PH Coast Guard stops China navy incursion near Palawan resort town

MANILA, Philippines—The Philippine Coast Guard (PCG) recently expelled a Chinese navy ship near Marie Louise Bank, which is about 309 km off El Nido town in Palawan province.

“Chinese warship 189 vicinity waters Marie Louise Bank, this is Philippine Coast Guard MRRV 4409….You are within Philippines’ exclusive economic zone,” Cmdr. Erwin Tolentino, of PCG vessel BRP Cabra could be heard as saying in a video footage of the PCG’s radio challenge on Monday (July 19).

“Your actions will affect Philippine-Chinese relations and will be reported to concerned authorities. You are advised to leave this vicinity, over,” Tolentino was heard saying in the radio challenge.

    PCG shared the footage.

The incident between BRP Cabra and Chinese navy tugboat 189 happened last July 13. The PCG used its long range acoustic device to issue a verbal challenge against the Chinese ship.

The PCG ship sailed closer and followed the Chinese ship to make sure that it would leave the Philippines’ EEZ. When they were 500 to 600 yards away from each other, the Chinese ship sent a radio message:

“Philippine Coast Guard 4409, this is Chinese Navy Warship 189. Please keep two nautical miles distance from me,” the Chinese ship was quoted as saying.

The same PCG ship drove off Chinese and Vietnamese fishing vessels in the same area early this month.

The Philippine government stepped up its maritime patrols after the large-scale incursion of Chinese militia vessels in Julian Felipe (Whitsun) Reef early this year.

Philippine sovereign sea is 12 miles from shore.

    UNCLOS is specific.

That have factual definitions as published in UNCLOS.

    Some UNCLOS definitions:

    "SECTION 2.

    LIMITS OF THE TERRITORIAL SEA

    Article 3

Breadth of the territorial sea Every State has the right to establish the breadth of its territorial sea up to a limit not exceeding 12 nautical miles."

    Article 57

Breadth of the exclusive economic zone

The exclusive economic zone shall not extend beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured.

    Article 58

Rights and duties of other States in the exclusive economic zone

    1. In the exclusive economic zone, all States, whether coastal or land-locked, enjoy, subject to the relevant provisions of this Convention, the freedoms referred to in article 87 of navigation and overflight and of the laying of submarine cables and pipelines, and other internationally lawful uses of the sea related to these freedoms, such as those associated with the operation of ships, aircraft and submarine cables and pipelines, and compatible with the other provisions of this Convention.

    2. Articles 88 to 115 and other pertinent rules of international law apply to the exclusive economic zone in so far as they are not incompatible with this Part.

    3. In exercising their rights and performing their duties under this Convention in the exclusive economic zone, States shall have due regard to the rights and duties of the coastal State and shall comply with the laws and regulations adopted by the coastal State in accordance with the provisions of this Convention and other rules of international law in so far as they are not incompatible with this Part."

One subject which UNCLOS does not determine is, "Sovereignty of ownership".

That is left to others, if requested by the two parties in dispute.

You are too daft to understand that if you apply UNCLOS rules on a map then it will be lines.
Spratley Islands and Marie Louise Bank are very far away from a chinese UNCLOS sea line regardless of it is a territorial sea line or an economical zone line.

Whilst I deplore the way the Chinese are militarising the South China Sea, is it fair to say that 309km is 'near'? That is further than Korat is from Bangkok.

200 nautical miles (340 km) is the max length from a country's shoreline to the end of its exclusive economical zone, it can be shorter if it is overlapping with another country.
The chinesiums are known for not announcing their entry into another country's exclusive economical zone and that is most likely why the phills expelled them.

Indeed, this Chinese probing of the readiness of others to challenge them is a constant irritation, as it is designed to be.

I am only taking issue with the reporting, it feels a bit alarmist to make the headline 'near' and then tell the interested reader that the distnce is 309km. For me, if I can see it from the beach, that would be 'near'. Only my opinion.

    ^correct...
General Belgrano was sunk outside the 200-nautical-mile (370 km) total exclusion zone around the Falklands, delimited by the UK. Through a message passed via the Swiss Embassy in Buenos Aires to the Argentine government on 23 April, the UK made clear that it no longer considered the 200-mile (370 km) exclusion zone as the limit of its military action.
