An adultery law, under which a married person can sue for divorce from their spouse and demand compensation from them if they are found to have had sexual intercourse with a third party, came into force on January 22.
The law is an amendment to Section 1523 of the Civil and Commercial Code, in line with § 27 (1) and § 27 (2) of the Thai Constitution, and ruling 13/2567 by the Constitutional Court.
If, however, one party in the marriage consents to their spouse engaging in sexual intercourse with a third party, they cannot demand compensation.
By coincidence, the adultery amendment comes into force on the same day as the Marriage Equality Act, which legalises same-sex marriage in Thailand.
