BANGKOK (NNT) - The Supreme Administrative Court reversed a ruling of the Administrative Court regarding the selection of private firms bidding to participate in the U-tapao Airport development project and Eastern Aviation City project; it delivered a ruling in favor of Thana Holding Co, a firm affiliated with Charoen Pokphand and partners.
The Supreme Administrative Court ruled that the occasion on which CP Group had submitted technical and price bids nine minutes later than scheduled, by no means affected the implementation of the projects nor rendered advantages or disadvantages to any other bidders, adding that the bidding process provided for a delay in the submission of bids. Therefore, Thana Holding Co had by no means violated the relevant law.
In addition, the Supreme Administrative Court ruled that the selection committee, being the accused party, had reserved the right to consider all three bidders’ proposals and pick the one providing optimum benefits to the state. Thus, the ruling of the Supreme Administrative Court has provided for Thana Holding Co to participate in the bidding process for the
U-tapao airport project, as it had intended.
Thana Holding Co had sued the selection committee involved in the 290 billion baht U-tapao Airport project and Eastern Aviation City project, for not accepting the firm’s bid. The Administrative Court lifted the lawsuit.
