    Currently, the following types of visas are NOT permitted to enter Thailand: Tourists visa (TR), Transit visa (TS), Sports visa (S), Monks and other religious visa (R), Retirement visa (O-A/O-X), Thailand Privilege Card (Elite card), Volunteers (O), and non-formal students visa holders (such as language schools, diving schools, boxing schools).

    This is how I interpret the info -
    If you request a COE on the basis of an O-A or O-X visa you will be
    denied - if you request a COE on the basis of being married to a Thai (provide a copy of your marriage certificate) your application will be considered. If you entered Thailand with or currently have an O-A/O-X visa you will have to apply for a Non Imm O Visa on the basis of your marriage.

    As is always the case - "at the discretion of" the individual reviewing your case. You are presenting yourself as having a valid reason (family
    separation) to enter/re-enter Thailand. You are willing to jump through all the hoops they have established; testing, quarantine, insurance, and all the costs associated.

    Lots of hoops, only someone who really needs to enter Thailand will be willing to do the dance...

    It is bizarre and somewhat typical of the Thai to create a muddle and turn a situation into a torment simply because they cannot think things through.

    So, a legal resident on an extant retirement extension with a valid multiple re-entry visa living in Thailand with his spouse cannot re-enter Thailand unless he applies for a Non - Imm. 'O' visa in addition to all the other requirements?

    I can't see the logic of that and cling to the belief that even the Thai could not be that stupid.

    Well, we cannot say that is certain. Logic may well happen. You/I/He/She will go to the Royal Thai Embassy and present our case and factual data to support our claim. "At The Discretion Of" whoever is the embassy official.

    Interesting to note - when I visited The Royal Thai Consulate in New York City I spoke in Thai to the Thai standing at the counter. He replied "I do not speak Thai". He was an American of Thai descent who never visited Thailand and had a part time job at the Consulate. The point being, even though you may be presenting your case to a Thai Embassy - the "At the discretion of" person may not be Thai. And, a great flexibility may, or may not, be applied to their interpretation of the requirements.

    Yes, it is a lottery, however, as with anything, you would be smart to stack the deck in your favor with polite inquiries and a smile, as opposed to an attitude, why do they make it so difficult...

    Officialdom is always best avoided. Offloading it to one's "assistant", to manage such things, is always preferable.
