    Illegally held Sor Por Kor land plots will be taken back and re-allocated to the land

    Thailand’s deputy Agriculture Minister Thammanat Promphao has vowed to seize all the Sor Por Kor land plots, or land plots which should be allocated by the state to landless farmers under the Land Reform Program, and reallocate them to the landless.


    The deputy agriculture minister said Sunday that he had set up a committee to solve the problem of Sor Por Kor land plots across the country, many of which are being held by non-farmers and those who have used the land for other purposes, such as building resorts.


    He said that land illegally held by non-farmers must first be confiscated and then be redistributed to the landless, mainly for agricultural purposes or for community tourism if the land is not suitable for farming, but an approval is needed from a committee which is yet to be set up.


    There are about 2.4 million hectares of land under the Land Reform Program, of which 2.16 million hectares have been allocated to landless farmers and the poor on which they can make a living.


    The remaining 240,000 hectares are yet to be allocated because land surveys cannot be undertaken due to legal problems.


    Thammanat said that about 800,000 landless poor have signed up for Sor Por Kor land and they are still waiting for their allocations.


    Sor Por Kor land plots cannot be sold or transferred to non-farmers or used for other activities besides farming. They can, however, be inherited by the next of kin of the original recipients.

    First rule when buying land in Thailand. Do not build on Sor Por Kor titled land.


    Edit: Sorry I should have said 'when building a house in Thailand do not build on Sor Por Kor land'.

    And to add to that I think only 25 Rai can be held, I won't say owned as you can't own Sor Por Kor land, per person.

    Thing is if they check some of this land has changed hands numerous times, so the last sucker will take the hit - the previous seller and the original get away scot free?

    Agreed but the Thais know the score when buying land here. It's a case of 'fingers crossed' that they don't get caught. I believe land disputes, due to selling of Sor Por Kor land, to be the biggest bottleneck in Thai courts.

    PATTAYA: -- A British man and his Thai wife have called for justice after they lost out on a land deal.

    Philip Coghlan, 66, and his wife Sommai had bought land and erected an expensive house with swimming pool and maid's quarters on the property.

    But on the day they moved in they found out to their horror that the land was to be compulsorily purchased to build a new road.

    There was nothing they could do - but instead of receiving their money back they have been given 9 million baht. This was after they invested 23 million baht.

    They complained to the relevant authorities and have been told bluntly that all they can do is appeal the figure they have been offered.

    They bought the land from a local "Phoo Yai Ban" (village elder) in the Banglamung area of Chonburi who assured them that there would be no road going through that area.

    "The Thai people are great and it is lovely to live in Thailand," Philip told reporters. "We just ask for fairness in this matter and a fair valuation of the land".

    Back home, they would hire a lawyer/solicitor to do surveys and ensure that there was no planned highway/road/trainline etc going to be built on or nearby.

    Why do idiots buy land in a foreign country and not worry about performing those same checks?

    I think I read somewhere that those who built a resort illegally on their Sor Por Kor land may not necessarily see it destroyed, the relevant agency may propose to the "owner" to pay a rent for their resort.

    How does this fit within the confines of this related discussion.

    Might be asking how extended Wat land is legally categorized.

    I've witnessed, or know of, resort/hospitality-type of businesses that were built upon broad Wat land.

    My wife and I have purchased several properties over the years and always perform your checks. Never a glitch.

    Those who follow their wife's do it the "Thai way" advice are indeed idiots and deserve to lose their asses.

    And no doubt will follow by blaming Thais for being a corrupt, farang hating bunch rather than admitting they themselves fucked the pooch.

    When buying land in Thailand to build on you don't really need to do those checks if it is full 'Chanote' titled land. The title 'Chanote' is basically your guarantee against fcuk ups. This is why Chanote title land cost more and is highly prized.

    The usual legal problem with Sor Por Kor land is that the original title older sells it off before they die and does not notify the next of kin. Come their death the family members find out the land was sold without them knowing. This is where the court steps in to decide ownership. High chances are the family will get the title paper.

    You can't actually transfer names and money until taxes have been paid at the local land office and the papers proven to be genuine.

    Very complex subject, land titles and use, there are more types of land titles than most think.

    Since the introduction of the cadastral land system in Thailand, things have changed greatly, that's why most Thais believe in the old local rules.

    Charnote title does not give a right to build a house, resort or nuclear power plant, it is freehold yes, but land use is control by what ever a government agency runs that area.

    Where I live very little charnote land, most of it is along the 2248 and is green zone controlled by the Land development board, they are the top dogs in land usage. If you are computer literate you may be able to find a map of the zoning in your area, the land office will have one.
    Tthe LDB and some other government guys came by a few years ago and slapped demolition orders on anything built on green zone land [charnote title]

    Sor Por Gor land, as the land is a national title, think this will be enforced the same all over, when the charnote people came they didn't care who the original owners were. If the present user was farming the land, it was not over the family or individual limit and there was no dispute from others about ownership, the charnote was issued.
    Sor Por Gor land is a use it or lose it title, 3 years of laying idle and technically you lose the right to have it.
    Also the 10 year rule applies, user farms any land without dispute, 10 years pass and it's yours.

    There is another land type title out my way, populate the land border near Lao, land was sold very cheap around a big dam/lake' Idea was people would settle the area, after 10 years and they had an operating rubber, palm oil or cashew nut plantations, a charnote title would be issued [land had already been surveyed].
    Lots of city people bought in, hope being that the title would be issued with no checking, LDB came and confiscated all the land that was not an operating plantation.

    This introduction of the cadastral land system is big picture stuff, the nations wealth grows as land and home prices grow.

    Lots of these dodgy deals seem to involve land 'adjoining' national parks.

    Another example is land near the Black Mountain golf course in Hua Hin, which has been subject to legal wrangling for years.

    A few years ago we looked at some seemingly impossibly inexpensive land bordering the beach in Pranburi.

    A year after seeing it I read of the scam in The Bangkok Post.

    It does seem that one has to be particularly wary of land boasting beach access or close proximity to it.

    Many farang will want to see pics of the nearby beach, the double car park or whatever when looking at an ad. for a property.

    The Thais will want to see a pic of the Chanote.
