Forensic expert questions Premchai acquittal of panther carcass possession

The chief of the Wildlife Forensic Science Unit, at the Department of National Parks, Wildlife and Plant Conservation, has raised questions about Tuesday’s dismissal by the Thong Pha Phume provincial court of the panther carcass possession charge laid against construction tycoon Premchai Karnasuta.


In her Facebook post on Tuesday, Dr. Kanita Ouitavon said she used to tell herself not worry about the legal proceedings of the case but, when the verdict was delivered, she wondered whether she had overlooked something in her forensic work when identifying the carcasses of wildlife species collected from the crime scene.


“All the evidence, be it the panther skin with bullet holes, panther tail soup in the pot, bones from the stream, intestines, several knives, the chopping board, blood stains on leaves or on the ground, all showed that they came from the same panther,” said Dr. Kanita in her post, adding “Forensic science work does not just provide answers to what kind and how many animals are involved, but must provide more answers.”


The forensic expert went on to say that, while the case was complicated, the evidence collected is indicative of hunting, the killing of animals, cooking, eating and a cover-up attempt at the scene and the people who were present – all of them were linked together.


Natural Resources and Environment Minister Surasak Kanchanarat said he would leave the Department of National Parks, Wildlife and Plant Conservation to decide whether to appeal the verdict.


Meanwhile, deputy spokesman for the Office of the Attorney-General, Mr. Kosonwat Inthuchanyong, said today he would ask for the full text of the court’s verdict before deciding whether or not to appeal the court’s decision regarding possession of a panther carcass and illegal collection of forest products.


He insisted that the prosecutor had handled the case carefully and quickly, as the four defendants were indicted within a month of receiving the case from the police.


Mr. Premchai, the president of Italian-Thai Development Plc, one of Thailand’s largest construction firms, was charged on six counts, including illegal hunting of protected wild species, carrying weapons in public without a permit, possession of a panther carcass, possession of a grey pheasant carcass and illegal collection of wild items in the sanctuary.


However, the Thong Pha Phume provincial court only found him guilty of carrying firearms in public without a permit, possession of a grey pheasant carcass and abetting others in illegal hunting and sentenced him to 16 months in prison without suspension. He was subsequently released on 400,000 baht bail.


Yong Dodkrua was given 13 months imprisonment, Mrs. Nathee Riamsaeng 4 months and Thani Thummat 2 years and 17 months. All were granted bail.

I hope she prevails but I'm asumming that the "lack of evidence" very conveniently boils down to nobody can prove who shot the creature.

Construction tycoon Premchai Karnasuta was this morning (Tuesday) sentenced to one-year in prison, without suspension, after he was found guilty of bribery, in connection with the illegal hunting scandal in Thungyai Naresuan wildlife sanctuary last year, by the Region 7 Criminal Court for Corruption Cases.

On March 19th, Mr. Premchai, CEO and chairman of Italian-Thai Development Plc, was sentenced to a 16-month prison term by the Thong Phaphum provincial court in Kanhanaburi province, after he was found guilty on three charges of illegal firearm possession in public, being an accessory in illegal hunting and illegal possession of the carcass of a pheasant, which is a protected species. He was also ordered to pay two million baht in compensation to the Department of National Parks, Wildlife and Plant Conservation.

On May 24th, the public prosecutor appealed against the Thong Phaphum provincial court’s verdict seeking heavier penalties against Premchai for being the principal suspect in the illegal hunting episode.

The bribery charges were filed with the anti-corruption police against Messrs. Premchai and Yong by Mr. Wichien Chinnawong, chief of the Thungyai Naresuan wildlife sanctuary. The filing accuses the duo of offering him bribes in exchange for releasing the hunting party and dropping the charges against them.

Park officials managed to record Premchai’s bribery offer, which was used as key evidence in court.

Italian-Thai boss Premchai given six month prison term without suspension

Construction tycoon Premchai Karnasuta was sentenced to six months in prison, without suspension, by the Criminal Court this morning (Tuesday) after he was found guilty of possessing three hunting rifles and a home-made firearm without licenses.


The court agreed to cut the one-year jail term by half because he had confessed, but declined to suspend the imprisonment because there are still two criminal cases, carrying possible prison terms, pending against the defendant at the Thong Phaphum provincial court in Kanchanaburi province and at the Region 7 Criminal Court for Corruption Cases.


Today’s case against Mr. Premchai, the boss of Italian-Thai Development Corporation, one of Thailand’s leading construction companies, was related to illegal hunting in the Thungyai Naresuan wildlife sanctuary, during which one black panther, an endangered species, and several protected species were killed.


In March this year, Premchai was sentenced to 16 month in prison the Thong Phaphum provincial court after being found guilty on three charges, namely aiding and abetting others to hunt illegally in a wildlife sanctuary, possession of the remains of protected wildlife species and illegal possession of firearms in public. He was acquitted of the charge of illegal possession of the black panther carcass. He was granted bail but banned from leaving the country without permission from the court.


In today’s case of illegal possession of firearms, Premchai had denied the charges, but he changed his plea when he confessed to the charge at the first hearing of the case in July. The court then ordered parole officials to prepare pre-sentencing reports before determining the punishment.


Prior to the sentencing this morning, Premchai, through his lawyer, pleaded to the court for leniency, claiming that he planned to go into the monkhood for 15 days at Wat Bowornnivet or any other temple, that he will donate three million baht to charity and will stay away from guns the rest of his life.


The court said that Premchai’s three vows were praiseworthy and expressed hope that he would keep his vows, but added that the court would not suspend the six-month prison sentence.


Premchai’s lawyer has asked the court for bail pending an appeal of the conviction. Bail was later granted.

Premchai granted bail, but must wear EM ankle bracelet

The Supreme Court has granted bail to Italian-Thai Development boss Premchai Karnasuta and two fellow defendants, but ordered them to wear electronic monitoring ankle bracelets and banned them from leaving the country.


The court set the Premchai’s, Yong Dodkrua’s and Thanee Thummat’s bail at one million baht each.


The fourth defendant, Mrs. Nathee Riamsaen, received 22 months, suspended for two years.


The Appeals Court on Thursday found all four defendants guilty of the illegal poaching of protected wildlife, in Thung Yau Naresuan wildlife sanctuary early last year, and increased their prison terms after the Appeals Court ruled that Premchai abetted the other two defendants in the killing of a black leopard, a charge which had been dismissed by the lower court.


Premchai’s prison term was extended from 16 to 38 months, Yong got 41 months and Thanee, 45 months.


The three convicts were detained at Thong Pha Phum district prison on Thursday night as they awaited for a ruling from the Supreme Court on their bail applications.

^ of course he eventually got bail, no surprise here..rich and/or influential people don't stay in prison for long on the rare occasions where they get jail time. Not particular to Thailand.

Thailand’s Appeals Court today upheld the one-year prison sentence imposed, by the Criminal Court for Corruption and Misconduct Cases, on construction tycoon Premchai Karnasuta for attempted bribery.


Mr. Premchai, president of Italian-Thai Development Corp, was later released by the court on 500,000 baht bail.


The tycoon was convicted of trying to bribe park rangers at the Thungyai Naraesuan Wildlife Sanctuary following his arrest there, along with his driver Yong Dodkruea and two others, in February 2018, for poaching.


After their arrest, Premchai allegedly told park rangers that he would give them whatever they wanted if they let him go.

Appeals Court upholds Premchai’s 6 month sentence for illegal possession of firearms

Thailand’s Appeals Court has upheld the six-month prison sentence, imposed by the lower court on construction tycoon Premchai Karnasuta, who was convicted of illegal possession of firearms.





Mr. Premchai, president of Italian-Thai Development Corp, was charged with possessing three hunting rifles and one muzzle-loading rifle without licenses.


In upholding the Criminal Court’s conviction, the Appeals Court dismissed his new defence, not raised in the lower court trial, that all the illegal firearms were inherited from his father. The court said that possession of illegal firearms is a serious offence and that it will be difficult for the authorities to track down offenders if the rifles were to be used in a crime.





The court also dismissed Mr. Premchai’s argument, that he is very sick and the prison lacks a proper hospital to treat his illness, stating that there is a prison hospital and, if the patient is very sick, he can be sent to a private hospital.


After the reading of the Appeal Court’s decision this morning, the tycoon was released on a 500,000 baht bail.





On July 29th, the Appeals Court upheld a one-year sentence, imposed on Premchai by the Criminal Court for Corruption and Misconduct Cases, on bribery charges.


In December last year, the Appeals Court handed three years and two months in prison to Mr. Premchai, for illegal possession of wildlife carcasses, having firearms in a national park and poaching.
