Who would be at Fault. ?

The truck driver could say he had pulled out to move off and the bike rider pushed his bike out without checking.

Maybe that's what happened in this case.

    I don't know.
From what I have seen, it would be the truck driver's fault.

Ha, even though I am a member, I have not posted for quite a few years. As said, if a foreigner feels they are not at fault, stand firm and see where it takes you. The odds are not in our favor and if a Thai does give you damage money, consider yourself very lucky.

I recon you would have a hard time proving that.

If Pom was looking at his mates in the restaurant and not paying attention it's perfectly feasible that he had pushed his bike to far out as the truck driver had began to move off.

    In fact,

The truck driver could of and more than likely did check his mirror and as he moved off Pom pushed his bike out at precisely the wrong time.

It would be nice if there were a street CCTV to look at the incident and then we might know. Otherwise, we are relying on what is said and how things look after the fact. In other words, we are guessing.

CBR650, nice little runabout but cheap. No worries.

Was probably on the phone to his insurance rep.

Judging by the front of the truck, it's not the first time he's done it.

    Exactly.

I recon the only one who really knows what went down was Pom.

Somchai had no fookin idea what had happened as did all others milling around, hence why no one entered in to it.

I did feel Poms pain though as he stood looking over his new ride.

I had an accident last April with a Thai bird and won the day.
Now as a bike rider and racer for many years I put myself to blame even tho , technically it wasn't my fault.
Standing at the lights Tesco lotus Phuket heading south to Central and a guy on a forza pulls in next to me and starts up a convo about my Ctx.
We gets to yapping away when he looks up and starts pulling away. The lights were go so without turning my stupid pin head for a look I pull away also. I'm on his right and take the full hit from a Thai bird turning right and fucked the whole front end and every plastic panel .
The Thai bird was sprawled out unco and as I heard later had a busted collarbone.
Police guy on a bike saw everything. Police report was she went right on the red ao my insurance paid out and I got away with scrapes and bruises. A lesson learned even after many years on a bike its still was to fuck up if not 100% right on the ball.

I'll bet Pom never ever makes that mistake again.
Such as parking his lovely over-sized scooter in the middle of the street.
    Things happen.

I would just like to add to this story how road rules mean absolutely shit to the Thai.

The thing that always confuses me is how Insurance companies work out claims considering the Law here is fuked.

Here on Silom the Council repaired the cross walks to International standard, flashing lights, bells and all the whistles. They really had done a great job.

Thing was, it was dangerous as fuk for the International newbie tourists that plied Silom.

They actually thought that these cross walks were safe and the traffic would stop at the Red light.

    Like fuk,

I shit you not, after two weeks the council disconnected the power to those cross walk lights and now things are right back to normal.

    Much safer for all concerned.

    Fookin brilliant innit.

here are some "recently upgraded to international standards" pedestrian crossings in pattaya, showing their effectiveness.

you may want to turn the "benny hill" music down.

Might have been a rental bike and he was phoning to report the damage in advance in fear of a jetski type scam.

Anyone reversing a vehicle into a flow of traffic is asking for trouble. I see pickup trucks here reversing out of driveways onto a dual carriageway expecting approaching traffic to avoid them.
