    Thai visa extension based on having a legal Thai spouse.

    Further to a reading a similar thread dealing with visa extensions requirements (retirement):

    Plenty of info tips, procedures, required "paper work" and the usual suggestion of visiting your designated TIO for any clarifications.

    There is also a copy the Thai Ministry regulation/police order number.

    THE REGULATION

    Police order 777/2551

    2.18 In the case of a family member of a Thai (applicable only to parents, spouse, child, adopted child or child of his/her spouse):
    Permission will be granted for a period of not more than 1 year at a time.

    (1) The alien has obtained a temporary visa (NON-IM)
    (2) Proof of family relationship
    (3) In the case of a spouse, the marital relationship shall be dejure (legitimate) and de facto;
    (4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the family, and must be less than 20 years of age; or
    (5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.
    (6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

    (the paragraph about “husband” should be considered as “husband” or “wife”.)

    Having been responsible, to my then employers, to speak at international conferences and ensure all, including those whose native language was not English. I found pauses, assisted them all to understood my presentations and allow them time to write them down, add O/H presentation slide numbers etc. if necessary.

    Some used their notes to highlight their questions during the later, question and answer opportunities. At the end of my presentations, over lunch or at the bar in the evenings.

    No, in such case you can not prove that it is your monthly deposit.

    Does anyone know if it's essential to be on a 90 day 'Non Imm-O' visa in order to obtain an extension based on marriage?

    If so, has anyone arrived on a 'Tourist Visa', then obtained a 'Non Imm-O' Visa at their local office?

    What was needed?

    It shouldn't be an issue.

    the foreigner on a Visa Exemption stamp or a Tourist Visa can still apply for a Thai marriage visa inside Thailand as long as the foreigner has already met the requirements for the non-immigrant O visa and the one year Thai marriage visa applications. This can be done at the local Thai immigration office in the province where the foreigner and Thai spouse are residing.

    yes always reserve some time for the unexpected, don't go at the last day of your permit to stay.

    I have and it's not easy (paperwork wise), but possible.

    You have to be on a non imm visa to extend.

    Landed in BBK and got 30 day VOA, extended for 60 days after that for visiting family, then changed to a single entry non O (good for 90 days) whilst I applied and seasoned the 400k for a the 1 year extension for being married to a Thai national.

    Arriving on a tourist visa then leaving again to somewhere like Penang to get a 'Non-O' will obviously involve a double quarantine, so I'm keen to avoid that.

    So I'm hoping Eddie is correct.

    If the spouse is already inhouse, I'd get them to visit the local immigration office to confirm, after 30 minutes of off-tangent meaningless babble with the IO or their assistant. Or else contact local visa agents about the possibility of either changing from a TR to non-O or getting a 12 month extension of temporary stay based on family while on a TR. Better to be safe than sorry and get it all but confirmed before applying for the TR.

    I arrived in March 2020 on a tourist visa, extended it, then swapped to a 90 day non-o at my local immigration office based on marriage, then extended it for a year. I also loaned a buddy 400k so he could do the same. Both cases were done at a tiny immigration office in the boonies, above board, and even the tiny immigration office knew exactly what we were trying to do.

    Need:

    TM86

    All the normal non-o paperwork.

    And 400k baht in your Thai bank account at the time of application.

    Critical Points:

    You MUST apply 15 days BEFORE your last day. If you have a 60 day visa, then you must apply on or before the 45th day. A day late and they could flat deny you. This point almost fucked me during the beginning of covid.

    400k baht in a thai bank account at the time of application. Does not need to be seasoned to apply for the visa change (90day) but DOES need to be seasoned by the time you apply for extention. If you put the money in at the time of application, it will be seasoned by the time you extend. Don’t go under 400k.

    You must apply for the extension 15 days before your last non-o day. If you get a 90 day non-o, apply to extend on day 75.

    1 year extension was harder and more of a pain in the ass than the swap to non-o. House visits & shit. But still straightforward.
