    Indonesia set to pass new criminal code that will ban sex outside marriage

    Indonesia is expected to ratify sweeping changes to its criminal code on Tuesday, senior officials confirmed, in a legal overhaul that critics say could wind back hard-won democratic freedoms and police morality in the Southeast Asian nation.


    Among the most controversial revisions to the code are articles that would penalise sex outside of marriage with up to one year in jail, outlaw cohabitation between unmarried couples, insulting the president, and expressing views counter to the national ideology, known as the Pancasila.


    Deputy speaker of the House of Representatives, Sufmi Dasco Ahmad, and Bambang Wuryanto, head of the parliamentary commission overseeing the revision, told Reuters on Monday that parliament would hold a plenary session on Tuesday to ratify the new code.


    The government and House of Representatives have agreed on the draft code, clearing a hurdle to its passage.


    Decades in the making, the revision of the country’s colonial-era penal code has sparked mass protests in recent years, although the response has been considerably more muted this year.


    Parliament had planned to ratify a draft new code in September 2019, but nationwide demonstrations over perceived threats to civil liberties halted its passage.


    Legislators in the world’s third-largest democracy have since watered down some of the articles deemed most contentious.


    Revised articles on sex outside marriage and cohabitation, for example, now state such complaints can only be reported by close relatives such as a spouse, parent or child, while insulting the president can only be reported by the president.


    But legal experts and civil society groups say the changes don’t go far enough.


    “This criminal code is a huge setback for Indonesia,” said Bivitri Susanti, a law expert from the Indonesia Jentera School of Law.


    “The state cannot manage morality,” she said. “The government’s duty is not as an umpire between conservative and liberal Indonesia.”


    Articles on customary law, blasphemy, protesting without notification and expressing views divergent from the Pancasila were all legally problematic because they could be widely interpreted, she said.


    Once ratified, the new code will come into effect after three years as the government and related institutions draft related implementing regulations.

    Cohabitation and sex outside marriage are already frowned upon. So no change there. Maybe the changes are for the better because they are clarifying who can instigate a complaint.

    Revised articles on sex outside marriage and cohabitation, for example, now state such complaints can only be reported by close relatives such as a spouse, parent or child,
    This sounds problematic as Muslims may have more than one wife whereas Christians cannot. So if a Muslim wife complains, she may then end up with a new family member.

    It is also possible that this is a relaxing of the laws. Now "curtain twitchers" cannot instigate a complaint but a pregnant daughter's family can.

    It is. Nice people, some beautiful scenery, sunshine and palm trees, but can be a bit grubby in places. Street food is not up to Thai standards, but i don't generally eat that either.

    No reason to be sorry, yours was a perfectly reasonable reaction. I thought of exactly the same when I read the article.
    A country can be beautiful and it's people wonderful and still be a shithole. Though I think I would disagree with the "people wonderful" , wonderful people do mot allowed such behavior and laws.
    Some might say , that the people don't have much choice.
    I disagree, some people have no choice but when a preponderance acquiesce... How wonderful can they be?
    Then IMO for the most part they are not wonderful.
    The sooner you fall behind, the more time you have to catch up.

    I've had a couple Willy but are you using my Thesaurus?

    As gay marriage of Indonesians banned, this effectively limits cohabitation disproved of by conservative parents etc.

    Will they recognise foreign same sex couples.

    Must be good news for competing places like Vietnam and here, where I read assault and rubbery is in grate demand.

    Some hotels already do ask for copies of your marriage certificate at check in. In my opinion the problem will not be authorities prosecuting an unmanned couple but the wider fallout where every petty little village chief or posse of morality women/men in each village will be emboldened to vigilante enforcement of this new law…

    The wife and I stayed at the Bangkok Christian Guest House(off Silom) two times.

    First time out of convenience, cause she was going to the hospital next door.


    They were somewhat sceptic about letting us in, looking as farang/whore and all.
