    Property Transfer While In Australia

    My Thai wife's mother wants to put her property in my wifes name. This transaction will be done through a Thai bank. Can this be done with out my wife travelling to Thailand.

    Transfer of land ownership is done at land office not bank. The fact they are dealing with bank seems to indicate the bank is owed money on this property and chanote shows a lien on property or the bank is holding the chanote.

    ^^ Thankyou for the reply, Yes, maybe that is the case, is that why the bank needs my wifes signature on the documents, if that is the case can it be still be done from Australia

    The bank does not care who pays the money, as long as it is paid they do not need your wifes signature.

    the chanote needs your wife in attendance,

    which bank is owed the money and who holds the chanote(Papers for land).?

    ^^ what bank etc ime not sure at this stage, l let my wife sort that out, but it looks like my wife has to be in attendance, that's no problem, just didnt want to travel to Thailand to sign a document. It would be good if it could be done through a solisitor in Australia

    whats the urgency of transfering the name on the chanote, her mother could leave a will, and your wife named on it our you paying for the land ?

    If the bank is owed money on this property, will the debt be transferred to your wife? And jointly on to you?

    ^^ It is all finacialy very secure, we would still like to find away of not having to go to Thailand just to sign a document. As Yaso said in post 6, maybe it could be done with a will.

    just make sure its her last will and testament, saying that if your wife has taken care of her parents the other siblings should respect there parents wishes.

    if they did'nt you would have to take it to a lawyer if it was worth the trouble, if they not have money a solicitors letter would be enough possibly to scare them.

    Your answer is here, land transfers are done at the land office, not the bank.

    If the bank needs signatures it is because she will be taking on the debts for the land, no debts and the bank aint involved, just the land office, so we can assume her mother has borrowed on the land, can't afford to pay it back and is pressuring your wife to buy it/clear her debts.

    DD if they pay back the loan if there is one they can just send money to bank via a transfer, once payment is recieved whoever put the chanote as a loan recieve the papers back.

    thats unless things have changed.

    I am pointing out that there is a loan, land and property transfer has nothing to do with any bank unless they own a bit of it due to debts or loans, money is owed on it, she aint mentioned that tiny little detail to her husband, she has to pay it off, she gets to own, the parents get to live there free, everybody is happy.

    But yes, the loan can be paid from Aussie land, but the transfer she will have to be there at the LAND OFFICE or give power of attorney to someone she knows and trusts and get them to do it.
