    thanks all, was very helpful!

    i am wondering if it makes sense to apply for a burmese visa, when already on an "extended" overstay here... the passport would be gone for a couple of weeks i suppose, but i still have till mid july or more... will see...

    ...if im not mauled to death by the next attack already prepared...

    How do you think your visa application will go when they thumb through your passport and see you are a significant over stayer in the current country you are in?

    There are ways to fix an overstay in country, but you need the help of a lawyer and you pay some extra tea money, but the advantage is there will be no overstay record in your passport. Cost is around 40k baht including the lawyer fee.
    Go out through the airport and the overstay will be noted in your passport.

    i once had an overstay in an old passport... and EACH AND EVERY immigration in the world would stop when scrolling through the passport and read the whole thing, most of them were a bit frowning...

    Yep it's better not to have an overstay noted in your passport. Unless your needing a new passport soon I'd think on sorting it out in country.

    its certainly less expensive (than the 20,000 thb lawyer fee) to "loose" the passport or just put it in the washer and get a new one, but i thought the advantage of the lawyer was, that the whole thing was NOT ON FILE ?

    so, how "far" goes the "non-stamp"-thing?

    will the overstay be on thai-files or not?

    Just get a new pp if it worries you that much.
    Other counties may look at it, but thailand doesn't care if you overstay, as long as you pay.

    The lawyer charged 9k and the tea money for immigration another 9k, 20k fine and 2k for the 3 month medical extension visa. The excuse was being sick and also had a letter from a doctor requesting a medical extension. No overstay notation in the passport.

    If someone was short of cash and needed to get out of the country easily the border crossing near Satun you could just walk out past the Thai immigration and into Malaysia. You could also easily just walk into Malaysia without getting a stamp. Take a bus to Penang or KL and get a new passport.

    Do as you describe and all sorts of alarm bells would ring when you tried to leave Malaysia and they see there is no record of your entry.
    It's all computerized.

    A friend here had over 3.5 years overstay. He flew from here to Phuket where he checked into his flight to Penang. The immigration just laughed and said it was good for Thailand as they get big money, ie the 20000 Baht fine which he paid. As the batteries were flat in his calculator he couldn't add up the days to put in the overstay stamp so simply put . He flew to Penang where he applied for a tourist visa which he got the next day and then returned to Thailand the next day. he was stamped in without even a look and has had several tourist and education visas since.

    That broke dick scenario only works if you get a new passport in KL.
    The border crossing at Satun is 1970's no computers, just a stamp in the passport on the Malaysian side. It's wide open and you can just walk back and forth. Or ride a motorbike.

    What big fella said is the simplest way as long as you got the 20k for the overstay fine when you leave.

    ^Did he not have the 20K and plane ticket out? Hanging with Nigerians he was probably not just drinking too much.

    I got banged up in imm jail for 3 weeks waiting for a plane ticket out, back in 1979.(hanging which the wrong people) Not something you'd want to repeat.

    It then moves from a simple overstay situation, to an illegal entry and exit situation.
    Overstaying is quite a minor offence, illegal exit and entry is quite a serious offence

    Somtamslap I had a 60 day over stay, payed at the border Cambo, back to Thailand 3 day later.
    That was 10 years ago.

    It's nothing but scaremongering, saying having an overstay stamp in your passport is somehow detrimental in some obscure imaginary way.

    The advice of seeking out a lawyer, paying tea money and "fixing" an overstay is just bull-shit advice too.

    The "lose your passport", wander out of the country illegally and into another one also a crock of shit.

    Do you people lay awake nights thinking up half-assed hare-brained ideas on how to circumvent the rules here or what? Truly, the mind wobbles at some of the "advice" given here..

    Sheesh, it's an overstay, nothing more nothing less. It's NOT leaving the country on an overstay which causes you the problem; it's getting caught out inside the country without a valid visa which throws a wrench in the gears.

    I recently shepherded an American guy with a 5+ year overstay thru the process of getting sorted out and legal. It went like this;
    • Took him to the border, paid the 20K fine, exited, turned around came back in, got the 15 day visa exempt stamp.
    • Went to Immigrations at Chaengwattana the next day, applied for a single entry 90 day Non-O Visa based on retirement.
    • Two weeks later (on the day his visa exempt stamp was expiring) showed back up at Chaengwattana and got the 90 day Non-O stamped into his passport.
    • Two months after that got the yearly extension of stay based on retirement, and a re-entry permit.
    NO lawyer was needed, NONE of what we did was under the table, NO tea money was given to a single person, and all we did was follow the rules. Also no Thai Immigrations officer "frowned" at us, not that I'd give a shit if they did. In fact there wasn’t even a single comment about the overstay from any of the Immigrations officers we dealt with either at the border or at Chaengwattana..

    Try NOT to make a big deal out of something as trivial as an overstay. Follow the rules, get it sorted out.
