    TD Detectives - Who is at fault in this SMASH?

    We settled on 50/50 fault to avoid a big shit fight.

    I was turning right into a driveway, veered slightly left first so I could hook around. Indicacted nice and early, slowed down, saw the car in rear view approaching at speed but did not anticipate them overtaking me.

    My half was a 'dangerous' right hand turn, illegal in Thailand they tell me. Drunk woman overtook over solid yellow line. Pretty sure she paid off cops before I got to the station to avoid a blood alcohol test...

    Collision is just after the 0.50 sec mark.



    My car is totalled, but I caught it just in time to stop and only cop a clip - she was going at least 120 kph ... a split second more and I get t-boned to death .... lucky to be alive.

    So what say ye all, am I at fault here at all?

    Very strange. The first bit of the video showed some unusual driving across both sides of the road - were you unsure where you were going and where to pull into? I presume so, and that is why you stopped to ask somebody? On the wrong side of the road, facing oncoming traffic with your full beams/main headlights on...

    Just before you turned, you did look to pull into the left lane, so I can imagine why they thought they could overtake you (I presume you had your right turn indicator on, so you should not have been overtaken - if you didn't then you were certainly at fault; it cannot be seen on the video, I've looked several times). Difficult to tell how the road visibility in a straight line was, street lighting, etc - she was no way doing 120+... I'd say you were very lucky to get away with a 50/50 against a Thai, especially if the police saw your video...

    The more I look, the worse your driving looks. Having said that, it certainly looks like a difficult place to pull into on a fast road; maybe the kinda place you'd need to drive past, turn around in a safe place then turn left into safely.

    This is a conditioned driving habit that is quite dangerous and almost illogical, though you don't see it as much as you used to.

    In regards to the OP's situation......isn't it the responsibility of the turning vehicle to wait until they can turn? Giving way to flowing through traffic....

    Depends where you're turning. That was a dangerous place to turn, and looks like an illegal place to turn (judging by the solid white line); but, I'm not certain of that.

    Luckily, everyone was ok, so lessons to be learnt and move on.

    (I see R1_pet on the thread, and can't help but think if that was a motorbike you'd have killed them...)(of course, the motorbike shouldn't be overtaking, like the woman should not have been, on the wrong side of the white line, but we all know that they do in Thailand.)

    You assume way too much. I was picking up a salad from the restaurant where I got my takeaway from. She forgot to give it to me so I doubled back. I know exactly where I'm going, and the solid line stops where the driveway I was turning into is. My 'saw necking' did not cross over the white shoulder line. This is a driveway that you need to veer to turn into ... but yes you need to be very careful in this spot. This woman was flying, reared right up behind me un pulled right at the last second at speed.

    Anyway the cops say I'm at fault because I should have seen the overtaking vehicle and avoided the collision.

    Thats what the cops said too. So when turning right, you have to give way to speeding cars overtaking?

    I'm all for criticism, but how could this have been avoided? I stop dead because there is a car behind me (that may or may not want to overtake) .... it goes without saying she did not indicate to overtake.

    In hindsight, she probably shouldn't have made the attempt the pass him on the right into his turn, instead of on the left side as it is usually done.

    From the vid, it appears to be a difficult locale to turn anyway.

    You crossed over the white/yellow solid central line to get your salad, you kept your full lights on to oncoming traffic. Then, crossing over the white line again, you weaved between lanes on your side of the road. Lastly, where the full white line stopped wasn't actually possible to turn without coming back on yourself, a partial U-turn if you will (hence why you weaved into the left land, so you could swing round into the driveway). That's terrible, dangerous and illegal driving.

    Nonetheless, you're safe and so are the folks/woman in the other car, so not to worry.

    I'd say again, you were very very lucky to get away with a 50/50 in this instance.

    I'll accept pulling in to get my salad was illegal, as was pulling out. But not even close to dangerous. But that did not cause the collision. The solid line ends where I made my turn, for the purpose of turning into this driveway. The police even acknowledged that, but said because I was not aware of the overtaking vehicle, I was also at fault.

    In the real world, unless you have no brake lights or indicators the following car is almost always held at fault.
    It takes something pretty special to change that.

    I agree with you that it's a tricky place to turn. I'd hope that I'd drive safely, drive past the turn until somewhere safe and legal such as a garage or somewhere else, turn around, come back and pull in safely.

    But, if I was hurrying to get back to dinner, didn't see the car behind me then I may well have turned too.

    Once you saw the car behind you, you were in a tricky situation because you had a fair idea a Thai would either undertake or overtake at speed, bad light, at night, etc... I might have continued on at that stage, but I wasn't there and cannot say for sure. It's a bad turning, a dangerous turning, on a fast road...

    Yeah I know, the pulling in to get the salad and pulling out was a bit erratic ... but I was watching and the road was empty. I'll accept that was crappy driving.

    But the part where the collision was ... that's what I'm talking about, and yeah already admitted I'm 50% in the wrong here, even though that woman was plastered (yes I was sober) and did that overtaking, I should have known better. But the way it went down, not sure how I could have avoided it, other than doing a u-turn further down the road, which would have been illegal, as opposed to my legal swan nexk turn into this fucked up driveway.

    My insurance guy (1st class IMG) rocked up and said I have to go for blood test and we meet up the next day. Then he fukd orf. The woman stalled big time so it was about 2.5 hours after the collision until she got to the cop shop and they called me in. I got fined for driving with an Aussie licence (in country less than 3 months) and told by the big police that going for the blood test will mean a shitfight court case between insurance companies. I admit 50% fault and we nip it in the bud right here. And yeah I realise my driving was not perfect so happy with that result. Her insurance rep was there the whole time.

    Our place is a right turn off a major highway and if we don't drive down the center line as we get ready to turn, it seems just about every car will try to over take us. Directional signals mean nothing here and overtaking is the priority, not safety. In the west, I would say you were not at fault. Here fault is a fuzzy thing.

    yeah that's where I fucked up, totally admit it. I take this turn pretty often, its fucked up. Wont be doing it again.

    Yes Willy I am nuts as you know, and lucky to be alive, let alone getting away with 50%. But still ... the woman overtaking ... hard to see that one coming. I clocked up a few k's and never had an incident my fault before this ... maybe getting a bit complacent.

    Anyway keep firing it in. I think I did the wrong thing, but technically I could contest and make it her fault (even disregarding the fact she was drunk) ... or not?
