    Govt Cracks Down on Thai Nationals Acting As Nominees for Foreigners

    The Business Development Department is planning to lodge police complaints against seven Thai nationals it accused of acting as nominees for foreign real estate and tourism companies in Thailand.


    The police complaint follows the department’s probe into the matter, which was launched earlier this year, Business Development Department’s director-general, Thosapone Dansuputra said.


    Since January, the department has investigated the operations and management of three business sectors, real estate, tourism and hotels, in 9 provinces, namely Phuket, Chiang Mai, Koh Samui in Surat Thani, Krabi, Phangnga, Chon Buri, Prachuap Khiri Khan, Phetchaburi and Bangkok.


    The provinces were chosen as they are popular among foreigner investors.


    Most of the cases involve Thais who had willingly accepted to act on behalf on a foreign partner, or lawyers who advised clients to appoint a Thai nominee to get around certain laws, he said.


    Mr Dansuputra said that the investigation found two tourism businesses and three real estate developers in Chon Buri and Prachuap Khiri Khan used Thai nominees.


    Thai law permits foreigners to own up to 49% shares in a business in Thailand. If proven guilty, the seven face jail time of up to three years and fines of between 100,000 to one million baht.


    The director-general said the department will expand its investigations to target fruit brokers in Phuket, Chiang Mai, Surat Thani, Krabi, Chon Buri, Rayong, Prachuap Khiri Khan, Phetchaburi and Bangkok.


    Mr Dansuputra said the department will ramp up inspections next year and educate both Thai and foreign businesses to obey investment laws.


    Large investments by Thais are often conspicuous so they are easy to investigate, he said, adding the Tourism Authority of Thailand, Department of Special Investigation and Tourist Police have been called to join the crackdown.

    Looks like a token crackdown, so all those folk that "own land" in Thailand can probably relax.

    The Law has bean in force since the 70's or 90's at least since the previous constitution? cant remember, but the loopholes are being blocked, The Thai government is simply enforcing its laws now. Fact is that Law is Law,
