    Land Title

    We plan to purchase land in Thailand, if possible we want 3 names on the title documents.
    My Thai wife's name, my name and a friends name, we are both Australian.
    Is it possible to do this.
    If the land purchase cant be organized prior to our return to Australia, is there a way to achieve this without be present.
    Eg, signing in the presence of a Thai solisitor, to be counter signed by a given person.
    Sending documents to Australia to sign in the presence of an Australian solicitor etc.
    Hope iv'e sorta made myself clearish.

    I'll wait for the experts to come along.

    In the mean time: I was under the strong impression that the answer was: no. You can't own land, so you can't have your names on the land title certificate; I may be wrong, but...

    I think you'll find farangs can't have their name on land papers. I did know an English guy that obtained land through divorce, but couldn't put the land in his name. All he had was a document from the courts giving him rights to sell it within 12 months of the divorce.

    That's right Prag, farangs, aliens are banned from owing land, or controling the use of if, unless BOI certified. Even then it' a long term lease from the Government.
    OP any land you buy in Thailand, will have to be in a Thais name.
    Be careful, it's illegal to give a Thai money to buy land for an aliens use.

    OK, Does that say the land can only be in a Thai name, but we can be part owner in the buildings ?

    Yes and no, you can form a limited partnership company, but you are an alien and if you are intending to make money you need to be totally legal. A lot to it, same as the west.
    As said, it's illegal to give a Thai national money to buy land for an aliens use. If you do you are behind the 8 ball to start.
    If your idea has some merit, go to the Small Medium Enterprise board, they can steer you through all the permits etc.
    If you are thinking of some sort of resort/retreat forget it.
    Thais will say no problem, no one cares, but as soon as you make any real money, they suddenly care, starting with the tax and Vat people.

    yes you can (not with Jim)

    All these are pretty easy questions, I'd suggest you put in some legwork after sounding out this board; see the lie of the land and what it's really like - as Jim said: a black whole for foreigners money... Having said that, some people do make money, but they get stuck in and find out all the details; plenty of legwork and involvement. Anybody expecting an easy hands off investment, or limited input, will find that black hole.

    You have hit the nail on the head, you need to be in the know and be there. Thailand has been separating farangs and their money for years, they are good at it.
    There are opportunities, not as easily available in the west, developing and growing country, but you still need a business plan, funds to cover the long term.

    OP, welcome to a joint bank account, think I have 200 Baht in mine and will be another month or so before I have cleared all this seasons costs. Those pesky little things like fertilizer, insurance, cars and health, taxes and this year renewal of the factory license.
    It's a business and you hope after paying the costs, there's some money left for growing and more importantly fun.

    Hi, I will take Jims offer and contact him via E-mail.
    But before I do that. I must put the record straight, my Thai wife is of the utmost as far as honesty, is well educated and very business wise, as her sister who looks into much of what we want we are trying to do. Niether her or her family are out to scam me or anyone else.
    My wife in conjuction with her sister go to great lengths trying to organise what we are trying to do.
    We have a small business venture already in Thailand and want to expand just to have an OK income and an interest for when we retire there in a couple of years time.
    It is at times I find it hard to get my head around how things happen with the banks etc in Thailand, this is why I ask those on TD for some direction.
    Just maybe there is a way around the complexity of the Thai system that my wife has over looked, especially comeing from the falang side of the system.
    To all, I thank you for the input.
