    Derek Chauvin to be sentenced June 16

    The Hennepin County District Court said that Chauvin will be sentenced at 1:30 p.m., according to CNBC.

    He is facing up to 40 years in prison.

    Leading up to Derek Chauvin's murder trial, Justice Department officials had spent months gathering evidence to indict the ex-Minneapolis police officer on federal police brutality charges, but they feared the publicity frenzy could disrupt the state's case.

    So they came up with a contingency plan: If Chauvin were found not guilty on all counts or the case ended in a mistrial, they would arrest him at the courthouse, according to sources familiar with the planning discussions.

    Under the contingency arrest plan, the Minnesota U.S. Attorney's Office would have charged Chauvin by criminal complaint — a quicker alternative for a federal charge that doesn't require a grand jury — so they could arrest him immediately, and then asked a grand jury for an indictment, according to sources, who were not authorized to speak publicly.

    Prosecutors want to indict Chauvin in connection to two cases: for pinning Floyd down by his neck for more than 9 ½ minutes in May 2020, and for the violent arrest of a 14-year-old boy in 2017. In the latter case, Chauvin struck the teen on the head with his flashlight, then grabbed him by the throat and hit him again, according to court documents.

    The other three ex-officers would be charged only in connection with Floyd's death.

    The federal case will be prosecuted by Justice Department attorneys in Minnesota and Washington, D.C.

    MINNEAPOLIS (AP) — The unique circumstances surrounding Derek Chauvin’s trial in George Floyd’s death could offer the former Minneapolis police officer some shot at winning a retrial on appeal, though most legal experts agree it’s a long shot.

    Here’s a look at some of the issues Chauvin’s lawyers might cite in their expected appeal, and their chances of prevailing.

    WHAT ARE POSSIBLE ISSUES THE DEFENSE COULD RAISE ON APPEAL?

    The defense has said it was impossible for Chauvin to get a fair trial in Minneapolis because of pretrial publicity and community pressure on jurors to convict. That claim is sure to underpin any appeal.

    As they arrived at and left the courthouse each day for testimony, jurors passed clear signs that the city was preparing for renewed protests. The courthouse downtown was encircled by razor wire and guarded by armed troops. Most storefront windows were boarded up.

    A prime target of an appeal would be key rulings by trial Judge Peter Cahill, including that the trial should remain in Minneapolis rather than be moved and that jurors should be sequestered only for deliberations.


    COULD COMMENTS BY POLITICIANS LEAD TO A RETRIAL FOR CHAUVIN?


    Judge Cahill seemed to think that’s at least a possibility.


    He rebuked U.S. Rep. Maxine Waters on Monday for telling a crowd in a Minneapolis suburb days before deliberations started that, if Chauvin wasn’t convicted of murder, “we’ve got to get more confrontational.” Cahill called the California Democrat’s comments “disrespectful to the rule of law,” saying elected officials shouldn’t comment about ongoing trials. “Their failure to do so, I think, is abhorrent,” he said.


    Cahill indicated that Waters’ comments could be appealable.

    Prosecutors cite five factors in support an aggravated sentence for Chauvin:

    Floyd "was a particularly vulnerable victim" when Chauvin pinned him against the pavement by holding a knee to his neck, since the use of force continued after he became unresponsive. Floyd was also intoxicated.

    Prosecutors argue that Floyd "was treated with particular cruelty" as he was held on the pavement after repeatedly saying he could not breathe and while bystanders called for Chauvin to stop, and that he was not offered CPR or medical assistance by officers.

    They also accuse Chauvin of abusing his position of authority as a uniformed officer and committing a crime, as part of a group of three or more people, in the presence of multiple children.

    What they're saying: Chauvin's attorneys responded in opposition to a higher sentence by noting that Floyd's size, and his ability to continuously struggle while being restrained during what they described as a lawful arrest, serves as evidence that he was not particularly vulnerable.

    The defense argued that bystanders were free to leave the scene anytime they wished and that officers called for an ambulance to get Floyd medical attention.

    His attorneys also stated that the other officers on the scene with Chauvin have not been convicted of a crime related to his own offenses. Former Minneapolis police officers Thomas Lane, Tou Thao and J. Alexander Kueng are charged with manslaughter as well as aiding and abetting second-degree murder.

    I make no value judgment on this particular case but on the process, because the process applies to all of us, and one day any one of us could find ourselves subjected to it.
    Even though I understand that the settlement between City and the family was a separate case, IMO it should had been delayed until after the trial. Since there was a historically high , well publicized settlement and a De facto addition of guilt by one party , and a reasonable request for change of venue was made, it should had been granted, but for political reasons was not, tainting the process. Then in a sensitive and well publicized case such as this a request for the jury to be sequester for a few days was rejected, Why?

    Then we have the issue of the Juror that lied about his involvement in BLM. Not making any equivalency but. supposed there was a black man on trial, and pictures of one of the juror wearing a KKK hood surfaced, how would you think the impartiality of that juror would had been judged?
    I will tell you , if I was on trial and these thing happened to me, I would not be very happy, or consider it very fair, would you?

    I am sure the only question he was asked was not if he had participated in the riots. After all the purpose of the jury selection was to determine if had already formed an opinion on the Floyd case
    "Get your Knee of our neck BLM" sounds to me like one might have already formed an opinion on Floyd case, and not a statement on "I have a dream" , He might have ware the T shirt at a MLK rally, but it was in support of BLM and made a direct reference to the Floyd case.
