    trespass law

    Regarding trespass laws in Thailand. Specifically, can I or anyone else enter somebody elses room uninvited, or vice versa?

    there ARE laws about tresspass in thailand but you kinda dont notice them paying attention to it, especially in the rural areas.
    i didn't read the details, but sounds like you could lay a charge, although if the tresspasser was thai, you would probably not get far, law or no law.
    you should just have beaten the bugger to death at the time.

    it was a farang, didnt break down the door, just walked in while it was unlocked. what does laying a charge here involve. would a lawyer be needed or could it be done privately?

    i am no lawyer.

    and i doubt that laying charges will get you much satisfaction, whether the law is on your side or not..

    better to just bide your time and get even when he least expects it.

    if he is bigger than you then you can get amazing results using a car jack or large adjustable plumbers' wrench.
    if you miss or he gets up afterwards, run!

    hes in hiding its seems, and he wont be coming back to that room most likely, just wondering about the legalities

    Trespass will be covered in Thailand's Criminal/Penal Code. I don't have a copy to-hand and cannot find one online, but that's where I suggest you start.

    Im sure it would be. But how does one go about laying a complaint in Thailand. Going to the police station? or thru a lawyer?

    You report it to the Police, and take photos of the incident, it can be a jailable offence

    its a bit late to for photos, altho apparently the guy did make a confession to his boss

    so would a written statement from the person involved and the witness, left with the police be worthwhile

    It's a little late now. Why didn't you call the police the minute it happened? If there is a next time, then that's what you should do.

    because the guys a volunteer policeman and i was unsure of weather what he was doing was legal or not

    Is Trespass not a Civil offence?

    If so theres no point involving the Police. Not their ploplem.

    TC - in Thailand trespass is a criminal offence (although you wouldn't believe with all those Red Shirts)

    well james, sounds like the advice you have received so far is not much use

    why would you want to prosecute anyway?

    what did the guy do except walk in uninvited?

    if he damaged anything or assaulted your family, it would be a different matter

    so why worry, just make sure he knows you were not happy and he had better not do it again

    If I am renting land up country what rights do I have if someone enters my home area uninvited or in a threatening manner...

    I can only give you an example of Thai on Thai....

    Several years ago Mrs J's younger sister was around 15 and living at home with her parents....All things being normal in the village she had a couple of boys sniffing around her at night... So Pau goes to the police and asks them a straight question..Can he shoot somebody that is trying to get into his house? Answer.. Yes!

    So he told the boy's Father the answer..result.. no more uninvited guests!!

    I would hope the sight of a gun would be enough...unless you were in deep s**t and there were three or four of them with similar deterrents....

    If you follow the advice of this brilliant legal mind, do remember than charges can be brought fairly easily for assault or attempted murder.
