    Health club creditors want B21m refund

    Members of the embattled health club California Wow yesterday demanded a total of 21.62 million baht in compensation from the company for failing to provide the fitness services it promised.


    About 100 California Wow customers and Consumer Protection Foundation staff converge at Silom Complex in Bangkok yesterday morning, demanding the financially troubled fitness club repay membership fees after closing down its branches.

    About 100 members of the health club gathered in front of the Consumer Protection Foundation (CPF) office on Silom Road demanding the company accept responsibility for failing to provide the services agreed upon.

    The protesters said they had paid the company the membership fees stipulated for the use of exercise equipment and the company had reneged.

    CPF official Sawanee Chumchaliew said a total of 300 members had prepaid a combined total of 21.6 million baht for use of the equipment and had not received the promised services when the health club went into bankruptcy.

    The demanded compensation would be much more if the fees paid by another 200 members were included, she said.

    The company was closed down in July without giving any notice to its members.

    Many of the members still have assets in the club's lockers and could not get them out.

    In addition, the members' payments were made through credit cards and cannot be cancelled. The fees are still being charged by the company without any services being provided, Ms Sawanee said.

    Her foundation will hold a meeting with state offices on Sept 23 to try to find a solution.

    One way out of the problem would be to ask the Bank of Thailand to order all banks to stop debiting their clients the California Wow fitness fees, she said.

    Yaowapa Chamratsomboon, a 48-year-old California Wow customer, said she was joined up as a life-time member, only to find that no exercise trainer showed up.

    The club was also shut down without giving members any notice, said Ms Yaowapa, who said the company's executives must show responsibility.

    Taking this at face value, , A very poignant lesson for all of us. Given your thai credit card number to someone and you are authorising them to take whatever they want, when ever they want for delivering what ever they feel like and if you are unhappy about it.... don't expect any help from your card issuer.

    Actually, no it's not bullshit. Long ago I learned the hard lesson of never allowing recurring charges on my credit card. It's very likely the charges continue. In most cases, you need to get the vendor's agreement to stop the credit card charges. Good luck now. Never EVER allow recurring charges on your credit card. Much different to bank recurring debits by the way - which you have total control over. In some countries, even if you cancel the credit card, you'd still receive bills - which you (in other countries) are liable for.

    I gave up on credit cards years and years ago, I've just givn in and to one as its just getting too painful to buy plane tickets online without one

    California Wow faces fraud suit

    Members of the embattled health Club California Wow (CAWOW) on Sunday filed fraud charges against the bankrupt fitness operator for allegedly failing to provide the services agreed upon and to refund their membership fees.



    The charges were filed with the Consumer Protection Police Division by about 50 members of the financially troubled health club accompanied by Saree Ongsomwang, secretary-general of Foundation for Consumers.

    Ms Saree said her foundation had received complaints from 587 affected members under life-long, yearly and monthly membership contracts demanding a total of more than 30 million baht in compensation from the company.

    CAWOW went into bankruptcy earlier this year and closed most of its club branches. Now It only has three facilities operating – two located in Siam Paragon and Esplanade shopping centres in Bangkok and the other in Chiang Mai province.

    The complainants living in Bangkok said it was inconvenient to travel to the two remaining facilities after the club branches near their residences had been closed down and they wanted to cancel their memberships. However, the company did not give any response when they demanded their membership fees be refunded.

    They also said the company was still recruiting new members even though it was facing financial problems and was now under a business rehabilitation plan. As a result, the members saw this as fraud, Ms Saree added.

    The Foundation for Consumers chief believed many affected people have not filed complaints yet because the fitness operator had more than 100,000 members nationwide.

    This is the real out of order shit - and this is legal. Years ago you could call your bank and tell them to cancel anything - but that was when they were less mercenary.

    Question Solution for CALIFORNIA WOW MUST READ!

    Well apparently, California WoW is trying to get the Bankruptcy Court's approval for re-organization of its business. Basically here is what they are going to do: they will close down all these big gyms and start operating as a franchise called "WoW Express". NOw these will be smaller and more compact gyms but will be greater in number and more centres all over Thailand. The math seems to work out, but I still need you guys to respond to these questions:

    1) Imagine yourself as an investor, would you be willing to purchase such a franchise?
    2) As a gym user, will you be able to trust California WoW again and buy memberships at these gyms?

    Recone your best bet is to put up some adds in the women's lav's at nana and soi cowboy. offer a finders fee of say 20% to any of them who can get their buffalo(s) to buy one of the franchisee. You should have no problem getting yourself a collection of the most gullible and vulnerable investors in Thailand.

    Thanks for all the feedback. Please keep them coming. Remember to respond to the questions I asked earlier. I am actually just a 17 year old interested in this matter, so I really need these comments to proof them in my report. I aim for at least twenty replies.
