    How Ivanka Trump and Donald Trump, Jr., Avoided a Criminal Indictment



    This article is a collaboration between The New Yorker, ProPublica, and WNYC.



    In the spring of 2012, Donald Trump’s two eldest children, Ivanka Trump and Donald Trump, Jr., found themselves in a precarious legal position. For two years, prosecutors in the Manhattan District Attorney’s office had been building a criminal case against them for misleading prospective buyers of units in the Trump SoHo, a hotel and condo development that was failing to sell. Despite the best efforts of the siblings’ defense team, the case had not gone away. An indictment seemed like a real possibility. The evidence included e-mails from the Trumps making clear that they were aware they were using inflated figures about how well the condos were selling to lure buyers.


    In one e-mail, according to four people who have seen it, the Trumps discussed how to coördinate false information they had given to prospective buyers. In another, according to a person who read the e-mails, they worried that a reporter might be on to them. In yet another, Donald, Jr., spoke reassuringly to a broker who was concerned about the false statements, saying that nobody would ever find out, because only people on the e-mail chain or in the Trump Organization knew about the deception, according to a person who saw the e-mail. There was “no doubt” that the Trump children “approved, knew of, agreed to, and intentionally inflated the numbers to make more sales,” one person who saw the e-mails told us. “They knew it was wrong.”


    In 2010, when the Major Economic Crimes Bureau of the D.A.’s office opened an investigation of the siblings, the Trump Organization had hired several top New York criminal-defense lawyers to represent Donald, Jr., and Ivanka. These attorneys had met with prosecutors in the bureau several times. They conceded that their clients had made exaggerated claims, but argued that the overstatements didn’t amount to criminal misconduct. Still, the case dragged on. In a meeting with the defense team, Donald Trump, Sr., expressed frustration that the investigation had not been closed. Soon after, his longtime personal lawyer, Marc Kasowitz, entered the case.

    Kasowitz, who by then had been the elder Donald Trump’s attorney for a decade, is primarily a civil litigator, with little experience in criminal matters. But, in 2012, Kasowitz donated twenty-five thousand dollars to the reëlection campaign of the Manhattan District Attorney, Cyrus Vance, Jr., making Kasowitz one of Vance’s largest donors. Kasowitz decided to bypass the lower-level prosecutors and went directly to Vance to ask that the investigation be dropped.


    On May 16, 2012, Kasowitz visited Vance’s office at One Hogan Place, in downtown Manhattan—a faded edifice made famous by the television show “Law & Order.” Dan Alonso, the Chief Assistant District Attorney, and Adam Kaufmann, the chief of the investigative division, were also at the meeting, but no one from the Major Economic Crimes Bureau attended. Kasowitz did not introduce any new arguments or facts during his session. He simply repeated the arguments that the other defense lawyers had been making for months.


    Ultimately, Vance overruled his own prosecutors. Three months after the meeting, he told them to drop the case. Kasowitz subsequently boasted to colleagues about representing the Trump children, according to two people. He said that the case was “really dangerous,” one person said, and that it was “amazing I got them off.” (Kasowitz denied making such a statement.)


    Vance defended his decision. “I did not at the time believe beyond a reasonable doubt that a crime had been committed,” he told us. “I had to make a call and I made the call, and I think I made the right call.”
    Just before the 2012 meeting, Vance’s campaign had returned Kasowitz’s twenty-five-thousand-dollar contribution, in keeping with what Vance describes as standard practice when a donor has a case before his office. Kasowitz “had no influence, and his contributions had no influence whatsoever on my decision-making in the case,” Vance said.


    But, less than six months after the D.A.’s office dropped the case, Kasowitz made an even larger donation to Vance’s campaign, and helped raise more from others—eventually, a total of more than fifty thousand dollars. After being asked about these donations as part of the reporting for this article—more than four years after the fact—Vance said he now plans to give back Kasowitz’s second contribution, too. “I don’t want the money to be a millstone around anybody’s neck, including the office’s,” he said.


    Kasowitz told us that his donations to Vance were unrelated to the case. “I donated to Cy Vance’s campaign because I was and remain extremely impressed by him as a person of impeccable integrity, as a brilliant lawyer and as a public servant with creative ideas and tremendous ability,” Kasowitz wrote in an e-mailed statement. “I have never made a contribution to anyone’s campaign, including Cy Vance’s, as a ‘quid-pro-quo’ for anything.”

    It is unfathomable to think of the Obama or Bush daughters, Chelsea Clinton, or any of their predecessors acting in such high-powered professional capacities, overshadowing the trained diplomats whose job it is to accompany the president to such meetings.

    But, as Washington has been seeing from the Trumps, the rules that previously governed the first family's behaviour have been discarded in this administration.


    Gasps become wordless eye rolls


    Every time there is some new breach of protocol, another one seems to follow, so that the gasps that might have been heard in prior times are reduced to sighs or wordless eye rolls.
    Until the 2020 election, America is hooked to the Trump family show.

    While some Democrats in Congress have tried to push back, nothing short of unseating Mr Trump will call time on the spectacle.
    It might be amusing, except that so much public money is at stake, not to mention America's standing in the world.

    No television script handed to Mr Trump was ever this ludicrous. And none of Ms Trump's jobs as a model ever gave her the runway that her father's administration has provided.

    The fireworks going off in Washington on Fourth of July night aren't only for a celebration of liberty. They symbolise the explosion of dignity that has taken place in the White House, and the man who lit the fuse.


    Others.

    Some are subtle, some, less so.

    Ivanka Trump calls legal inquiries into Trump business political ‘harassment’

    Ivanka Trump on Thursday called New York state investigations into her father’s business dealings “harassment,” seeming to confirm that the probes now include tax write-offs that appear to involve her.


    “This is harassment pure and simple,” she wrote on Twitter, linking to a New York Times report of recent subpoenas on the Trump Organization. “This ‘inquiry’ by NYC democrats is 100% motivated by politics, publicity and rage. They know very well that there’s nothing here and that there was no tax benefit whatsoever. These politicians are simply ruthless.”

    As President Donald Trump prepares to leave the White House, the tweet by his daughter, a White House adviser, could signal the family’s coming defense against mounting inquiries by state authorities.


    The president has been under investigation since 2019 by two independent inquiries in New York into his finances. One, led by Manhattan District Attorney Cyrus Vance Jr., was initially focused on the Trump Organization’s part in paying off the pornographic actor Stormy Daniels to keep quiet about an alleged affair with Trump. The other, a civil probe led by New York Attorney General Letitia James, was sparked after the president’s former lawyer Michael Cohen testified that Trump drastically exaggerated his wealth to secure loans.


    The Times reported on Thursday, citing people with knowledge of the matter, that those investigations had since grown to include consulting fees that were deducted to reduce the president’s taxable income. The two investigations have subpoenaed the Trump Organization in recent weeks, the Times reported, and some of those consulting fees appear to have gone to Ivanka Trump.


    Ivanka Trump dismissed the probes as political hit jobs. Both Vance and James are Democrats.

    Trump deducted about $26 million in fees to unnamed consultants between 2010 and 2018, and some of those fees paired exactly with $747,622 Ivanka Trump reported receiving from a consulting company of which she was a partial owner, according to The Times.

    Ivanka Trump was deposed on Tuesday as a part of an ongoing lawsuit from the Washington D.C. attorney general, which alleges the misuse of funds from President Donald Trump's inauguration in 2017, new court documents show.


    D.C. Attorney General Karl Racine sued Mr. Trump's inaugural committee and the businesses overseeing Trump International Hotel in Washington back in January, claiming the nonprofit inaugural committee coordinated with Trump family members to overpay for event space in a way that enriched the Trumps. Racine claims the inaugural committee knew it was paying above-market prices and failed to consider cheaper alternatives. The lawsuit, filed in D.C. Superior Court, alleges more than $1 million was wasted on improper payments to the Trump Hotel for event space during the 2017 inauguration.

    Following her “American patriots” tweet, Ivanka Trump and Jared Kushner “need not apply” to the upscale Indian Creek Country Club near their $30 million plot of land on the exclusive Florida island nicknamed “The Billionaire’s Bunker.”

    The island community — one of the wealthiest in the US — has just 29 residences, and residents include Julio Iglesias, Carl Icahn, Tom Brady and Gisele Bündchen — but owning a home there doesn’t mean you get automatic membership in the country club.

    A local source sniped, “You have to be nominated and make a formal application. But it only takes one member to object against any new member, and many members are objecting, particularly after the events at the Capitol on Jan. 6.

    “Jared and Ivanka can lunch with their fellow ‘patriots’ at Mar-a-Lago.

    “The Indian Creek Country Club members are very picky and the word is that Javanka need not apply.”

    Ivanka — who was at the side of her father, President Trump, in DC as he made his incendiary speech to protesters before they descended on the Capitol — was heavily criticized for calling the mob “American Patriots” in a tweet that she deleted, even though she also called for an end to the illegal behavior.

    And as the president prepares to leave office, Ivanka and husband Jared have been planning their post-administration life.

    Page Six exclusively revealed the couple bought the $30 million-plus parcel of land on Miami’s uber-swanky and high-security Indian Creek Island.

    At the center of the island is the Indian Creek Country Club, once referred to as “Miami-Dade County’s most exclusive, and controversial, private society.”

    The 300-member club, built in 1930, has an 18-hole golf course, a restaurant and initiation fees exceeding $150,000. It is run as a separate entity from the wealthy residents of the island.

    The club has been mired in controversy in the past for its one-time practice of permitting only a handful of Jewish people and people of color in its membership.

    In 1999, Bill Clinton was criticized for golfing there. The following year, then-Gov. Jeb Bush canceled a tee time there after talking to the island’s Jewish mayor, Leonard Miller.

    A separate source said Ivanka and Jared had already been made to feel very welcome on the island, which is largely Republican, and they had received numerous invitations to dine with their future neighbors.

    The source added they had not applied for a membership at the Indian Creek Country Club, and the Trump National Doral Golf Club — which has four PGA golf courses — is nearby in Miami.

    Plus, their house on the island would take around two years to build, and in the meantime, the couple would be residing at another property in the Miami area.

    Secret Service barred from using Ivanka Trump's bathrooms

    The dying days of the Trump administration have been plagued by yet more scandal in the form of riots, Twitter bans and impeachment. Now the Washington Post has added another: water closet gate.

    In a multi-bylined article one of America’s top investigative news outlets has chronicled in leg-crossing detail the apparently extreme difficulty that the Secret Service detail assigned to Jared Kushner and Ivanka Trump have had in finding a place to go to the bathroom.

    According to the Washington Post the president’s daughter and her top White House adviser spouse have apparently exiled the squad of men and women assigned to keep them from harm’s way from using the toilets in their sprawling Washington DC mansion.

    “Instructed not to use any of the half-dozen bathrooms inside the couple’s house, the Secret Service detail assigned to President Trump’s daughter and son-in-law spent months searching for a reliable restroom to use on the job,” the paper reported, citing neighbors and law enforcement official.

    It quoted one law enforcement official as saying: “It’s the first time I ever heard of a Secret Service detail having to go to these extremes to find a bathroom.”

    It added that Secret Service members in the couple’s detail who were desperate to relieve themselves had resorted to a porta-potty, as well as bathrooms at the homes of Barack Obama and Vice-President Mike Pence.

    The solution to the problem was not a cheap one. Since September 2017, the paper reported, the federal government rented the stricken Secret Service members a basement studio with a bathroom for the purposes of them going to the loo. The cost to taxpayers? Some $3,000 a month.

    A White House spokesperson denied the couple restricted agents from their home. But the Post stuck by its investigative guns, saying: “That account is disputed by a law enforcement official familiar with the situation, who said the agents were kept out at the family’s request.”

    The Post’s story is unlikely to endear Washington citizens – or indeed many other Americans – to Ivanka Trump and her husband as they leave office after four high-profile years in Donald Trump’s administration. Multiple reports have already gleefully detailed the couple’s likely rejection from the New York and Washington DC social circles in which they have previously moved.
    Not that the couple will lack for a place to call home. They have recently bought a $30m plot of land on an exclusive island in Florida nicknamed the Billionaire’s Bunker.
