It's more a case of international law. An Australian sold the name to the yank company.

Yeah, it stinks, but it does come back to the Aussie who sold the name to the seppos. Was he right to do so? Maybe not, but it was legit.
if a Kiwi or Aussie sold the name "Pavlova" for a merangue dessert to a seppo firm, what can be done?

The ruling is absurd. $1200 worth of merchandise does not warrant a half million dollar compensation. In that sense, yeah seppo law is fucked up.

Well not under US law it isn't, it's trademarked.

But....

Deckers began asserting its new trademark and sent out cease and desist letters to Australian manufacturers who were using the name ugg for their boots but otherwise took little action.

So if he was warned and decided to ignore it then the law of "som num na" applies.

Agreed though, the amount of damages is absurd, but it is seppoland.

Simple way to get Deckers. Get the Aussie public to stop buying Hoka One, Teva etc and get behind the Aussie battler. That will make the USD450K seem like chicken shit.

On the one hand I can sympathize with his plight but on the other hand I'm thinking that after years of nicking Kiwi desserts, bands, sports stars, horses, actors and other stuff and calling them 'Aussie' the Australians can get fucked.
