    Thailand charges dropped against BBC reporter

    Charges have been withdrawn against a BBC journalist in a criminal defamation case in Thailand.

    Jonathan Head faced up to five years in jail if he had been convicted.

    He and a co-defendant appeared in court in Phuket at the start of the trial on Wednesday. Both pleaded not guilty.

    "The plaintiff has withdrawn his case against BBC journalist Jonathan Head, but as the trial of his co-defendant is continuing, we cannot comment further at present," a BBC statement said.

    The plaintiff withdrawal means he may have figured out he was shooting his own foot, how could he think he could sue the journalist for stating the truth that he actually admitted on record, must have confuse defamation law with the one on LM...

    He couldn't stand the (deserved) public backlash for what he had done so made this face-saving lawsuit, easy for him as a lawyer that doesn't cost him much, I hope he's sentenced to pay for the defendant expenses...

    My understanding of Thai law - very limited and I am happy to be corrected - is that whether a statement is true or not is irrelevant in a defamation case. And that the only defence against such a charge is that it was in the public interest that the facts were publicised.

    ^ maybe you're right, you can't call a girl a prostitute even if she definitely work as a prostitute as there is not public interest in knowing that fact...In this case it was definitely in public interest to know that a foul lawyer can contribute to stripping someone from his assets

    It's clear that the prosecution didn't have a strong case and using face-saving tactics. These types of defamation/LM accusations regarding respected Western/Thai journalists are not approached the same as some upcountry rebellious Somchai with an online axe to grind.

    What really surprised me is the fact that Mr. Head physically appeared in court to face the charges and whatnot -

    I was talking to Mrs Naam this afternoon about this whole story. She has some interesting takes on it.
    Her first comment was it's the people that bought the property that are the ones who are worried and possibly an impetus to the crooked lawyer
    behind the suing of Head and the Brit who lost his property.
    Her second comment was the lawyer would have had his lawyer's license cancelled if he had lost, and he knew he would lose.
    Her third comment was, why didn't the Brit guy counter-sue the lawyer for this frivolous case?

    Valid comments I think. Particularly the first comment: consider the current owners.

    BANGKOK — A court in the Thai capital has ordered a British labor rights activist to pay 10 million baht (USD$321,000) in damages to a company that filed a civil defamation suit after he helped expose alleged human rights violations at its factory.

    The Monday ruling against Andy Hall was just the latest development involving one of four defamation suits filed by pineapple canning company Natural Fruit, which employed migrant Myanmar workers who claimed the company had broken labor regulations in abusing them.

    Hall has prevailed in one of the two criminal defamation suits against him, while the other is pending, as is another civil suit. He has also filed a countersuit against Natural Fruit.

    Hall left Thailand in 2016, citing intolerable legal harassment after another company sued him.

    it is worth reminding ourselves, as foreigners living in thailand, of cultural mandate no.2, issued by the government of pibulsongkhram in 1939, and how they shaped the thailand of today.


    The cultural mandates or state decrees (Thai: รัฐนิยม; RTGS: rathniyom; literally "state fashion" or "state customs') were a series of 12 edicts issued between 1939 and 1942 by the government of Field Marshal Plaek Pibulsonggram during his first term as prime minister and military dictator of Thailand. The mandates aimed to create a uniform and "civilized" Thai culture at the time when the country was allied with the Axis powers. Many of the practices initiated in the mandates were a result of Thailand entering World War II and remain in effect today.

    On preventing danger to the nation, issued 3 July 1939, consisted of five items:

    "Thai people must not engage in any business without considering the benefit and safety of the nation."

    "Thai people must never reveal anything to foreigners that might damage the nation. These actions are a betrayal of the nation."

    "Thai people must not act as agent or spokesman for foreigners without considering the benefit of the Thai nation, and must not express opinion or take the side of foreigners in international disputes. These actions are a betrayal of the nation."

    "Thai people must not secretly purchase land on behalf of foreigners in a way that endangers the nation. These actions are a betrayal of the nation."

    "When a person has betrayed the nation, it is the duty of Thai people to actively and quickly put a stop to it."

    I think its geared towards protecting Thai businesses regardless of the realities of any situation. Should someone expose Thai businesses not acting ethically hurts Thailand's image and image is everything.....
