    Extension of stay based on Thai children

    Has anyone applied for an extension of stay based on Thai children at Kap Choeng immigration?
    If so what was your experience?
    What documents were required?

    I am asking specifically about KCI

    No matter where in Thailand you're asking about this extension there are a couple questions you need to answer before anyone can actually give you accurate info.

    1) have you 'legalized' or gotten your parental rights recognized by Family Court? Simply being listed on the birth certificate as the father (even if your kids hold a passport from your country too) doesn't give you parental rights. I believe this is true whether you're married to the children's mother or not.

    2) IF you haven't done that, are the kids old enough to go to the local Amphur and point you out as their father. The age at which different Amphurs allows kids to do this varies too. Some will do it at 6 y/o some at 8 y/o.

    If you've already gone thru family court (a process which is not that perilous but takes about 2 1/2 months to get done) and are given rights as a parent, did you also go to the Amphur and have you listed in the 'log book' as the father?

    Now seeing as you asked about KCi (one definitely whacky Thai Immigration office) the following doesn't necessarily apply but;

    Here in Bangkok, you need to be recognized as the legal father (granted parental rights), the kids have to live with you, have the requisite income (40K/month) or funds (400K) deposited in the bank, have pictures of you and your kids at home, ALSO pics of them in their school uniform standing in front of where ever they go to school.

    You submit the application, it goes under consideration for 30 days and then you go back out to get the year extension stamped into your passport. Even though the regulations about extensions of stay based on the support of children DON'T require 60 day seasoning in Bangkok they make you season the money. I know one guy who had every "I crossed-n-T dotted" but the money wasn't seasoned. Even though by the time the 30 day under consideration would have wound down it would have been seasoned, they wouldn't do it. Instead they sold him a 60 day visit my thai kids extension. THEN after the money was seasoned he applied, it still went under consideration for another month but he go the year extension no problem.

    Again, the above stuff is for Bangkok, NOT middle of nowhere Surin Province. So it's anyone's guess what they'll want or how many hoops you'll hafta jump thru for them.

    In perusing another forum IF that post was yours, it appears you've got the legalization documentation already.

    I'd call KCI (or have a thai call) and ask them. These are the numbers I've used for them; 04-455-9127 04-455-9128

    Hence the reason for my post. I do have all the paperwork asked by CW but I do not want to traipse the whole family out to KCI for no good reason.

    I have done this in person twice when filing my 90 day both with and without a Thai and it would seem there is some miscommunication.
    They talk only in terms of 'marriage' and 'retirement'.

    As I say it could be simply a case of miscommunication hence the reason for posting asking for anyone's specific experience

    This question you're asking Harry reminds me of when one could obtain an extension by 'support of a Thai child'. It was based on the Thai ways in that a child supports an adult in their older days. No money was expected to be shown. I tried to get it when KCI was none existent and we all went to Korat. I did get the extension but they insisted on a show of money. I think we, me and the officer, settled on showing 200,000 Baht. I think this new extension, which was brought in in 2006 as I recall, only lasted a year before being withdrawn.

    There seem to be two headings in the current Police Order 327/2557 which might apply;
    2.18 In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children) Each permission shall be granted for no more
    than one year:
    (1) The alien must have been granted a non[at]immigrant visa (NON[at]IM).
    (2) The alien must have proof of relationship.
    (3) In the case of spouse, the relationship must be de jure and de facto: or
    (4) In the case of children, adopted children, or spouse's children, said children, adopted children, or spouse's children must not be married, must live with the alien as part of the family and must not be over 20 years of age except in case of the person hereof is of illness or disability and cannot live without support of father or mother:
    or
    (5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year.
    In case the father or mother requests to be under maintenance of children, the age of father or mother must be 50 years of age or over.
    For other necessary cases, the Commissioner or Deputy Commissioner of
    Immigration Bureau is granted the authority to make decisions regarding approval on a case[at] by[at] case basis.
    (6) In the case of marriage to a Thai woman, the alien husband must earn an average annual income of no less than Baht 40,000 per month or must have no less than Baht 400,000 in a bank account in Thailand for the past two months to cover expenses for one year
    Or this one;
    2.19 In the case of being a family member of a Thai resident (applicable only to parents, spouse, children, adopted children, or spouse’s children) Each permission shall be granted for no more
    than one year:
    (1) The alien must have been granted a non[at]immigrant visa (NON[at]IM).
    (2) The alien must have proof of relationship.
    (3) In the case of spouse, the relationship must be de jure and de facto: or
    (4) In the case of children, adopted children, or spouse’s children, said children, adopted children, or spouse's children must not be married, must live with the alien as part of the family, and must not be over 20 years of age except in case of the person hereof is of illness or disability and cannot live without support offather or mother:
    or
    (5) In the case of parents, the father or mother must be 50 years of age or over
    There is also Police Order 138/2557 which has almost the same written but a little more description.. They both came into effect on the same day Aug 29, 2014

    In thai you'd ask for an extension ต่อวีซ่ากรณีเป็นบิดาของบุตรมีสัญชาติไทย "extend visa in the instance of being the father of a thai national"

    These are the links to the Thai versions of both Police Order 327/2557 and Police Order 138/2557;

    Push comes to shove those are the only versions they're gonna believe and sometimes it's a stretch to get 'em to believe those are the real rules!

    it hasn't happened yet. I am going once again before year end taking the paperwork you kindly provide in an earlier post. I am also planning to take a Thai with me so there can be (in theory) no communication issues.
