    Ted Cruz says states can ignore SCOTUS gay marriage ruling




    The former Supreme Court clerk weighs in on the states with same-sex marriage bans and their obligation to adhere to the Supreme Court’s ruling on gay marriage. The distinction he makes is if a state is not named in the suit in question, it does not have to comply:

    Ted Cruz has some unsolicited advice for the states not specifically named in last week’s Supreme Court ruling on gay marriage: Ignore it.

    “Those who are not parties to the suit are not bound by it,” the Texas Republican told NPR News’ Steve Inskeep in an interview published on Monday. Since only suits against the states of Ohio, Tennessee, Michigan and Kentucky were specifically considered in the Supreme Court’s Obergefell v. Hodges decision, which was handed down last Friday, Cruz — a former Supreme Court clerk — believes that other states with gay marriage bans need not comply, absent a judicial order.

    “[O]n a great many issues, others have largely acquiesced, even if they were not parties to the case,” the 2016 presidential contender added, “but there’s no legal obligation to acquiesce to anything other than a court judgement.”

    Cruz continued, “The very first truth-teller featured in the book is a gentleman named Guillermo Farinas. He was a Cuban dissident. He used to be a member of Castro’s army. He was a Communist. In fact, his nickname was El Coco. And he describes how he went to the Soviet Union and somehow got his hand on a copy of George Orwell’s ‘Animal Farm.’ And it touched him powerfully, and he became a dissident, and he became a critic. He’s been imprisoned, he’s had hunger strikes. And Guillermo, and also another Cuban dissident named Elizardo Sanchez, both came to the United States about a year ago. I interviewed both of them for about a half hour in Spanish. We put out the video interview, but it was interesting, both of them predicted what the Obama administration has done. And both of them said that the Castros are following Putinissimo is what they called it, basically the philosophy of Putin, of appearing to liberalize, while in fact strengthening the repression. What Obama’s doing is sending billions of dollars that will only make the Castros stronger, oppressing, torturing, murdering their people, and also spreading terrorism throughout Latin America.”

    He concluded, “I’ll tell you, Guillermo Farinas was back in the United States recently accepting an award for his principled stand against Communism, it was after the Obama administration had announced their rapprochement. And he said that the opposition movement in Cuba is heartbroken, they are abandoned, they are crushed. You know, the administration is not insisting on any role for dissidents. The Castros are continuing to imprison and torture people. They have no political rights. And all of the money going there is just propping up a cruel dictatorship that hates America, and that is 90 miles away from America. And it’s an example — consistently under the Obama-Clinton foreign policy, we have abandoned our friends and allies, whether it is the UK, whether it’s Canada, whether it’s Israel, and we have shown weakness and appeasement to our enemies.”

    Anyway, I heard what you said about the kind of people you think Latino immigrants are -- people with problems, who bring drugs, crime and rape to America.     You see, what you just did with your straight talk was send more Latino voters to the polls than several registration rallies combined! Thank you for that. Here we are pounding the pavement to get American Latinos to the polls, while your tactic proves most effective. Remarks like yours will serve brilliantly to energize Latino voters and increase turnout on election day against you and any other candidate who runs on a platform of hateful rhetoric.

    Do you know why that's such a big deal, Donald? Because Latinos are the largest, youngest and fastest-growing constituency in the United States of America. That's right! You are running for President in a country where the Latino population grew by over 49 percent from 2000-2012, while the rest of the country grew by 5.8 percent. What's more, we are the future. The median age of the average Latino is 27 years old, compared to 42 years old for white Americans. In case you need a translation, that means there are a whole lot of Americans who are Latino and have the right to vote. And, we're not going anywhere.

    This is the America we are actually living in. I hope by now you understand that without the Latino vote, there is no chance of you ever winning this election. If you don't believe me, you could ask President Bush or you could even ask President Obama.

    Mexican immigrants are almost entirely lawful and hardworking people. Most are in fact devout Catholics. They work hard and in many cases have actually joined the military and fought for this country.

    But in 2016 Hispanics will represent just 12 percent of eligible voters, and between 9 and 10 percent of actual voters. That’s a lot, but it’s not large enough to grant or deny Republicans the presidency.

    The math is simple: A 10-point gain among 10 percent of the electorate yields an additional point in the popular vote. Mr. Obama won by a 3.9-point margin in 2012. So even if the next Republican presidential candidate received the magical 40 percent of Hispanic voters that Mr. Bush received in 2004 — which seems unlikely in a fairly competitive national election — it still wouldn’t erase Mr. Romney’s deficit in the popular vote.

    Hispanic voters are disproportionately concentrated in noncompetitive states like Texas and California. This makes it even harder for the Republicans to claim the presidency by focusing on them, since there are relatively few Hispanic voters in the battleground states that determine who wins the Electoral College. Hispanics represent more than 5 percent of eligible voters in just three battlegrounds: Florida, Nevada and Colorado. As a result, the Republicans could have entirely erased Mr. Obama’s advantage among Hispanic voters and still lost the presidency in 2012, since Mr. Romney would have still lost states like Virginia and Ohio, where there are very few Hispanic voters.
