This one gets rattled around a fair bit, and I am by no means an expert on this - but I have a nasty feeling that being named as the father on the birth certificate does not necessarily mean that you are legally considered the father. I am sorry, I am not up on all the fine details, but I know it is a problem many farang fathers have run across.
As a side point, I also think there is something else compounding by who does the reporting of the birth to the correct authorities (they may take precedent over the named father??).
I think you actually need to go to court if you want to assert full parental rights, and I beleive that simply being named as the father does not carry any weight.
However, I am prepared to be corrected on all this.
On this particular case, I have nothing but sympathy and best wishes for the father. yes, he messed up, yes he got rolled by an obviously conniving family - but here is the thing - he is trying to take responsibility for the consequences of his bad judgement (i.e. the son). We can ALL screw up royally sometimes, but stepping up to the plate, taking responsibility and trying to provide for the boy marks him as a fool, but an honourable one. far, far too many farangs would, or have -walked away.
and he has to be divorced, thats important, for legal reasons, and maybe or even most likely, he wants to be remarried in germany again in some time...
he can start-over in germany, but not with that stupid child and not while married in thailand...
the boy is same as them...better leave him back... sorry... jmho...

a good lawyer should be able to recover a large proportion of the money he spent, as long as he can prove he brought it into thailand in the first place.
he DOES need the wife/girlfriends permission in order to get the kid a passport and my guess is this is gonna be the biggest hurdle (unless he resorts to forgery etc as i had to in my case)
a lot depends on whether he was legally married and whether he is listed as the father on the birth certificate.
if this is NOT the case he has no rights to the child (dna test or not)
and even if he gets the child to germany he won't be able to remain there.
