    Do you bring your half Thai child into Thailand on their non-Thai passport ?

    Hi Gents

    My Thai ex has spent most of the last year abroad. She likes to cause problems so she won't renew the children's Thai Passports in the near future. Therefore I plan to take the kids out of Thailand for a holiday and come back in on our British passports. I've taken the kids on holidays before on my own and had no issues leaving.

    By the way my children have my surname on their birth certificates and passports and they have Western first names too.

    I believe I'll get 30 day stamp at Immigration when I return to Thailand then have to go to my local Immigration office to get that extended (the kids have Thai Nationality) to 1 year.
    Then buy re-entry permits !

    Just wondered if anyone else does this or has any advice ?

    Future options might be to apply for custody then get the Thai passports again but obviously that's not so easy as it sounds !

    Your children can overstay in Thailand til they reach the age of 14 without fear of penalty. Hopefully by that time your problems will be sorted.

    If she likes to cause problems and you are seeking custody then good luck.

    Do you intend to live in Thailand or abroad if you get custody?

    Just a correction. The age is 15 year old.

    Plan to remain Thailand til kids about 16 (4-5 years away) then go back home possibly for school/Uni

    But would that cause problems at Immigration when leaving and returning to Thailand each time we go abroad on holidays ?

    Now that's another question. All I know is that children up to the age of 15 are exempt fines for immigration offences. May be a reply by poster 'Toddanials' is in order? He should be able to advise.

    You say you'll be bringing your kids in on their British passports so what will you do with your kids when their 30 days is up? Get extensions for them too? Or do you hope to renew their Thai passports before that time and leave Thailand with them then return again on their Thai passports?

    One issue might be in leaving Thailand on Thai passports that are about to expire. Some countries won't accept that and require 6 months validity remaining on a passport.

    Leaving on the Thai passport is fine and entering on the Non Thai passport which has more than 6 months, into another country is fine. It would have to be this way though - leaving on the British passports when they last entered on their Thai passport will not work if I remember rightly. The other problem you have is that Thailand, officially at least, does not recognise dual citizenship. So when they try to enter into Thailand on their Brit passport, there is a slight chance that passport control get shitty and ask for the Thai one.

    Out of interest, why not pop down to the local amphur and speak to them and explain the problem and see if they can help? Always worth having a go giving them some sob story. Or the old fall back, give the ex wife some cash to sign an affidavit saying shes OK with them having a new passport but can not attend and get it notarised.

    If she concerned you'll run off with the kids?

    I believe they get 12 months Extension due to their Thai Nationality ...
    Ps I'll find out this weekend when we head to KL on a Thai Passport with a few months remaining and a British Passport with a few years remaining !

    Yeh I agree re "shitty" !
    Local Amphur, I think I'll try that route when the ex moves abroad permanently, hopefully soon...........
    She doesnt care if I run off with the kids but I wouldnt leave Thailand til the kids are late teens.
    She wants a SILLY amount of money to help with the Thai passports. Money for herself is more important than holidays for the kids ...

    Cliffy, your kids have Thai ID cards, have they not? That surely gives them the rights to live here without a visa?

    I'd send your kids into bat on this one then. Get them to badger her to sign the form relentlessly because the way I see it you need to get that done before she leaves the country.

    Either way though it would be best to re enter Thailand on the Thai passports - if there are a few months on them. Save a load of hassle and I can not think of a reason why you would not do that. Avoids the whole illegality of dual passports under Thai law conversation.

    Price would increase dramatically after she has moved. It would include flight and inconvenience on top of the extortion money

    I'm not running off ! I was asked if SHE cared IF I would run off WITH the kids. I said No.
    Kids go to an International school here in Thailand, Although Personally I think Education is better in Western Countries, especially Universities hence why I also stated I am considering going back to Britain for their University Education in 5-6 years time.

    Actually No they dont but I'll also try and arrange that this week or next. Again not sure I can do that without a Thai parent present though.

    What's to keep you in Thailand if you're divorced and thinking about your children's future? ?

    It's obvious the mother isn't bothered, so why hang around?
    Your children will have a better education in a Western School than an international school in Thailand.
    Plus they will make life long useful friends and become more accustomed to the curriculum and teaching methods.
    Just my two pennies worth.
    You are storing up trouble for yourself and your children's future by delaying,for what aim?
    How many children and what ages??
    It'll help with my advice.

    BUT I'm thinking once she's moved overseas my chance of obtaining Parental Power (Child Custody) will improve.
    Meetings will lawyers this or next week will/might confirm this idea or not...

    I'm now not sure why you want to complicate things by going abroad and returning with your kids on a British passport if you plan to remain in Thailand until your kids are about 16 (4-5 years away). Is it just a holiday abroad you want? Or is there another reason?
