    Boundary Wall Breach?

    Yet another 'willa' being slammed up adjacent to my property in Phuket. The owner's builder has started to build a swimming pool right up against my boundary wall. It's my understanding that any construction must be one meter away from an adjacent boundary and two meters if there are windows. Being a swimming pool the latter does not of course apply. Am I correct? Builder nice guy as in the wet behind the ears owner, but would appreciate confirmation of the aforegoing before throwing sharklets into pool when completed. Thanks

    I think your neighbour need written permission from you to build up to the property line. Otherwise, distance depends on district and what is being built.

    Taking the piss out of the locals. Anyway, no one appears to know anything here, but I distinctly remember my builder telling me that was the case. Howd you like a building slapped up abutting your house wall? Thought not.

    A bit of googledoodleoodle, i'd say a pool is equally relevant under sec 1342

    Section 1342. No well, pond, cesspool or receptacle for manure or refuse may be dug within two meters of the boundary line.


    No ditch or excavation for laying underground water-pipes or similar installations may be made nearer to the boundary line than one half of the depth of such ditch or excavation provided always that it may be made at a distance of one meter or more.


    In any case when the works mentioned in the foregoing paragraphs are carried out near the boundary line, due care must be taken to prevent earth or sand from falling in, or water or filth from percolating through.


    Section 1343. Land may not be excavated or overloaded in such manner as to endanger the stay of soil of an adjoining piece of land unless adequate measures are provided for preventing and injury.


    Section 1344. Fences walls, hedges or ditches, which serve as a boundary, are presumed to belong to the owners of the adjoining properties in common.

    Rather than starting a bad relationship with a neighbour try to talk with them, perhaps let the ladies haggle.

    Maybe for a small sum they will move the pool or similarly offer you some compensation like free use once a day/week would occur to me.

    If you intend to end your days there having good neighbours who will look out for you when away , water plants/feed animals a big plus.

    Softy softly , but try get sorted before too much expense at their end.

    While there all sorts of laws , compliance and enforcement is notoriously random from place to place and even which official in a quaeter of a century here I have had no issues with local offcials but cheaper, friendlier to avoid IMHO good luck.

    I did research this when I built our pool bar area. From what I remember, as Mike quoted, it should be 2 meters away from the community property line.

    Oddly enough what I found to be funny is you can build a 3+ meter tall wall as long as it is not touching the adjoining property line.

    This is a photo of a dividing outside wall where my neighbour has raised his garden soil levels higher than my garden soil. Therefore the pressure on his side of the wall has to be taken into account due to the rains etc.
