    A British woman accused of stabbing her husband to death in Malaysia has entered court for a murder trial that could result in her being hanged.

    Samantha Jones, 51, was wearing a mask and handcuffs as she was escorted into court in Alor Setar in the northern state of Kedah.

    Jones, who is originally from Somerset, was charged after police found a 30cm (12in)-long blood-stained knife in the couple's home where John William Jones was found dead on 18 October 2018.

    Police have said Jones confessed that she stabbed her 62-year-old husband in the chest during a heated argument.


    The couple moved to the tropical Langkawi island more than a decade ago under the Malaysia My Second Home programme, which gives foreigners long-staying visas.

    A conviction for murder carries a mandatory death sentence by hanging in Malaysia.

    Execution is also a mandatory punishment in the country for drug-trafficking, treason and waging war against King Yang-di-Pertuan Agong, its constitutional monarch.


    The only other Briton to be sentenced to death by hanging in Malaysia is Derrick Gregory, who was executed on 21 July 1989 for drug trafficking offences.

    I rather think it is an open-and-shut case of manslaughter at worst. Silly woman should have claimed self defence against an abusive husband in the course of a violent domestic squabble from the outset. Why she has to appear in handcuffs is ridiculous - typical Asian third world shit. That murdering thieving pig of an ex-PM wasn't cuffed.

    Absolutely true, he was wandering around in a business suit looking presidential as he was not guilty until proven so. Now he is guilty the suit will continue as he he is not guilty until every court of appeal has told him so and the Agong has failed to give him a Pardon., which being he is also from Pahang is quite possible.

    Samantha Jones, 54, broke down when she was told her charge of murder had been reduced and she no longer faced death by hanging.

    Instead the ex-insurance clerk from Somerset had been found guilty of "culpable homicide without intent" for stabbing her husband of 17-years, John Jones, 63, to death during a drunken row.

    The new offence carries a maximum penalty of ten years imprisonment to a fine.

    Samantha is set to be sentenced later on today.

    They are not the same court but you have to understand where the case starts and how far it can reach. The subordinate courts such as the sessions court only deals with matters up to RM1m and you can only go up to the Appellate Court. If you start in the High Court you can go one step higher to the Federal Court, it is an appeal against the decision of the appeal at the Appellate Court.

    The Appellate Court has one judge who hears a motion. Whilst he has powers similar to the High Court he is most unlikely to allow any new evidence or charades, just listen to the motion. He has access to all the court papers and evidence including the High Court judge's notes.

    Being High Court originated, coudl then proceed to the Federal Court.

    You would think 3 layers would be enough to winkle out any mistakes as to the law.

    Appellate Court and Federal Court will take four to five months each, they do not expect Bossku to see a day in prison for about a year.

    So you are right, "not every court of appeal" is wrong, mea culpa. But the Federal Court is the highest court and the final appellate court in Malaysia for cases started in the High Court, since they stopped sending matters to the Privy Council in England in the 1980s.

    But what will become clear is that an appeal to the Federal Court is not automatic. An application for leave of the Federal Court is needed before you can sully their doormat with your documents. Just as in all other properly run court systems there has to be a matter to be decided for the first time or a question of importance where such a decision would be to public advantage.

    Bossku obviously believes that being a top knob is sufficient, but the only grounds "Just Call Shaffee" came up with last week were either patently false or were factual findings that no appellate court will change. the appellate court is not going to rehear the case in its entirety.

    As to her case, I see she has been found guilty of "culpable homicide without intent". She could go to the Appellate Court but i doubt it, unless the sentencing is wildly wrong.

    Apparently she had been abused for years and it was in a drunken row. TD legal team must have been on the case!!!!!!

    Maximum ten years.

    So a bit less than 2 years to go. May get early parole 2/3rds of the way in.

    Agree, manslaughter on appeal is more convenient than mandatory execution for murder that would make the Brits grovel, though it may cost the Aid budget an extra hospital or two.
