    I was just watching Anthony Scaramucci interview on CNN and was asked about legal trump's challenges and if he was going to win and he said " it's just a sham designed to raise money, they have raised 67 million dollars in donations to challenge the results in the courts, but he said, if you read the fine print it says that the funds can also be used to pay debts and other costs , he said give it a couple of weeks to raise some more money, and he will change his tune and concede.

    trump is very mad at Fox for calling the election for Biden and is talking with One America News Network to have a trump news show there after he leaves the white house,

    I can't say for sure, but signs are there- what with this shameless begging for money, and cynically whipping up hysteria among the base. The real and most potent legal challenge facing trump may well be the bankruptcy courts.

    It mostly seems to be the case in our political system that the incumbents in power are reluctant to pursue the previous scoundrels, even for crimes of State. Otherwise, Cheney, Bush et al would be in jail- or hanging off the end of a rope. The reasoning, I think, is twofold. Firstly, they think such things serve to denigrate the political system overall- the very same system they benefit from too, and indeed hold the current incumbency. Secondly, methinks, such a blowtorch might one day be applied to them, when they are no longer in political power. They don't want that.

    It's human nature really. Give me all of the power, but none of the responsibility.

    President Trump has told friends he wants to start a digital media company to clobber Fox News and undermine the conservative-friendly network, sources tell Axios.


    The state of play: Some Trump advisers think Fox News made a mistake with an early call (seconded by AP) of President-elect Biden's win in Arizona.

    That enraged Trump, and gave him something tangible to use in his attacks on the network.


    "He plans to wreck Fox. No doubt about it," said a source with detailed knowledge of Trump's intentions.
    With loyal viewers and longtime dominance, Fox Corp. CEO Lachlan Murdoch said on a Nov. 3 earnings call:


    "We love competition. We have always thrived with competition. ... Fox News has been the number one network, including broadcast networks, ... from Labor Day through to Election Day."


    Here's Trump's plan, according to the source:


    There's been lots of speculation about Trump starting a cable channel. But getting carried on cable systems would be expensive and time-consuming.
    Instead, Trump is considering a digital media channel that would stream online, which would be cheaper and quicker to start.

    Trump's digital offering would likely charge a monthly fee to MAGA fans. Many are Fox News viewers, and he'd aim to replace the network — and the $5.99-a-month Fox Nation streaming service, which has an 85% conversation rate from free trials to paid subscribers — as their top destination.
    Trump's database of email and cellphone contacts would be a huge head start.


    Trump's lists are among the most valuable in politics — especially his extensive database of cellphone numbers for text messages.
    Axios is told told Trump may use vote-count rallies to undercut Fox.


    "He's going to spend a lot of time slamming Fox," the source said.


    Trump has increasingly complained that Fox News interviews more Democrats than it used to. He has needled the network by promoting other conservative outlets, including One America News and Newsmax.


    "Fox has changed a lot," Trump said during the most recent interview he has given anywhere, with "Fox & Friends" on Election Day. "Somebody said: What's the biggest difference between this and four years ago? And I say Fox."


    "I'm not complaining — I'm just telling people," Trump added. "It's one of the biggest differences this season compared to last."

    Voting technology company sends legal notices to Fox News and other right-wing media outlets over 'disinformation campaign'

    A voting technology company swept up in baseless conspiracy theories about the 2020 election said on Monday that it had sent legal notices to Fox News and two other right-wing media companies for participating in a "disinformation campaign" aimed at damaging it.The company, Smartmatic, said that Fox News, One America News, and Newsmax have helped spread false and defamatory claims that are not supported by real evidence and could easily have been debunked with basic research.

    "They have no evidence to support their attacks on Smartmatic because there is no evidence," Smartmatic chief executive Antonio Mugica said in a statement. "This campaign was designed to defame Smartmatic and undermine legitimately conducted elections."

    As President Donald Trump continues to attack the integrity of the voting system, some of his allies have homed in on Smartmatic because of the services it provided Los Angeles County for the 2020 election.

    The baseless conspiracy theories peddled about Smartmatic, which mimic those pushed against Dominion Voting Systems, falsely suggest that the company's technology allowed the November vote to be rigged against Trump. Some strains of the conspiracy theory have aimed to tie the company to the late Venezuelan leader Hugo Chávez and George Soros, the billionaire philanthropist who is portrayed as a boogeyman in right-wing media.

    In its legal notice to Fox News, Smartmatic identified several instances in which such theories were spread on its air by either Trump lawyer Rudy Giuliani or former Trump campaign lawyer Sidney Powell. The legal notice, which stated assertions made about Chavez and Soros have no truth to them, also identified instances in which the network's pro-Trump propagandists, such as Lou Dobbs and Maria Bartiromo, helped spread false information.

    "Fox News embarked on a disinformation campaign against Smartmatic shortly after the election closed and continuing today," the legal notice said. "Over the course of the campaign, Fox News published and republished dozens of false and misleading statements regarding Smartmatic."

    The legal notice said it believed Fox News has "no evidence or credible source to support" the false statements made on its air and said the network "would have easily discovered the falsity of the statements and implications being made about Smartmatic by performing even a modicum of investigation."

    "Smartmatic demands a full and complete retraction of all false and defamatory statements and reports published by Fox News," the legal notice added. "This retraction must be done with the same intensity and level of coverage that you used to defame the company in the first place."

    Smartmatic, which said it is reserving its legal right to pursue possible defamation claims against Fox News, One America News, and Newsmax, said its response to the conspiracy theories are "more than just about Smartmatic or any other company."

    "This campaign is an attack on election systems and election workers in an effort to depress confidence in future elections and potentially counter the will of the voters, not just here, but in democracies around the world," Mugica said.

    A spokesperson for Fox News did not respond to multiple requests for comment. Neither did a representative for One America News, the small right-wing channel to which Smartmatic also sent a legal notice.

    Newsmax said in a statement that it itself had "never made a claim of impropriety about Smartmatic, its ownership or software."

    "Individuals, including plaintiff's attorneys, Congressmen and others, have appeared on Newsmax raising questions about the company and its voting software, citing legal documents or previously published reports about Smartmatic," Newsmax added in its statement. "As any major media outlet, we provide a forum for public concerns and discussion. In the past we have welcomed Smartmatic and its representatives to counter such claims they believe to be inaccurate and will continue to do so."

    Smartmatic isn't the only election technology company that has been compelled to forcefully push back against baseless conspiracy theories targeting it.

    In November, elections security company Scytl poured cold water on conspiracy theories about it that had been circulated about it by right-wing media and a Republican congressman.

    'There is real teeth to this': Legal experts weigh in on Smartmatic's $2.7 billion lawsuit against Fox News


    "This is the definition of defamation."

    That's what CNN senior legal analyst Laura Coates told Erin Burnett Thursday night when discussing Smartmatic's $2.7 billion defamation lawsuit against Fox News, three of the network's hosts (Lou Dobbs, Maria Bartiromo, and Jeanine Pirro), Rudy Giuliani, and Sidney Powell.

    "When you are making statements that are knowingly false, and you make them with malice, and you actually tarnish reputations and it has a financial consequence — that's why you have defamation lawsuits in the first place," Coates said, explaining the seriousness of the lawsuit.

    Coates is not alone in believing Smartmatic's suit poses real threat to Fox. University of Georgia media law professor Jonathan Peters noted on Twitter that "libel law makes it difficult to prevail where the plaintiff is a public figure and/or where the speech involved a matter of public concern. In various ways, these will be key issues in litigation." But, Peters added that he believed the "smart money" is on Smartmatic.

    That seemed to be the general consensus among legal experts who commented on the case Thursday. Despite Fox describing the suit as "meritless," Powell calling it a "political maneuver," and Giuliani saying he looked forward to discovery, most legal experts believed it to have some bite. "This lawsuit is a legitimate threat — a real threat," CNN legal analyst Ellie Honig said. "There is a real teeth to this." And Roy Gutterman, who directs the Tully Center for Free Speech at Syracuse University, echoed to WaPo, "This complaint establishes a compelling narrative in its 270-plus pages. It will certainly be interesting to see how the defendants frame their responses."

    This is not a nuisance suit

    Brian Stelter writes: "Libel suits against media organizations are typically filed on a slippery slope. Journalists have good reason to be concerned about these types of cases. And nuisance lawsuits against newsrooms are a real problem. But I think it's safe to say that Smartmatic's action against Fox is not a nuisance suit, and it has little to do with news. It's going to be hard for Fox to wrap its hosts in a press freedom flag. This case is about entertainers who gave fuel to lies in a desperate bid to keep Trump in power."

    "Disinformation has free reign right now"

    When I spoke with Smartmatic's lawyer, Erik Connolly of "pink slime" fame, about the case, I did press him on whether he was worried his suit could set a precedent that could ultimately harm press freedoms. His response was that the lawsuit would actually be beneficial to legitimate news orgs. "I think it's the type of case that has to be brought right now to try to get us away from disinformation," Connolly told me. "Disinformation has a free rein right now. This kind of case can be a shot across the bow that courts can deliver that says, 'Let's get back to reality. Let's get back to factual reporting.'"

    A world of people "telling outright lies"

    Stelter writes: "I was struck by something Roberta Kaplan, a lawyer representing author E. Jean Carroll, told the NYT. Carroll is suing Trump for defamation. Kaplan 'stated that the profusion of defamation circumstances associated to the previous president was notable,' since there's been a perception that such cases are hard to win. 'What's changed,' Kaplan said, 'and why we're seeing so many more defamation cases today than ever before, is because, frankly, we're living in a world in which people with legitimacy and authority seem to feel no compunction whatsoever about just telling outright lies.' This is partly why other legal experts are saying Smartmatic has a strong argument -- the lies are explicit and easily debunked. And that's why it may not be so hard to prove that Fox and its hosts knew, or should have known, that they were telling lies -- which is the 'actual malice' standard that public figures have to meet in defamation cases..."

    The lies have consequences

    It's crucial to point out the consequences the slew of conspiracy theories pushed against Smartmatic have had for the company. In its lawsuit, Smartmatic detailed some of the ramifications: a wave of threats against its employees, a "meteoric rise" in cyberattacks, and hundreds of millions of dollars in projected revenue losses. CEO and founder Antonio Mugica told me that there was "no choice" the company had but to file the lawsuit. "The disinformation campaign that was launched against us is an obliterating one. For us, this is existential, and we have to take action."

    BREAKING: Dominion Sues Fox News For $1.6 Billion Over 2020 Election ‘Lies’


    Dominion Voting Systems, a company subject to a torrent of conspiracy theories from President Donald Trump and his allies seeking to overturn the results of the 2020 election, has sued Fox News for $1.6 billion, alleging the network falsely claimed Dominion rigged the 2020 election.


    That campaign to overturn the election — which was roundly rejected by courts but embraced by pro-Trump media — culminated in the January 6 attack on the Capitol, in which a horde of Trump supporters violently interrupted the certification of the 2020 vote by Congress.


    Dominion accused Fox, which is facing another $2.7 billion lawsuit from election technology firm Smartmatic, of spreading false claims that the company helped rig the 2020 election in favor of Joe Biden.


    Fox News filed a motion to dismiss the Smartmatic suit.


    “FOX News Media is proud of our 2020 election coverage, which stands in the highest tradition of American journalism, and will vigorously defend against this baseless lawsuit in court,” Fox News said in response to Dominion.


    The lawsuit cited a number of Fox News stars as having pushed false statements, including Maria Bartiromo, Tucker Carlson, Lou Dobbs, Sean Hannity and Jeanine Pirro.


    “Fox, one of the most powerful media companies in the United States, gave life to a manufactured storyline about election fraud that cast a then-little known voting machine company called Dominion as the villain,” the suit stated. It argues that after “viewers began fleeing Fox in favor of media outlets endorsing the lie that massive fraud caused President Trump to lose the election,” the network “set out to lure viewers back—including President Trump himself— by intentionally and falsely blaming Dominion for President Trump’s loss by rigging the election.”


    The lawsuit noted that Trump’s own attorney general, William Barr, said there was no evidence of widespread fraud in the 2020 election, and that Fox News knew the claims made about Dominion were “lies.”


    “Fox endorsed, repeated, and broadcast a series of verifiably false yet devastating lies about Dominion,” the suit stated. Those lies, according to Dominion, included the following:


    (1) Dominion committed election fraud by rigging the 2020 Presidential Election; (2) Dominion’s software and algorithms manipulated vote counts in the 2020 Presidential Election; (3) Dominion is owned by a company founded in Venezuela to rig elections for the dictator Hugo Chávez; and (4) Dominion paid kickbacks to government officials who used its machines in the 2020 Presidential Election.


    “The truth matters,” the suit stated. “Lies have consequences. Fox sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process. If this case does not rise to the level of defamation by a broadcaster, then nothing does.”

    Senate majority leader Chuck Schumer has joined a flood of social media users gleefully trolling Larry Kudlow after the former economic adviser to Donald Trump complained that Joe Biden wanted Americans to drink “plant-based beer”.


    Kudlow made the indignant claim on his Fox Business show on Friday, saying Biden’s climate policies and attempt to slash emissions would force Americans to “stop eating meat, stop eating poultry and fish, seafood, eggs, dairy and animal-based fats”.


    “OK, got that? No burgers on 4 July. No steaks on the barbecue ... So get ready. You can throw back a plant-based beer with your grilled Brussels sprouts and wave your American flag.”


    Beer is typically made from grains, hops and yeast – not steak, sausages or chops.
