testimony presented.

    d) Cost of a four-day trial; how many lawyers involved X how much per lawyer per hour plus court costs plus expert witness testimony (if there were any) – well, this can add up to a considerable sum. Even if Unsworth’s Lawyers were on a no win no pay basis, Musk’s definitely were paid, and probably handsomely. More than likely a very expensive trial for someone like Unsworth with an estimated income of £25k or USD $33k.

    http://thethaiger.com/news/national/...pedo-guy-tweet

The unanimous verdict by a jury of five women and three men was returned after roughly 45 minutes of deliberation on the fourth day of Musk’s trial.

    four-day trial in LA

    http://www.sfgate.com/business/techn...n-14887833.php

Jury foreman Joshua Jones said the panel decided Unsworth’s lawyers failed to prove their case. He said they spent too much time trying to appeal to jurors' emotions and not concentrating on the evidence.

“The failure probably happened because they didn’t focus on the tweets,” Jones said after the verdict was announced. “I think they tried to get our emotions involved in it."
Attorney Lin Wood, in an impassioned and at times emotional closing argument, suggested the jury should award $190 million.

Unsworth hadn't demonstrated actual damage to his reputation other than asserting over a couple minutes of emotional testimony delivered with his voice cracking that he felt isolated, ashamed and dirtied, Spiro said. There was no supporting testimony from his girlfriend or other friends who could discuss the impact they witnessed, no evidence he had lost business or relationships as a result of the tweet and he hadn't sought psychological counseling or medication.

    http://www.theverge.com/2019/12/6/20...t-honors-agent

Unsworth participated in three books and two documentaries, for a total of $3,000 in compensation, which Price characterized as about 10 percent of Unsworth’s annual income. (The income “varies,” according to Unsworth, but is around £25,000, which is about $33,000.)
