    Jatuporn gets suspended jail term

    The Criminal Court on Tuesday sentenced red-shirt leader Jatuporn Prompan to six months in jail, suspended for two years, and a fine of 50,000 baht after finding him guilty of defaming Democrat Party leader Abhisit Vejjajiva.

    The lawsuit was filed by Mr Abhisit.

    It stated that stated that Mr Jatuporn, at a press conference at the Pheu Thai Party headquarters on Jan 13, 2009, accused Mr Abhisit, who was then prime minister, of showing no respect to His Majesty by sitting on a chair of the same level with that of the King when granted an audience.

    The court found Mr Jatuporn guilty of defaming Mr Abhisit and sentenced him to six months in jail and a fine of 50,000 baht. The jain term was suspended for two years.

    The court also ordered Mr Jatuporn to publish the court's verdict in ASTV Manager and Matichon dailies for seven consecutive days with his expenses.

    Uh, how does this work - the actual Jail Term is for 6 months, but he's being given a 2 year suspended sentence?

    It means that if you break the law within that 2 year period,you get to serve the 6 months in prison.

    Wonder why they picked Sondhis newspaper ? Why not the Daily news or Thai Rath ?

    Court accepts Jatuporn's excuse
    26/05/2014

    The Criminal Court on Monday accepted a request by red-shirt leader Jatuporn Prompan for another delay in his appearance to testify in a defamation case filed by Democrat Party leader Abhisit Vejjajiva, because he was being detained by the junta.

    The court previously ordered Mr Jatuporn to show up today or faced an arrest warrant after he sought several delays in the case, citing sickness and safety issues due to the political unrest.

    His lawyer Winyat Chartmontree asked the court to postpone Mr Jatuporn’s testimony on the grounds that his client was being held in custody by the National Council for Peace and Order (NCPO) and did not know when he would be released.

    The court ruled that Mr Jatuporn’s excuse for delay was plausible and ordered him to show up on July 2 at 9am.

    The head of the United Front for Democracy against Dictatorship was believed to have been taken to a military facility in Ayutthaya’s Wang Noi district along with other key figures in the political conflict on Thursday afternoon, immediately after NCPO chief Prayuth Chan-ocha seized power, according to a Post Today report.

    Jatuporn gets six months for defaming Abhisit



    The Supreme Court today handed down six months prison term for redshirt leader Jatuporn Phrompan over a false statement he told redshirt supporters during the anti government rally in 2010.
    However his jail term was suspended on a two year probation instead as he never convicted to serve jail sentence before.

    Jatuporn, the leader of the United Front for Democracy against Dictatorship (UDD), was earlier sentenced to six months in prison and a fine of 50,000 baht by the Criminal Court (first court,) and the Appeals Court after finding him guilty of defaming former prime minister Abhisit Vejjajiva in the anti government rally by redshirt protesters in 2010.

    Both courts ruled that the UDD leader delivered false speech at the rally,and again on People Channel accusing Abhisit of ordering soldiers to shoot at redshirt protesters.

    However both court suspended his prison term for two years instead, judging from the fact that he had no record of serving prison term in the past.

    Jatuporn appealed to the Supreme Court.

    At the hearing of the final judgement, the supreme Court said his appeal to drop the case was rejected due to lack of substantial evidence.

    Instead his accusation against the former prime minister was false and had tarnished his reputation.

    The Supreme Court then upheld the ruling of the first court which handed down him six months in prison.

    However his prison sentence was suspended for two years instead.

    If Abhisit hadn't ordered the shootings of Reds (or at least no proof he had), does the Army testified about where the order came from, or if the Army decided by itself to proceed with the shootings what was the chain of command ?

    We'll never know, accountability doesn't apply here if you're on the "right side"

    If he wasn't involved, did Abhisit voiced critic/disent about the crackdown? he was clearly working with the Army at the time...

    Who is the top of the chain as such applies to commands/orders?
    Probably not too difficult to track down - even during those chaotic and covered-up times....

    Sure, it shouldn't be too difficult to find thoses responsibles but because of the culture of impunity (for the "good guys") there's no chance to see thoses responsibles stand to court for judgement ...

    I wonder how they can call for Reconciliation ...
