Woman in Switzerland fined Bt50,000 for reading husband's email

Woman who read husband’s emails without permission fined £1,150

Zoe Drewett Monday 15 Jan 2018 6:45 am

A woman was convicted of reading her husband’s emails without his permission where she discovered he was having several extramarital affairs. The Swiss woman – who has not been named – was charged with unauthorised intrusion into her husband’s data after she couldn’t resist logging in to a new email account he had created on their shared computer.

She became suspicious of the new account but the couple shared several passwords which were noted down next to the computer, according to the Aargauer Zeitung. She used one of these passwords to access his new account and discovered he had been having affairs with a number of different women for some time. ‘He had been in contact with several women for a long time. I confronted him with his affairs, and he moved out of our flat relatively quickly,’ the unnamed woman from Aargau, in northern Switzerland, said in a court hearing. ‘My trust in him was gone. We did not talk to each other anymore.’

She confronted her husband, who moved out of their apartment and later filed a criminal complaint against his wife for reading his emails. The original charges were brought in February last year when she was convicted in Muri and handed a 9,900 franc (£7,500) fine, suspended on the condition of no further offences in the next two years, and a 4,300 franc (£3,250) fine to cover police costs. The prosecutor said the woman intentionally and repeatedly invaded her husband’s account and downloaded material that was not her own. The computer, an external hard drive and a USB stick were confiscated. On appeal to a district court, the defence argued for the woman’s acquittal, saying that the defendant had not technically ‘hacked’ into her husband’s account, given she already knew his password.

However, her search history revealed that she had checked beforehand whether it was an offence to read the emails, which, the prosecution argued, demonstrated her awareness of the potential illegality of her actions. The court upheld the conviction on the grounds that reading password-protected data without the account owner’s permission is illegal under Article 145 of the Swiss criminal code and punishable with a fine or up to three years in prison. Nonetheless, it significantly reduced the suspended financial penalty from 9,900 francs to 1500 francs (£1,150) because the woman merely had to ‘exploit her husband’s carelessness’ and thus exert ‘minimal criminal energy’ to gain access to the information.

Well I converted for maximum impact, but I'm sure if you edit the story sufficiently carefully you can use it to scare the missus off trying to get into your Tinder account.

If you put 2 sim cards in a Samsung phone, you can have 2 Whatsapp accounts, 2 Line accounts and 2 accounts of everything really. One on show and one of all those accounts can be hidden in the secret 'secure folder,' which you can customise the look of, password protect and rename to Footy results, if you're a sneaky fucker

Theres also a browser, email client, calendar, gallery and To Root list in there,

Samsung has added its Secure Folder app and file encryption tool to the Play Store

He creates his cheating account on a computer he shares with his wife and leaves the password on a sticky note beside the computer. Not the sharpest spanner in the toolbox.
