200 hotel employees have not been paid for 6 months

At least 200 hotel employees have not been paid for 6 months, they are now asking the Chiang Mai Governor for help. These are employees of a famous hotel who chose to remain silent believing that they will get back to work. But after 6 months the hotel is still silent. The group contacted INN News on 30 September 2020 revealing they will be going to the Chiang Mai City Hall on the 1st of October. The group will hand in a complaint to the Chiang Mai Governor because he is the hotel’s registrar. The affected employees demand the hotel be ordered to close down permanently. This will raise the chance for the employees to get their compensation payments from the Labor Court.

A representative from the group stated that it all started when the Covid-19 situation began. Up until now, the hotel has moved its reopening date 2 times. Last time the hotel promised employees to reopen on 1 October 2020. Before the opening date employees decided to visit the hotel but it was in terrible condition. The computers are gone and the buildings have no electricity. The hotel power transformer is gone because the business is in serious debt. Employees believe that the main reason why employees have not been paid for over half a year is that the hotel’s original executives have been replaced. The new executives are from a company with issues in the stock exchange market. This new team has taken over the hotel and since then employees are left empty.

The hotel employees have been seriously affected by the problem. Their families have no money and are struggling to find food every day. They have received unclear answers with no fixed date on when or will they even receive their hard-earned salary. The group hopes that the Chiang Mai governor can help solve the issue, so they can all continue on with their life. The employees have waited patiently believing that the hotel will fulfill their promises. Their hopes were crushed when visiting the hotel, it was clear that the business would remain closed.

If the hotel has been stripped for debts, they have no hope.

    It resolves to redundancy money.

If it is right the hotel ceased trading with no intention of re-opening then under Thai employment law the employees were entitled to some form of severance pay. Sounds as if the owners are /were seeking to avoid their obligations.

    How ?

They were not sacked just temporarily stood down due to covid, I'd also venture to say whilst they were "employed" by the hotel I suspect it was more of a "cash in hand arrangement" type employment rather than legit tax and social security paying employment.

    Yes. From my link:

A group of 70 workers, representing over 200 employees at a luxury resort in northern Thailand, have filed an official complaint with Chiang Mai’s Department of Labour and Welfare, claiming they have not been paid for 4 months. Thai Residents reports that the workers are all from the 5 star Dhara Dhevi resort in Chiang Mai, which closed its doors for good in early May.

Former employees say they received only 50% of their salary in February and 25% in March. They have not received any payment for the months of April and May. Monthly salary amounts range from 9,750 baht to 100,000 baht, with workers claiming to be owed over 10 million baht in total.

    Just fancy that:

    Jan 10th

The government is wooing investors to take over Dhara Dhevi Hotel Chiang Mai by setting a low reserve price for the auction.
The Legal Execution Department will open the auction for the property next month at a price of Bt2.116 billion.
The Court of Appeal had earlier dismissed a petition for rehabilitation of the hotel, as a result the hotel has to go into bankruptcy.
Recently, it was reported that the department had announced the auction of Dhara Dhevi Hotel on February 18, at the Chiang Mai Legal Execution Office, with a starting bid of only Bt2.116 billion. The overall price would be less than half what Inter Far East Energy Corporation Pcl had paid in 2015 for the acquisition, which involved the final price of Bt2.52 billion but exceeded Bt4.3 billion when outstanding debt was taken into account.
Dhara Dhevi Hotel Chiang Mai opened in 2002 as a 5-star hotel with ancient Lanna style architecture, located at Tha Sala subdistrict in Chiang Mai province.
Spread over an area of approximately 153 rai (24.48 hectares), with 123 rooms, it is located in the middle of Muang Chiang Mai district.
The hotel completely shut down on November 18, 2020, after business was hit badly due to the Covid-19 outbreak.
    Feb 3rd
Plans to auction off the bankrupt Dhara Dhevi Hotel in Chiang Mai have been suspended after its operator opposed the Legal Execution Department's reserve price of Bt2.116 billion.
Inter Far East Energy Corporation (IFEC) chairman Thavich Taychanavakul said an independent assessor estimated the hotel was worth Bt3.728 billion, adding that Chiang Mai Provincial Court will investigate the case on March 15 this year.
Dhara Dhevi Hotel Chiang Mai opened its doors in 2002 as one of Thailand’s top luxury resorts. Boasting Lanna-style architecture, its 123 rooms sprawl across 153 rai (24.5 hectares) in the middle of the northern capital’s Muang district.
The hotel closed operations on November 18 last year after business was badly hit by the Covid-19 outbreak.
Perhaps Mr. Chairman hasn't factored in that this hotel is going to be a millstone around the neck of whoever purchases it until at least fourth quarter if not into 2021.
