    Hmm... guess he’s lucky then. Hasn’t died in a motor vehicle accident, or gone among the ranks of the missing, hasn’t been convicted of a crime, or deported, or beat senseless in some remote back alleyway.

    Maybe he should seek a second lawyers opinion or perhaps it is best to be left well enough alone.


    The point of this thread was to bring up a legal case where a falang did not get screwed by a Thai Court of law. Again, it is contrary to the ongoing consensus of "a foreigner doesn't stand a chance in the Thai legal system".

    Awarding the car to the Dane, I think the judge should've been specific adding 'in good condition'. As it stands, he should expect some sawdust, grinding paste, sand and or iron filings in the oil sump, shit in the petrol tank and oil in the screen reservoir.

    In this case the Judge pretty much explained to the woman that if she didn't agree to the judges brokered compromise, she would lose the house. Her, the woman, options are limited. Don't like my deal - lose the car and the house and get, if you are lucky, all of THB 450k.

    excerpt from the article

    "The judge also explained, that since the house was built on land that belonged to the Thai woman’s mother, the only alternative to a compromise would be to tear down the house and sell the used building material and sell the car and split the money – since the Danish man was entitled to 50 percent of the shared assets of the relationship. That would give him half of approximately 900.000 baht.

    The judge made no room for doubt that if the Thai woman should decide not to accept her suggestion, then she would rule in favour of the Danish man. Leaving the car to him and keep the house was a better alternative for both, she proposed.

    It took the accused – the former partner – surprisingly long tome to make up her mind if she preferred to continue to fight for her claim, that it was all a gift, or accept the deal offered. Eventually, she declared in tears that if the Dane would not come back and live with her, which she had hoped for, then it was OK that he got the car."


    Silver lining to every story: At least the poor lass got a house out of it...

    ...who do you think would read it? Those of us who have been following your posts all these years already know many of the details...as an exercise to work out any remaining demons, however, writing might be worth the effort...

    Well, I doubt it would make you a millionaire, but, as a factual non-fiction and decent marketing it should garner a good bit of interest and could be profitable.

    You know far better than most the risk factor. Whether the possible rewards justify the risks, well, up to you. Writing a book is no small task.

    There's many a slip 'twixt the cup and the lip in Thailand.
    The case closes when the court's decision is met. While never ending appeals, disappearances and other antics happen at the upper end, for the most part it's a matter of which side is more generous, but from the few farang vs Thai cases at the lower end which I know about, when the court makes an order it's as good as done.

    The Dane can buy insurance from me, that he gets the car as ordered, but with no guarantee on its condition.

    Well, the woman would be foolish to damage the vehicle.

    The case went to court, a Judge brokered a compromise, if the woman damages the vehicle she will be held liable for the damages. The judge has already gone on record in finding for the plaintiff. However, the resolution of tearing down the house, selling the used building materials and the vehicle then splitting the cash value of THB 900k results in the woman losing both the house and the car for a return of @ THB 450k in cash.

    So, the woman is looking at a situation where the price of being vindictive is @ THB 2.5M.

    Only a fool would jeopardize the compromise, which basically gives the woman a THB 3M house for a two year "common-law" relationship. Would you risk a THB 3M house for the potential gain of a THB 1.7M vehicle? Considering a court of law has already reviewed the case and found for the plaintiff?

    If the vehicle is/was received in a damaged condition, as everything concerning this case is on record, the Danes' response is to have his lawyer file a criminal damage complaint with the police and a court case for the damages. The judge who brokered the compromise would probably order the house torn down and the materials sold. The proceeds used to repair or replace the damaged vehicle.

    I dont agree with you and I have never really listened to "reliable and vetted barroom buddies". I am basing what I think on living and interacting with normal Thai's here for 31 years.

    The guy got lucky and may have paid the judge to get that ruling. So many others who live in Buri Ram have been taken to the cleaners in a divorce over the years.

    My suggestion to you would be to get off.
