Unless they have the means and motivation to spend the rest of their lives avoiding extradition, not necessarily a good move.

Based on legal precedent they are looking at ten years in chokey.

PHUKET CITY: Briton Paul Chetwynd-Talbot was sentenced to 10 years in jail today for the murder of his girlfriend, Debra O’Hanlon, on July 31 last year in the Patong room the couple shared at the time.

The 32-year-old accused and his lawyer, Somsak Chattay, had hoped for a reduced charge of manslaughter, arguing that Chetwynd-Talbot had not intended to kill Ms O’Hanlon.

Judge Nopparat Suwannakorn, however, pointed to forensic evidence indicating that Chetwynd-Talbot had hit Ms O’Hanlon very hard in parts of her body that could have caused death, and sentenced him based on a charge of murder according to Section 288 of the Thai penal code. This offense carries a penalty of 15 to 20 years in jail.

The sentence was cut by a third because Chetwynd-Talbot surrendered to police after the murder and admitted in court that he had killed Ms O’Hanlon.

After today’s hearing, Chetwynd-Talbot maintained that Ms O’Hanlon’s death was “fundamentally an accident”. He told the Gazette, “I threw one punch that I shouldn’t have thrown and this resulted in the girl’s death.

“I wasn’t expecting to be charged with murder. It seems there is no way of bringing that charge down.”

He noted, however, that his lawyer had told him that, given good behavior, he could be out of jail in five years. The time he has already spent in jail awaiting trial will also be deducted from the remainder of his stay in jail.

less than 3 years isn't a bad sentence for murder, if you can get it.

I don't think they even follow the 'precedent' system in Thailand, do they? Doesn't each judge make a decision based solely on the circumstances of each case? (And the size of the backhander, obviously...)

So the American was defending a Thai woman who was being attacked by the Australian by punching him and knocking him out.

Up until that stage everything was good but the continued attack being stomping on his head while unconscious is totally out of order and which obviously caused his death.

I doubt he will get a self defence verdict even though his original action was justified.

Still kinda sounds like the Yank should get a public service award....

The original offence was created by the Aussie, the Yank intervened by protecting the woman by knocking the scum out, the police could have been called (the police station is 5 minutes walk away), a report would have been filed with the Aussie being taken to the police station with deportation being the probable end result.

A life changing event for all involved.

Polanco was charged with murder in the second degree by North Miami Police in 1993. Court documents seen by news.com.au reveal Polanco, who was then a teenager, killed Michael Cooper after receiving $20 for looking at a problem with Mr Cooper’s car.
“[He] told detectives where he disposed of the murder weapon, which was not recovered, and where he disposed of his own bloody clothing, which was recovered,” the court documents stated.
He was initially sentenced to 12 years in jail but was released after two years behind bars when the charge was downgraded to manslaughter with a firearm. After he was released he spent five years on probation.

Could be a lot worse though - and he handed himself in. If he pleads guilty it could be a lot better than first feared.

He was initially charged with injuring others causing death, punishable by 3-15 years under the Criminal Code.

Would that be taken into account by a Thai court?

So the Yank has a prior conviction being manslaughter with a firearm.

Any prosecuting lawyer would use that information in court.

Obviously when applying for a visa here you do not need to reveal prior convictions and disclosing that you have spent time in jail.

I wonder what that would do to the TOT numbers if it was a prerequisite, as it is when applying for a tourist visa when entering other countries.

The Yank has already done jail time in Florida for murdering an 18 year old student . Extreme violence is not unusal to him it seems.
I often try to warn young guys out here on holiday not to get into fights. You could be messing with a complete lunatic for all you know and in the case of this Aussie it looks like he did and paid the ultimate price.
