    about time a court ruled with some common sense,
    aust was going down the american road of i will sue someone because i
    was a dickhead, if you do something stupid,wear it because you are stupid.
    my insurance and taxes go up because of these drop kicks and their lawyers
    hope she gets her name outed, then the next guy would be sure to screw her in the middle of a fifty acre paddock,nothing but stars overhead.

    It is not just money but quality of life for other people that these fok-ups are putting at risk. If she got a massive compo payout then the fallout would be that folk who have to travel a lot for work would end up with more conditions imposed on them about what they could and could not do while on the road.

    The reasoning given in the judgement is not ok.

    If she was walking into the lobby, speaking on her phone in the lift, doing her toenails on the edge of the bed, she would've got compensation - saying that sex is the reason she doesn't get compensation is just wrong.

    I'm not saying she deserves compensation, I'm just saying that the 'legal' reasoning is pathetic and wrong.

    She's either covered whilst on government trips or she is not... Saying that having sex, clipping your toenails, putting on a wooly hat, etc, was not 'enouraged/instigated' or any other wording, is plain wrong. The nature of accidents is that they are not predicted or encouraged or instigated, etc. This is an awful judgement...
    Cycling should be banned!!!

    she was using something (ie the light fitting) in an incorrect manner.

    If she used the hair dyer in the shower she would also not be covered. If she crossed a road against a red light she would also be told tough luck.

    her stupidity should not be borne by her employer (or regulatory body).

    Not for the toenails she would not.

    The legal clarification is that in order to be eligible for compo you must be engaged in an activity that was encouraged or directed by your employer. i.e. what recreational activities you get up to in your private spare time after hours is your business and is not covered - doesn't matter if it is shagging or painting your toenails.

    I now paint my toenails in the office during working hours just to be on the safe side!

    So as this happened in Australia ....in the next chapter of this saga, we will probably see "Commonwealth Government employee sues for negligence as her female supervisor fails to protect her under the workplace safety act whilst having sex with her"

    Don't laugh.....poor average Australians are paying tens of thousands of dollars for this..."her employer" (the Australian public service funded by taxation!) covered the court and high court legal fees.......and the citizens of Australia do nothing about it!!!
    Fortunately this would not happen in Thailand...and people think Thais are stupid!!!!

More likely a Lesbian lover!........the Australian Public Service is run by women these days, (if you doubt this do some research)...almost all Schools have more than 80% women from top to bottom.Our Universities are producing female lawyers like rabbits!..and senior academic positions are increasingly being taken by femmanist proactive women. This is changing sensible policies in almost every level of Government in Australia. In most Local Government they are rapidly taking control of all management and executive roles, and every part of the public service....day by day... just a matter of time until they out all the male politicians....That's why in desperation the males that are left are importing so many radical Muslim Men illegally through Muslim countries by boat, to try to maintain a male dominant family orriented society in the hope they will stifle the female plans of a bloodless female Government Coup! Have we just had our first ? female Prime Minister?     Your last sentence gets to the point. Either you are covered for accidents at work or you are not.

    If your insurance does not cover you for accidents on work trips then I would not be going on work trips. Fullstop.

    The legal angle is just that, an angle... It's shameful when the judiciary are used for politics and powermongering (as in this case), but it's sadly the norm.
