    Man charged for defacing Elliot Fletcher Facebook tribute page with child porn


    POLICE have arrested a man who allegedly plastered child pornography over Facebook sites set up to pay tribute to a dead schoolboy and schoolgirl.

    Elliot Fletcher, 12, died after a Brisbane schoolyard stabbing in February.

    Trinity Bates, 8, was murdered in Bundaberg in the same month.

    Thousands of people paid tribute to the children on Facebook pages but the sites were soon defaced by hackers.

    Queensland police said the anti-child exploitation task force Argos had today charged a 29-year-old Tarragindi man over the defacing.

    Detectives who executed a search warrant on a Brisbane home this morning allegedly found child exploitation material.

    The man faces five charges relating to the offensive use of the internet and possessing and distributing child exploitation material.


    He was expected to appear in Brisbane Magistrates Court this afternoon.

    Detective Superintendent Peter Crawford said there was a clear message out of the case.

    "You are not anonymous when online and you can and will be held responsible for your actions when they breach state or Commonwealth legislation," he said.

    If it's on their notebook computer, and they travel overseas (Australia for example) and the contents is found on the computer, then they will certainly be in a precarious position.

    I think you guys are over looking the requirement for mens rea / intent. You can't / wouldn't be prosecuted for accidentally viewing the material.

    However since this is a Facebook page we're talking about here then if it ended up on your laptop, you travelled overseas, and the contents were found then yes you'd probably be prosecuted. Rightfully so at that, you've met the required mens rea / intent as the only way it could have gotten on there was if you actively downloaded/saved it.

    Really? Truth be told I'm a bit of a PC numpty so wasn't aware of that possiblity. I guess though that it would be some type of 'ghost' image/file, as in not the original? If that were the case you could easily still make a defence on the basis of lacking the requisite intent (even if it were the 'original' for that matter, although the chances of succeeding would admittedly be less).

    I guess the point I'm trying to make is that if someone were to send you an e-mail / link that you opened and it contained some objectionable and illegal content you wouldn't automatically be charged and/or prosecuted for it were it later to be found lurking on your hard drive somewhere.

    For sure, but they would certainly ask where and when you reported the offending material, and if not, why not.

    I believe every single page one visits in Thailand isto kept on record by the IP provider. I'm sure US and UK are doing the same through assorted " Patriot " type act legislation.
    I' sure proxy servers also keep records .

    The internet is truly a two way street.
