    Chief Justice James Allsop says the court may reconvene "this afternoon or perhaps tomorrow morning".

    Yeh, agreed.

    IMHO grounds for cancelling the Visa and the strength a potential argument.

    But the guys with the high pay-cheques think otherwise.


    Maybe the government see the best public opinion if he remains in the country.

    They can say they are 'tough on boarders' but then go to say the decision was taken out of their hands by the Federal Court.

    Providing false information doesn't appear to be a part of the government's argument. They have given him a slap wrist for that but say the effect is neutral...

    I guess they lost that line of argument in the first court case when the prosecution basically waved the French flag...

    I do not really understand why the court is weighing the merits of the decision. They should be confining themselves to the legality of whether the minister was acting within his legal authority.

    As you illustrate, the answer has already been decided.

    I suspect the "grounds/merits" of the minister's decision may or may not meet the legal extents of his actions, as defined by the OZ laws.

    Here is an example:

    Ministerial intervention under sections 351, 417 and 501J of the Migration Act 1958

    "Circumstances not anticipated by relevant legislation; or clearly unintended consequences of legislation; or the application of relevant legislation leads to unfair or unreasonable results in your case. Documents to demonstrate:


    • that you have circumstances that were not anticipated by the legislation relevant in relation to the visa that you were refused
    • how legislation or policy did not intend that a person in your circumstances would be refused a visa
    • how the refusal of your visa has led to an unfair or unreasonable result.
    • how the refusal of your visa has led to an unfair or unreasonable result."

    As an OZ federal judge has already found that the refusal of the tennis player's visa has been found, "Unreasonable".

    That lucky player will be randomly drawn from the top four ranked players who lost in the final round of Australian Open qualifying.

    To be eligible, the players will have to sign up tomorrow.

    So what does this mean?

    OK so that's the news we've been waiting all day to hear.

    As Chief Justice James Allsop outlined before announcing the decision, the court's job was simply to consider whether the decision made by Immigration Minister Alex Hawke was unlawful, irrational or legally unreasonable.

    The court found the grounds outlined by Novak Djokovic's lawyers failed to demonstrate that.

    It means the decision made by the Immigration Minister Alex Hawke to cancel his visa stands.

    Djokovic will be deported from Australia, will be unable to compete in the Australian Open and may face a ban on entry to Australia of up to three years
