Court nixes Fox News' bid to end voting tech firm's suit

Fox News lost an attempt Tuesday to shut down a multibillion-dollar defamation lawsuit that accuses the network of spreading lies that a voting-technology company helped “steal” the 2020 election from then-U.S. President Donald Trump.

New York's Supreme Court Appellate Division, a mid-level appeals court, ruled against the network, which wanted judges to dismiss the $2.7 billion defamation case.

The company that brought the case, Smartmatic, has said it played a valid and small role in the election. It hailed the ruling as a step toward holding Fox News accountable for amplifying unsupported and damaging claims from Trump's lawyers.

Fox News cast the case as an attempt to chill journalism, expressing confidence the network ultimately would prevail.

Tuesday's decision means Smartmatic's suit continues against Fox News, hosts Maria Bartiromo and Jeanine Pirro, former host Lou Dobbs, and Trump attorney Rudy Giuliani. A claim against Trump lawyer Sidney Powell was dismissed earlier because she doesn't have ties to New York, where the case was filed.
Keep your friends close and your enemies closer.

A filing in Delaware state court by Dominion Voting Systems as part of the company’s blockbuster lawsuit against Fox News and its parent company contains never-before-revealed vignettes from inside the network in the days that followed the 2020 election.

Text messages, e-mails and testimony contained in the filing show the outlet’s top executives and hosts casting doubt on former President Trump’s false claims of a stolen election, and worrying about how fact-checking those assertions on the air might be received by the conservative media outlet’s massive audience.

Here are the most explosive revelations contained in Dominion’s filing:

Leading hosts called foul on ‘insane’ Powell, Giuliani claims

The filing includes a number of text messages and emails between Fox’s top talent showing them insulting pro-Trump lawyer Sidney Powell, who made many of the on-air claims at the center of the suit.

“Sidney Powell is lying by the way. I caught her. It’s insane,” Tucker Carlson wrote to fellow prime-time host Laura Ingraham on Nov. 18, according to the filing.

Carlson and Hannity talked about getting Fox reporters fired for fact checking Trump

The filing alleges Carlson and Sean Hannity floated the idea of pressuring network leaders to fire Fox White House correspondent Jacqui Heinrich after she fact-checked a tweet from Trump promoting some of the Dominion claims.

The filing says Carlson told Hannity, “Please get her fired. Seriously….What the fuck? I’m actually shocked…It needs to stop immediately, like tonight. It’s measurably hurting the company. The stock price is down. Not a joke.”

Fox leadership worried about getting flanked to the right

As Trump grew increasingly critical of Fox in the weeks leading up to and after the election, Dominion alleges that some at the network became concerned about the brief ascendance of Newsmax, a smaller conservative channel that aired many of Trump’s false election fraud claims.

Dominion alleges Carlson texted a producer on his weeknight primetime show: “Do the executives understand how much credibility and trust we’ve lost with our audience? We’re playing with fire, for real….an alternative like newsmax could be devastating to us.”

    Murdoch dismissed Trump’s election claims

When Rupert Murdoch watched Rudy Giuliani and Sidney Powell make false claims of electoral fraud on November 19, he told Suzanne Scott: “Terrible stuff damaging everybody, I fear,” according to the filing.

Fox prepping First Amendment defense in court, questions Dominion’s motives

Dominion’s case against Fox’s hinges on its ability to prove that the network acted with “actual malice,” or reckless disregard for the truth, a legal precedent that has been a high bar to clear for parties suing media companies and other publishers in recent years.

Fox has for months argued it was doing its journalistic duty covering the claims of electoral fraud coming from Trump and his team, and in a filing of its own this week said it “fulfilled its commitment to inform fully and comment fairly,” on Trump’s claims.

“Some hosts viewed the president’s claims skeptically; others viewed them hopefully,” Fox’s filing reads. “All recognized them as profoundly newsworthy.”

Rupert Murdoch, the billionaire conservative media mogul who owns Fox News Channel, acknowledged that top hosts at his network endorsed former President Trump’s false claims of a fraudulent election in 2020, court documents filed on Monday show.

Lawyers for Dominion Voting Systems, which is suing Murdoch and Fox Corp. for defamation and seeking $1.6 billion in damages, pressed Murdoch directly as they deposed him about whether some of the network’s widely watched opinion hosts endorsed Trump’s unproved claims.

“In fact, you are now aware that Fox endorsed at times this false notion of a stolen election?” one of Dominion’s lawyers asked Murdoch during his deposition, the court filing shows.

“Not Fox, No. Not Fox. But maybe Lou Dobbs, maybe Maria, as commentators,” Murdoch replied.

“Some of our commentators were endorsing it,” the media tycoon added, when pressed again if the hosts endorsed Trump’s claims of a fraudulent election. “Yes. They endorsed.”

The filing made Monday by Dominion is the latest chapter in a blockbuster lawsuit, in which the voting systems company argues that top brass at Fox, including its top hosts and executives, defamed Dominion by airing false claims peddled by Trump and his associates in the weeks following the 2020 election.

A trial is scheduled to begin in mid-April.

Fox News and one of its producers filed lawsuits against each other on Monday, according to news reports, potentially posing a new obstacle for the network amid its ongoing legal battle against Dominion Voting Systems.

Abby Grossberg, who has worked with Fox hosts Tucker Carlson and Maria Bartiromo, says in her filings in New York and Delaware that before giving a September deposition in Dominion’s $1.6 billion defamation suit over false 2020 election claims, she was coached in “a coercive and intimidating manner” to protect executives and on-air talent.

Grossberg also alleges that at Fox she was forced to work in an environment rampant with sexism and misogyny.

“That’s what the culture is there,” she said in an interview with The New York Times. “They don’t respect or value women.”

Fox, meanwhile, filed a complaint in the Supreme Court of New York seeking to block Grossberg’s claims.

“Ms. Grossberg has threatened to disclose Fox’s attorney-client privileged information and we filed a temporary restraining order to protect our rights,” the network said in a statement to The Hill.

Parisis G. Filippatos, an attorney for Grossberg, told the Times that later on Monday, his client had been placed on forced administrative leave.

“Having just received and read Fox News’ frivolous attempt to silence Abby Grossberg, we are happy that the full story regarding her case will now be heard by three separate courts in each of which we are confident she will receive the justice she deserves and certainly the fair treatment which she hasn’t experienced thus far from her employer Fox News,” Filippatos said in a statement to The Daily Beast.

Regarding Grossberg’s allegations of workplace misconduct, a Fox News spokesperson told The Hill that it “engaged an independent outside counsel to immediately investigate the concerns raised by Ms. Grossberg, which were made following a critical performance review.”

“We will vigorously defend these claims,” the spokesperson added.

Dominion in 2021 filed suits against a number of individuals and corporations it says knowingly spread baseless accusations about its voting machines and the 2020 election in the wake of former President Trump’s loss.

In recent weeks, the company has made multiple court filings presenting evidence that Fox News hosts and top executives were privately casting doubt on the same false claims they gave abundant airtime.

Fox has countered with free-speech arguments, saying it was giving voice to concerns voiced by, among others, a then-sitting president.

The Times reports that Grossberg says in her filings that she was “coached by and intimidated by” Fox’s legal team ahead of her deposition.

Asked during that deposition if she cared whether statements about the election made on Bartiromo’s program were true or false, Grossberg reportedly replied, “No, because we didn’t know if they were true or false at that time.”

She responded “no” when asked if it was important to correct a false claim made on the air, according to the Times.

One of Dominion’s filings reportedly included an exchange between Bartiromo and her producer in which the host asked if she should have pushed Trump harder during an interview to commit to a peaceful transition.

“To be honest, our audience doesn’t want to hear about a peaceful transition,” Grossberg responded.

Fox News drops lawsuit seeking to gag Tucker Carlson producer suing them for discrimination

One day after suing Tucker Carlson’s producer, Fox News quickly retreated on Tuesday with a brief indicating, without explanation, that the network dropped its case.

The filing gives Fox News the option to refile the case, if it so chooses.

“PLEASE TAKE NOTICE that, pursuant to CPLR 3217(a)(1), Plaintiff Fox News Network, LLC, hereby discontinues this proceeding, without prejudice, and without costs to any party,” the single-paragraph notice reads in full.

Project Veritas loses journalistic and attorney-client privilege claims in Ashley Biden case

The Department of Justice’s seizure of materials from the home of Project Veritas founder James O’Keefe and other staffers does not threaten First Amendment freedoms or journalistic privilege, a special master ruled on Tuesday.

“This is not a situation where the Government is deputizing Petitioners to do its investigative work for it; the Government is investigating Petitioners,” former federal judge Barbara Jones noted in a 21-page report and recommendation.

The petitioners listed in the ruling are O’Keefe and two other staffers: Spencer Meads and Eric Cochran.

Dominion Voting Systems Has Released Witness List in Fox News Lawsuit

he jolly lawyers representing Dominion Voting Systems in its $1.6 billion lawsuit against Fox News has released its wish list of witnesses it would like to call whenever the case reaches a courtroom. If they somehow get their wish, the trial will be a star-studded extravaganza as well as a nostalgia tour for CPACs gone by. From CNN:

Among the network personnel that the voting technology company wants to call as witnesses are Fox News chief executive Suzanne Scott; Fox News President Jay Wallace; hosts Sean Hannity, Tucker Carlson, Maria Bartiromo, Laura Ingraham, and Bret Baier; and former executive Bill Sammon and politics editor Chris Stirewalt.

    Also starring,

Dominion also said it wishes to call to the stand Abby Grossberg, the Fox News producer who filed lawsuits against the network last week that alleged network lawyers coerced her into providing misleading testimony...Dominion previously asked Delaware Superior Court Judge Eric Davis to force Fox Corporation Chairman Rupert Murdoch and chief executive Lachlan Murdoch to testify at trial, as well as board member Paul Ryan, the former House speaker.

This is unlikely fully to come to pass; it's sort of like judicial fantasy baseball, but the Fox defense team has managed to hand Dominion's side one important advantage—they have thoroughly honked off the judge sitting on the case.

During Tuesday’s virtual court hearing, Davis became exasperated with some of Fox’s lawyers for what he called legal “gamesmanship.” And he was taken aback when he learned that Fox had objected to every single exhibit that Dominion might want to use at trial. “If I think you’re just trying to interrupt testimony out of gamesmanship… you may have a problem,” Davis said. “…Be careful, people. Keep your powder dry on this stuff. This isn’t a game. This is a trial, and you’re going to be presenting to a jury.” The judge said he was “very concerned” about Fox’s “blanket” objection to the exhibits.

Every carnival needs a sideshow, and this looks like a good one. If the Murdochs don't settle this on the courthouse steps, they're out of their hive mind.

    • Fox News CEO said correspondent’s fact-check of Trump’s election lies was ‘bad for business,’ new emails show

Fox News CEO Suzanne Scott sounded the alarm inside the company about the financial fallout that the right-wing network would suffer if it continued aggressively fact-checking then-President Donald Trump’s lies after the 2020 election, according to messages that became public Wednesday.

In one instance, Scott emailed Meade Cooper, executive vice president of prime time programming, and expressed frustration after correspondent Eric Shawn appeared on Martha MacCallum’s show and fact-checked Trump and a Sean Hannity guest.

“This has to stop now,” Scott said in a December 2, 2020, message.

“This is bad for business and there is a lack of understanding what is happening in these shows,” Scott added. “The audience is furious and we are just feeding them material. Bad for business.”

A Fox News spokesperson told CNN that Scott was not taking issue with the fact-checking, but said the matter was about “one host calling out another,” seemingly referring to the fact that MacCallum and Shawn fact-checked a guest that appeared on Hannity’s show.

The email to Cooper was revealed as part of Dominion Voting Systems’ $1.6 billion defamation lawsuit against Fox News. Like several documents made public Wednesday, the email had previously been redacted in earlier court filings. The new emails were included in a presentation that Dominion showed at a hearing last week in Wilmington, Delaware. The voting technology company publicly released the full slideshow Wednesday, per a court order. Fox News, which denies any wrongdoing, has accused Dominion of cherry-picking emails to present a self-serving narrative about what the right-wing network did after the 2020 election.

“These documents once again demonstrate Dominion’s continued reliance on cherry-picked quotes without context to generate headlines in order to distract from the facts of this case,” a Fox spokesperson said in a statement. “The foundational right to a free press is at stake and we will continue to fiercely advocate for the First Amendment in protecting the role of news organizations to cover the news.”

In another email written by Scott, zinging correspondent Kristin Fisher, who now works at CNN, for her supposed “dismissive tone” in November 2020 after the presidential contest, the Fox News chief disclosed that the company had “lost 25k subs from FOX NATION,” its streaming service.

In earlier court filings, the data about the Fox Nation subscriptions had been redacted.

The messages underscore the panic that gripped Fox News in the wake of the 2020 election when its viewers rebelled against the channel for accurately calling the election for President Joe Biden.

Other newly released emails showed network producers discussing how putting Trump lawyers Rudy Giuliani and Sidney Powell on the air inflated ratings. At the time, Powell, Giuliani and host Lou Dobbs were promoting debunked conspiracy theories that Dominion had rigged the 2020 election by flipping millions of votes.

A jury trial in the case is slated to begin April 17.

A judge in Delaware has ordered a jury trial in Dominion Voting Systems’ blockbuster lawsuit against Fox News, setting the stage for one of the most consequential defamation decisions against an American media company in decades.

Lawyers for Fox and Dominion faced off in court during a two-day hearing for summary judgment last week, with each side unsuccessfully arguing the court should rule in their favor and forgo a jury trial that is expected to span weeks and could further bring to light internal discussions at the network following the 2020 election.

Dominion is suing Fox for $1.6 billion in connection with what it alleges was the network’s airing of false information about the company’s software, claims promoted by former President Trump’s associates and allies after the election.

Delaware Superior Court Judge Eric Davis rejected Fox’s attempt to throw out the suit ahead of trial, and he ruled that Dominion has proven the first elements of their defamation claim: namely, that the network’s statements about Dominion and the 2020 election were false.

But he ruled that a jury must decide whether Fox operated with actual malice.

“The evidence developed in this civil proceeding demonstrates that is CRYSTAL clear than none of the Statements relating to Dominion about the 2020 election are true. Therefore, the Court will grant summary judgment in favor of Dominion on the element of falsity,” the ruling read.

The network’s lawyers have defended the conservative cable news company on First Amendment grounds, saying the claims being made by Trump and his allies were newsworthy.

“Even if the neutral report privilege did apply, the evidence does not support that FNN conducted good-faith, disinterested reporting,” Davis wrote, also rejecting Fox’s other First Amendment defenses.

The outcome of the closely watched case — which has already produced a number of embarrassing headlines for the nation’s cable news leader — is certain to have major implications for Fox’s future and media law more generally.

“We are gratified by the Court’s thorough ruling soundly rejecting all of Fox’s arguments and defenses, and finding as a matter of law that their statements about Dominion are false,” Dominion said in a statement to The Hill on Friday. “We look forward to going to trial.”

Fox said in its own statement that “this case is and always has been about the First Amendment protections of the media’s absolute right to cover the news.”

“Fox will continue to fiercely advocate for the rights of free speech and a free press as we move into the next phase of these proceedings,” the network said.

The process of discovery has been an embarrassing one for the nation’s top-rated network, with a number of private communications and depositions by leading hosts and executives at the network in the post-election period brought to light.

Internal text messages and emails from top hosts at Fox showed them throwing cold water on Trump’s false claims of electoral fraud but worrying how fact checking those claims might hurt their standing with their audience.

In one email surfaced as part of the lawsuit Rupert Murdoch, owner and co-chairman of Fox Corp., worried to Fox News Media CEO Suzanne Scott that top hosts Sean Hannity and Laura Ingraham “went too far” in endorsing former President Trump’s false claims about the 2020 election, fillings from Dominion showed.

“Maybe Sean and Laura went too far,” Murdoch wrote to Scott. “All very well for Sean to tell you he was in despair about Trump but what did he tell his viewers?”

Davis ruled there was no factual dispute that all of the statements that Dominion is suing over are false.

“Dominion has offered proof demonstrating that the allegations were substantially false,” Davis wrote. “Comparing the allegations at issue to the truth, the truth would have likely had a different outcome on the average viewer, as the statements at issue were dramatically different than the truth.”

“In fact, although it cannot be attributed directly to Fox’s statements, it is noteworthy that some Americans still believe the election was rigged,” the judge added.

The problem is we are inundated with left wing news broadcasts. Some more subtle than others depending how far they are bent to the left. Fox could've been the alternative to these leftist rags and brought balance to news and politics. Sadly it did not. It became all the worst things that the far left were but to the far right. I remember its constant criticism of Obama although to be fair he was a poor President. From that to virtually no criticism of a President whose ego was more important than the country he supposedly served. It is now almost impossible to find a news station in Australia that is not loaded with far left woke agenda. The only one that isnt is Sky news australia which is probably Fox news light at best and populated exclusively with right wing journalists, some still debating climate change. Balanced news in Australia is dead. A pox on them all.

Dominion Voting Systems can force Rupert Murdoch and his son Lachlan to take the witness stand in court at a defamation trial later this month, a Delaware judge ruled at a hearing on Wednesday, per CNN.

Why it matters: The ruling deals a major blow to Fox News, which had been trying to persuade the judge not to compel the elder Murdoch, who serves as chair of Fox News parent Fox Corp., to testify in person.

Details: If Dominion subpoenas the Murdochs to testify in person later this month, Delaware Superior Court Judge Eric Davis said he would not stop them, arguing that they are "relevant" to the case.

Flashback: Rupert Murdoch did testify earlier this year, in a closed-door deposition. That deposition, which was unsealed in February, did not bode well for Fox News.

    • Asked during the proceeding whether it was fair to say that he "seriously doubted any claim of massive election fraud," Murdoch said, "Oh, yes," and conceded that he doubted false narratives around election fraud from the beginning.

The big picture: Dominion is suing Fox for defamation, and is claiming $1.6 billion in damages. Fox has said that the case is about the First Amendment protections of the media’s right to cover the news.

Be smart: Dominion will need to prove that Fox executives knowingly peddled false information about its role in the 2020 election.

    • Because of the First Amendment, which has strong protections for the news media, there's a very high bar in being able to prove that Fox acted with "actual malice. "

What they're saying: “Dominion clearly wants to continue generating misleading stories from their friends in the media to distract from their weak case," a Fox spokesperson said.

    • "Demanding witnesses who had nothing to do with the challenged broadcasts is just the latest example of their political crusade in search of a financial windfall.”

A former Fox News producer on Tuesday claimed to have secret recordings of Rudy Giuliani and other Trump allies admitting they had no evidence to back up their false claims about Dominion Voting Systems. MSNBC aired the tapes on Tuesday night after receiving the audio from the producer's attorney.

Former Fox News producer Abby Grossberg, who worked for Tucker Carlson and Maria Bartiromo, sued the company for harassment and discrimination, accusing the network of coercing her to falsely testify in Dominion's $1.6 billion defamation lawsuit. Grossberg in a Tuesday filing claimed that Fox News failed to disclose evidence to Dominion, including recordings she made of Giuliani, former Trump lawyer Sidney Powell and Trump campaign officials admitting they had no proof of their claims.

The judge overseeing the case on Wednesday scolded Fox News for withholding evidence in discovery after Dominion lawyers played some of the recordings in court. Judge Eric Davis said he would likely appoint a "special master" to investigate the matter.

"As counsel explained to the Court, Fox produced the supplemental information from Ms. Grossberg when we first learned it," a Fox News spokesperson said in a statement.

MSNBC's Alex Wagner aired the tapes on Tuesday night after receiving them from Grossberg's attorney.

The first tape includes Giuliani admitting to host Maria Bartiromo ahead of an interview days after the election that he didn't have evidence of the false TrumpWorld claim that Dominion rigged the election.

Giuliani claimed he could tell Bartiromo "exactly" what evidence the campaign had but the Dominion evidence was a "little harder."

"It's being analyzed right now. I mean, there are a couple of races that have been reversed because the Democrat was triple-counted, two already in Michigan. Now, whether that applies for the whole state or not, I can't tell you yet," Giuliani said.

"This Dominion software, does Nancy Pelosi have an interest in it?" Bartiromo asked.

"I've read that. I can't prove that," Giuliani acknowledged.

Wagner also played another recording of a Trump campaign official asking to go off the record to admit there did not appear to be anything wrong with the voting machines in Georgia.

"I think they have looked at the machines. When the secretary of state did its audit, there was a lot, I think a fair bit of looking at the machines," the campaign official said. "The audit came in pretty darn close to what the machine count was with the receipts. So, I don't know the outcome of those, but our understanding—again, this is from the secretary of state's office—was that there weren't any physical issues with machines on those inspections."

The official later noted that January 6 would be an important date.

"That's the whole reason why I wanted to chat with you two just to understand where the real backstops are here," he said. "And if both sets of electors are set up, that would be the moment when the vice president—who's the president of the Senate—would have to decide which slate of electors to go with."

A spokesperson for Fox said that Fox has "complied with its discovery obligations in the Dominion case."

But former federal prosecutor John Kaley on Wednesday warned that the tapes "could have a devastating impact on Fox's defense."

Kaley told Salon the records could "potentially undermine it entirely and subject Fox and others with knowledge to sanctions and even potential criminal exposure if false statements and representations were made knowingly under oath or in court."

Dominion Voting Systems tomorrow will square off in court against Fox News, more than two years after filing a $1.6 billion defamation suit accusing the network of knowingly airing disinformation about election fraud in the 2020 presidential contest.

Why it matters: The trial could set an important First Amendment precedent and shape political coverage by one of America's most powerful media outlets.

The big picture: Successfully suing for defamation in the U.S. is intentionally difficult — but legal experts believe Dominion has an especially strong case.

    • Dominion not only has to prove that Fox News made false statements, which it already has done, but also must demonstrate malice and that those false statements caused harm.
    • Unintentional errors, for example, wouldn't meet the legal threshold.

If Dominion wins: It could convince Fox News to become more cautious ahead of 2024 elections, particularly when it comes to ballot fraud allegations.

    • There also could be shakeups both behind and in front of the cameras at Fox News, as shareholders are unlikely to sit by quietly if a jury awards Dominion what it seeks or more.
    • A Dominion victory also could embolden others to sue media organizations when they feel wronged, although legal experts tell Axios the risk is remote.
    • "I do think it’s an uphill battle [for Fox]," University of Tennessee journalism professor Stuart Brotman said. "But you have some very powerful, famous media personalities testifying, and jurors can be captivated."

If Fox wins: Not only would it reaffirm America's very high bar for media defamation, but also would provide Fox News with a legal roadmap for airing future falsehoods.

    • The network has parted ways with one of the on-air hosts who allegedly defamed Dominion, Lou Dobbs, but continues to employee others, including Maria Bartiromo and Jeanine Pirro.

Either way: The trial could influence how Fox News defends itself against other defamation charges, most notably a $2.7 billion case brought by election technology company Smartmatic.

What they're saying: "In my opinion, [a Fox victory] would open our society up to a return to what used to be referred to as the yellow journalism of the late 19th century, like the Hearst newspapers that led to wars,” says Catherine Ross, a George Washington University constitutional law professor who focuses on the First Amendment.

Look ahead: Opening arguments are expected to begin at 9am ET on Monday, with a live audio stream available to those outside the courtroom.

Delaware Judge Delays Start Of Dominion’s Defamation Trial Against Fox News

The judge did not cite a reason for the decision.

The start date was pushed back to allow both parties to discuss the possibility of a settlement, the Washington Post reported. According to the Wall Street Journal, people familiar with the situation said Sunday that the conservative network had made a late push to settle the dispute out of court.

    No settlement yet

Fox News' highly anticipated defamation trial will kick off in a Delaware court Tuesday, more than two years after Dominion Voting Systems filed a massive $1.6 billion lawsuit against Fox over its 2020 election coverage.

Why it matters: Barring a last-minute settlement, the trial is expected to last five to six weeks and will not be televised, limiting the public's visibility into the proceedings.

    • Instead, the courtroom drama will mostly be documented by the few reporters that are able to get inside on a first-come first-serve basis. While a live audio feed will be available to the public, news companies can't rebroadcast it.
    • In-court cameras have helped some recent trials go viral, including Gwyneth Paltrow's ski collision court case last month and the defamation trial between Amber Heard and Johnny Depp last summer.

State of play: The judge in the trial announced a last-minute trial delay Sunday, pushing the trial start date from Monday to Tuesday. A new court filing out Sunday suggests dominion may be softening its settlement damages claim.

Catch up quick: Dominion is suing Fox for damages related to Fox's coverage of the 2020 election. It argues Fox knowingly aired false claims that its voting systems were rigged.

    • Fox argues Dominion’s lawsuit "is a political crusade in search of a financial windfall," per a network statement. Its main defense is that its broadcast rights are protected by the First Amendment.

Delaware Superior Court Judge Eric Davis has already narrowed the proceedings via a slew of pre-trial hearing decisions leading up to Tuesday's start date.

    • Last month, Davis ruled that Dominion could take Fox to court, after Fox lobbied for a summary judgement that would avoid a trial. He also ruled that Fox News' statements about Dominion are false — meaning that question of fact can't be disputed at trial.
    • Last week, Davis ruled that Dominion is not allowed to bring up the January 6 insurrection at the trial, arguing that doing so could unfairly influence the jury's thinking about the issue at hand, which is Fox's coverage of Dominion's voting machines.
    • He also said that Fox's defense can't reference broadcasts where some of its journalists fact-checked Trump's election lies.
    • Earlier this month, Davis said that Dominion can force Rupert Murdoch and his son Lachlan to take the witness stand. The ruling dealt a major blow to Fox, which had been trying to persuade the judge not to compel Murdoch to testify.

Between the lines: Ample evidence brought to light during months of pre-trial discovery hearings has legal experts in agreement that Fox faces an uphill battle.

    • “It looks like Dominion has a strong case, and I think that myself,” said Carl Tobias, a professor at the University of Richmond Law School. “I think the judge thinks that but he hasn't said that.”
    • Last week, Davis assigned a “special master,” or an outside attorney, to determine whether Fox lied to the court and withheld key evidence in the way it presented Fox Corp. Chairman Rupert Murdoch's role at Fox News.
    • Fox apologized to the Judge over the weekend and took responsibility for the situation, CNN reported.

The big picture: The trial could set an important First Amendment precedent and shape political coverage by one of America's most powerful media outlets, as Axios has noted.

    • Successfully suing for defamation in the U.S. is intentionally difficult. But if Dominion wins, Fox News may be forced to be more cautious ahead of the 2024 elections, particularly when it comes to ballot fraud allegations.

What to watch: Tuesday morning's proceedings will kick off with the finalization of the jury selection, before the trial officially begins.

    • There’s still technically time for Fox News to try to settle the case out of court, but there's less incentive for Dominion to settle at this point.
    • If Fox were to lose, it's likely to appeal the ruling, and an appellate process would "probably take quite a while," said University of Tennessee journalism professor Stuart Brotman.

    Settlement reached. 787.5 million

Fox News settles Dominion defamation lawsuit

Fox News and Dominion Voting Systems said Tuesday that they have reached a settlement agreement just moments before opening arguments were set to begin.

The deal ends a monthslong legal battle over whether the media company had defamed the voting machine maker when they broadcast election conspiracy theories in 2020.

The terms of the settlement were not immediately available.

    Lies Have Consequences

In a statement addressing the settlement, Fox News acknowledged the falsehoods aired on the network, without going much further to take accountability.

    The statement reads:

We are pleased to have reached a settlement of our dispute with Dominion Voting Systems. We acknowledge the Court’s rulings finding certain claims about Dominion to be false. This settlement reflects FOX’s continued commitment to the highest journalistic standards. We are hopeful that our decision to resolve this dispute with Dominion amicably, instead of the acrimony of a divisive trial, allows the country to move forward from these issues.

“The truth matters. Lies have consequences,” said Dominion lawyer Justin Nelson, noting that the $787.5m settlement with Fox News represents accountability.

“Fox has admitted to telling lies about Dominion,” said Dominion CEO John Poulos.

Just wake up , and as I usually do every morning , I log on to Google news and scan the headlines.
I was stunned to read about this latest development in the Dominion case.
I guess Fox knew what the outcome of this case would be and did not want it to go to trial.

    "Lies Have Consequences "
I hope this outcome , comes as a warning to other , who lately seem to be paling fast and loose with the truth and the information they are feeding the public. I hope some of the others who were witnesses against Fox, take the opportunity to also kick some Fox ass.
The sooner you fall behind, the more time you have to catch up.

With every news outlet on the planet talking about the Dominion debacle. it was fun watching Carlson and Hannity fumble through their shows with the same tired Biden bashing drivel.

Fox Noise response to the decision:

“We acknowledge the Court's rulings finding certain claims about Dominion to be false," the statement said. "This settlement reflects FOX's continued commitment to the highest journalistic standards. We are hopeful that our decision to resolve this dispute with Dominion amicably, instead of the acrimony of a divisive trial, allows the country to move forward from these issues."

“ Continued commitment to the highest journalistic standards.”

Too bad they settled out of court. More of Fox’s dirty laundry being aired everyday would have been more entertaining.
