so shagger, in your case, both the lease holder and owner hold a deed.?
in both of my leases there is only one deed. and i hold one the owner holds the other. i'm just wondering if the owner can borrow money on a leased chanoot.

Yes mate was done in Phuket circa 2006.
There's lots of conditions in my favor on the back of the chanote.
Doesn't add up to a hill of beans if relations get nasty.
I would be standing dick in hand if the land holder wished it that way.
In my case the land holder can not borrow money against the property whilst the lease is in term. It's been tried and failed unless I was to sign off on the lease.
This was doing things legally thru the banking system .
Illegally thru whatever means , who holds chanote wins ..
