A simple appeal will take around a year...this one will take longer I'm guessing, due to the ramifications of a verdict either way.

Lawyers for two Myanmar nationals sentenced to death in Thailand are optimistic about a favourable appeal following a recent announcement from the presiding Thai court.

The court announced that no further extensions will be granted to the prosecution, which has delayed the hearing of the appeal nine times since it was lodged in May this year.

The prosecution has been given until November 10 to submit a reply to the defendants’ appeal to the court. So far no such action has been taken.

Ko Zaw Linn and Ko Wai Phyo were convicted and sentenced to death in December 2015 for the murder of David Miller and the rape and murder of Hannah Witheridge on Koh Tao, an island popular with tourists.

At the time of their conviction, the defendants’ legal team said the verdict represented “an extreme miscarriage of justice” and called for the sentence to be overturned as the prosecution’s case was based on circumstantial evidence.

In May, the migrant workers’ lawyers lodged a 198-page appeal detailing 21 deficiencies in the prosecution’s case, including the incorrect admission of evidence and the failure of police to identify a potential suspect in CCTV footage who was referred to as the “running man”. Concerns over the veracity of DNA evidence used to convict the pair also plagued the case.

U Aung Myo Thant, a legal adviser from the Myanmar embassy in Thailand, said that if the prosecution did not provide any reply to the appeal by the November 10 deadline, Ko Zaw Linn and Ko Wai Phyo would have a strong chance of a favourable outcome given that the court would have to consider the points made in the defendants’ appeal without any rebuttal from the prosecution.

“We don’t know how the court will decide on their sentence but it may well be changed if the prosecutor does not make any reply to our appeal. Our appeal is strong and points out many weak points in the prosecution’s case that suggest that the crimes may not have been carried out by these two Myanmar migrant workers,” said U Aung Myo Thant.

U Sein Htay, chair of the Migrant Worker Rights Network, was similarly optimistic concerning the defendants’ prospects.

“If the prosecutor does not lodge a reply to the appeal, this could be a good sign for Zaw and Phyo,” he said. He added that this would mean that the court would be forced to consider the points made in the appeal from only one perspective.

According to U Sein Htay, the two defendants were recently visited by his organisation at the prison they are held in. Their mental health is reportedly strong and they hope to soon be released.

So now the guilty pair are flush with money and fancy lawyers, all courtesy of misguided western libtards.

Will money buy freedom for the 2 killer / rapist / littering / illegal / thieves ?

    money vs justice

Hopefully they won't be freed, if they are, no doubt they will be granted 'asylum' in Canada/ uk/ Australia where they will live out their lives on welfare or maybe an affirmative action non-job.

Same court, same judges, from what I read.

Are the same Thais judges really going to publicly announce that they (and the PM) were wrong.

    Don't think so.

Burmese migrants convicted of killing British backpackers Hannah Witheridge and David Miller in Thailand WILL be executed after losing their appeal

    • Zaw Lin and Win Zaw Tun were convicted of killing Hannah Witheridge and David Miller
    • The friends died in September 2015 in the diving resort of Koh Tao in Thailand
    • The two men have lost an appeal against the death sentence

Two migrant workers convicted of raping and murdering a British backpacker and leaving her friend to drown after beating him will be executed, a court has ruled.
Zaw Lin and Win Zaw Tun, who were found guilty of killing David Miller, 24, and the rape and murder of Hannah Witheridge, 23, have lost an appeal against the death sentence.
The British tourists' battered bodies were found on a beach on the southern diving resort of Koh Tao, in Thailand, in September 2015.
The workers said Thai police tortured them into confessing to the killing, and the conviction sparked widespread protests in their homeland.

Convicted: Zaw Lin and Win Zaw Tun have lost an appeal against the death sentence in Thailand

Their original conviction in December 2015 was mired in controversy, with the defence accusing police of bungling their investigation from the outset after local detectives came under huge pressure to solve a case that risked damaging the country's vital tourism sector.
Investigators were accused of failing to properly collect and preserve DNA samples and declining to test key pieces of evidence, such as Witheridge's clothes, or allow independent examination of the samples.
But a higher court threw out the defence's appeal.

'The Appeals Court upheld the Criminal Court's ruling against the two Myanmar suspects,' Theerawut Phamhun, deputy provincial prosecutor of Surat Thani province, told AFP.
He said the appeal judges ruled the evidence investigation 'were up to standard' and that DNA found at the scene matched the suspects.
The defence now have 30 days to appeal to Thailand's Supreme Court, the final court of appeal.
Zaw Lin and Win Zaw Tun's defence lawyer did not pick up his phone Wednesday.
While Thailand keeps the death penalty on its books it is rarely carried out.

Miller family: Killers can now reflect on their horrific crimes in jail

The parents of Jerseyman David Miller, who was killed in Thailand in 2014, say they are confident the court has "made the correct decision" by upholding a guilty verdict in the trial into his murder.

Two Burmese men, Zaw Lin and Wai Phyo, were convicted of the murder of David and the rape and murder of Hannah Witheridge in 2015.

Today a Court of Appeal in Thailand upheld the guilty verdict handed down to the pair.

Zaw Lin and Wai Phyo will now have time in jail to reflect on their horrific crimes.

    – STATEMENT BY THE MILLER FAMILY
Speaking about the decision, the Miller family have said they believe the "Thai police have found the killers" and "the Thai court process has been visibly very fair and effective."

They added "Zaw Lin and Wai Phyo will now have time in jail to reflect on their horrific crimes."

Lin and Phyo face the death penalty, but the Miller family are asking for leniency in the sentence.

We have lost our son David forever and the Witheridge family will have been similarly devastated by this crime. There is not a day that goes by in our home without pain, feelings of loss and utter sadness.

We are proud of our son and what he achieved in his short life. We miss him terribly and miss his hugs, beaming smiles and infectious enthusiasm. His life was cruelly destroyed.

    Supreme Court now.

Hannah's family seem much more intelligent than the Millers.

The thing is when one has the death penalty and it looks like it will be carried out, the sensible tactic when negotiating the next appeal step might be to admit an offence if the sentence will be commuted.

But the contrast between the sentence of these two and the life sentence imposed on Pol. Sgt. Somchai Wisetsingh for the brutally horrific murders of Adam Lloyd and Vanessa Arscott is quite notable. I suppose in the latter case the police officer finally admitted he had killed the victims but not in the circumstances which most understood to be the truth - no one came forward to give evidence for fear of retribution and the Court appeared to be partially accepting the killer's account in handling down a life sentence. I understand that the good sgt. was given a 'trusted status" job immediately on his confinement and was transferred 2-3 years ago to a prison near his home town..........

^ I had to Google that.

Right at the end of one article, the father of one deceased commented, and gave me major deja vu...........

Mr Arscott added that the initial police investigation "showed a level of incompetence which was truly beyond belief".

    You nailed it buddy.

The Thais are going to let the clock run out on this. Out of sight; out of mind. Two out comes maybe 10 years from now:

1 After a record number of appeals -and International verification of Excellent Thai Detective work- the Ministry of Justice has ordered that the convicted Burmese murders be executed.

    OR

2 New evidence has emerged that the Burmese suspects are actually Aliens and were visiting Mars at the time of the murders. They will be released and deported immediately Er, jus as soon as diplomatic relations are established (with Mars?)

SMH. Even the Miller family believes the Burmese are guilty?

Thailand could make billions with a state run public relations agency. I can see the bill boards now: "Shot your ex-wife? Swindled millions from poor pensioners? Call 1-800 mai gohok. We are Thai and we're on your side! We will have your accusers apologizing so fast you will wonder what you did right! References upon request."
