The UK have made concessions on the rights of EU citizens living in the UK. It looks as though the ECJ could be used in some form to ensure these rights remain beyond the brexit date.
The UK cannot afford to lose trading with the EU. Further concessions will be made before a future trade relationship begins. The idea of paying to stay in for a further two years speaks volumes.

PM May suggested that the ECJ may be used for clarification during her speech in Florence. It is a climb down from one of her red lines that said that EU citizens in the UK would be subject purely to UK law.
With the dangers that UK law will change post brexit in a way that endangers EU citizen rights, it is only to be expected that the EU wants those rights maintained as part of the brexit package.
The UK has already backed down on leaving the EU human rights convention...thank goodness.

That's the problem buriramboy, the UK still haven't put anything on paper. It's all wishy-washy stuff so the Brexiteers don't get too upset until a deal is done. However, if you bother to read between the lines of the Florence speech you will see that the UK have backed down on a couple of things. EU citizen rights and a clean exit in March 2019 for starters. The UK will be paying a brexit bill on top of this, despite Boris and the UK will be paying in the future to remain in certain EU associations.
Once this is put in black and white to the satisfaction of the EU then parallel trade talks might begin. Meantime, UK construction suffered an unexpected drop which, together with the collapse of Monarch, makes the UK position even weaker.
