    US Deportation of Illegal Immigrants

    The US deported around 250 illegal immigrant gang members to a prison in El Salvador. The courts have now ruled that Trump's use of the emergency deportation law was legitimate.

    However, one of the deportees was Kilmar Abrego Garcia.

    This BBC article says SCOTUS has now ordered he be brought back to the US.

    On Friday, President Donald Trump told reporters that if the Supreme Court said "bring somebody back I would do that".

    "I respect the Supreme Court," he said.

    Mr Garcia, 29, entered the US illegally as a teenager from El Salvador. In 2019, he was arrested with three other men in Maryland and detained by federal immigration authorities.

    But an immigration judge granted him protection from deportation on the grounds that he might be at risk of persecution from local gangs in his home country.

    The reason for his deportation protection, it says, is that he is 'at risk of persecution from gangs'. That sounds very much to me like he is a gang member himself. If that is the case then I think offering sanctuary to a gang member due to other gang members 'maybe wanting to harm him' is soft-hearted nonsense. Gang members should be deported.

    Unless there is a clearer explanation of why he deserves repatriation to the US then I would not mourn his 'accidental' deportation.

    The point of the article is not about whether or not the judge that ruled is wrong, it's that the orange turd is deporting people without due process.

    If this Garcia punter gets repatriated then it will show that even an expedited process is capable of correcting mistakes.

    But I would still like to see more evidence that this fella really is innocent of gang membership or involvement, given that his reason for special protection is 'risk of harm from gang members' back home, which makes it sound like he is mixed up in criminal gang activity.

    If he is involved in gangs then I don't think he deserves the legal protections he has been granted.

    I think the law has to be applied judiciously. The expedited deportation process using the emergency measures seems finally to have been approved, which I do think is judicious.

    Shouldn't due process be an inalienable right of everyone? Shouldn't have the guy been given the chance to show a judge he was in the country legally before being deported, not to a family back at home, but to a prison back at home without any evidence of a crime committed in either country?

    That is a good question.

    This is probably a separate debating point, but I do not think it is unreasonable to make a distinction between citizens and illegal aliens when it comes to measuring out the quantity of due process that is owed to an individual.

    I do think it is possible that illegal aliens should maybe be entitled to a smaller measure of due process than a paid up citizen.

    Of course the law as it stands does not make such a distinction, but I would argue that it would be reasonable of the law to make this distinction.

    They are illegal immigrants who are not supposed to be there in the first place. You could make a case that they should have no rights whatsoever to any legal recourse once their illegal status has been confirmed.

    I think suggesting that confirmed illegal immigrants may be due a more modest measure of legal recourse than a full citizen is a moderate position.

    I think the legal system seems to be in need of a DOGE style reform to get some community oriented common sense back into the speed of processing of illegal immigrants who are known to be gang members.

    Do you think the founding fathers had the deportation of illegal immigrants who were known to be members of overseas criminal gangs in mind when they wrote those words?

    I think they were more likely thinking of US citizens not being allowed to be executed, imprisoned or asset-stripped in the US without due legal process.
