    Piss weak little Vios vs. tough BT-50 - SMASH!!

    Had my first collision in Thailand after driving here for 2.5 years. Was waiting at a red light when BOOM! Some drunk kid smashed in the back of me, going for the close swerve obviously intending to run the red light.

    This is in Chiang Mai on the highway just out of the city going to Chiang Rai. Was on my way to Mae Sai for a Visa run about 5am, the Monday after one of the millions of Thai holidays.

    Lucky I was sitting with my foot on the break, or I would have been propelled into the car in front of me. Insteadk, the little shit box (lowered to be cool) copped a frame rod straight through the windscreen and was lucky not to get hit in the face with the tough steel of my BT-50 HiRacer.

    Result; Vios written off, minor rear end damage to my pickup.

    Doubtless you'll be found guilty as a friend of mine was when an uninsured car went to a red light and T Boned her.

    The cop who witnessed it agreed the foreigner was wrong.

    Funny story actually. The guy driving was plastered, looked about 15 but could be in his 20's. He apologised profusely and spoke English. I called my insurance co. and he called daddy.

    About 10 minutes later I see a cop about 50 metres away sitting on his bike talking on a radio. Was puzzled why he wasn't coming over to inspect.

    Another 5 minutes later and brand spanking new Mercs rocks up and another kid gets out, pretty sure it was his older brother. The Mercs waits as they talk some hush in Thai and the drunk kid runs over to the Mercs and gets in the passenger side and it speeds off. The copper is watching and comes over after Daddy wisks the offender away in the Mercedes with the other sober kid there to take the fall. Standard.

    I didn't mind, wasn't going to snitch, but made it clear I was filming everything from my phone. I had a chat with the fall guy who also spoke pretty good English, not about the crash, just football and stuff. Nice guy he was. Good thing I spose it was a hi-so kid that smashed me.

    It's was a clear cut case, my insurance guy got there first and did the report with the copper. Even being a falang the insurance companies will always protect their interests so no stitch up here.

    actually not sure you are better off,

    the shit VIOS only got hit on the hood, while you got hit on the chassis, might have moved something underneath

    Overall you're right. They get a brand new car and I get mine back smashed up and repaired. But by better off I'm just talking about the collision. Defo not happy about it or anything.

    ^ Nah but two young French blokes were in the back coming for a Visa run. One was asleep no seat belt and woke up wedged between the back floor and front passenger seat.

    The offender hit his head and had a lump but was fine.

    I assumed with the premium insurance cover I got that I'd be covered for a car whilst mine was in for repairs. Turns out this is not the case which pissed me off, but apparently standard in Thailand now, you only get a courtesy car in the event of a write off. Insurance told me I need to sue them in civil court to cover costs of car rental and any other damages.

    Another funny story regarding this to follow...

    ^ Did it the next day, wasn't confident to drive but a mate who's a qualified mechanic back in the UK went over it and said it was fine to drive (the insurance guy told me can drive no worries but wanted a second opinion). Ended up overstaying one day. The French dudes headed for the Bus station as they didn't want to fuk up their double-entry.

    ^^ Nah they were cool. They wanted to hang around but I told them to go and organize a bus I'd be OK, and they told me to make sure to contact them if I needed witnesses etc. They saw the driver change and were there when the cop and my insurance rep did the report and drew pretty white lines on the road.

    I was told it was written off by my insurance co. Maybe not though, I thought it was serious but repairable.

    Wish I got this. The little fuker could have at least written my pickup off. I'm planning to trade it in on the new Ranger, not sure what affect this smash will have on resale or trade-in value.

    So I'm told repairs will take 7 days. I've got a new infant (2 months old) and need to be mobile for doctors, vaccines etc. Obviously I need to try get them to cover the cost of a hire car lest I be a pussy.

    The Missus insists on calling them first (we got their number from our insurance co.) as she thinks diplomacy is not my forte, the number was for one of the kids, not sure which one. I wanted to speak directly to Daddy.

    So the kid is an arrogant fuk to my Missus and said it was just an innocent accident and no reason he should pay for a hire car, and he also has money problems. She told him the driver was drunk and switched and if they don't pay they are 'jai lai', he goes sheepish but she gets nowhere. He refuses to pay.

    I call him back the next day, his English is surprisingly good. He started off with the arrogance "Why is my insurance paying if I did something so bad". I ask him what his insurance company would think about the video footage I have of the switch. He starts squirming and pleading, saying how he has no meny etc. I tell him he has to go to Daddy for the money, I saw the Mercs, the family has cash. I'm asking for the nut low amount of 7 days x 800 bt (5600) for an inferior hire car.

    It was like talking to a 12 year old. I explained to him what would happen if this goes to court; you will lose a claim of 500K bt+. I also go into how he needs to pay for the consequences of his actions, and how reasonable I'd been. I asked what he would do if he were me, and that if I was 99% of Thais I would be going for the throat, but all I want is the 5600bt for the hire car.

    He starts sobbing on the phone and says he needs to talk to 'some people' (Daddy - I think he's shit scared of pestering the old man over this again, 3 weeks after the incident).

    He calls me back a few hours later and it's obvious the words are coming straight from Daddy who seems to have a little bit of smarts and realises what's at stake here. He tried to haggle over the price and with my farang agression told him this was not negotiable, the 5600 is way unders and that it's an ultimatum to pay up or go to court. He tells me he doesn't care about court but wants to help me with my problem

    He said I need to bring the missus to meet up and collect the cash, they will pay but I need to sign a confidentiality agreement (assume they are protecting themselves from me cashing in then sueing anyway). He was a blubbering mess and on the back foot. I asked for his father's number but he wouldn't give it. I told him I need to think about signing anything and might need more money. This was yesterday and I'm, sposed to call him back this evening. How do you old hands out there play this hand?

    I really don't want to get into a shit fight especially with a rich family who can have the cops holding off like that with a phone call. Thinking I will just sign the paper, take the cash and be done with it. In reality though, since I got the evidence on video and two witnesses, I could probably squeeze 50-100Kbt + out of the old man, though would be creating an enemy in the process. Thoughts?

    hehe already asked them if they have a spare car for me to drive and that would be fine.

    Think I'll go with the sage advice of Larv and just get the cost of a hire car - leave it at a 5600bt settlement. They're getting off pretty dam light though.
