    UK Man gets 14 months for giving g/f genital herpes

    Man jailed for 14 months for giving girlfriend genital herpes


    Traffic officer David Golding has been jailed for 14 months for passing on genital herpes to his girlfriend.


    The 29-year-old admitted causing grievous bodily harm by giving the sexually transmitted infection to his then partner, Cara Lee, 23.


    But sexual health experts and charities have called the decision to imprison him ‘outrageous’.


    It is the first time anyone has been convicted for passing on herpes.


    Golding, who works for the Highways Agency, kept his infection a secret when the couple were together in 2009, and later denied it when confronted by his partner, Northampton crown court heard.


    After finding out she had been infected, Ms Lee moved out and reported him to police in March 2010.


    Judge Michael Fowler told Golding, from Daventry: ‘Because it was in a relationship, it was particularly mean and one which amounted to a betrayal – a betrayal in a relationship in which you professed love.


    ‘The injury you caused by this infection is at least or more serious than an injury leaving a scar because it carries continued recurrence, extreme discomfort and consequences for relationships she will have in the future.’


    David Everett, defending, said his client was ‘extremely stupid but he did not do this in a premeditated way.’


    Sexual health experts said herpes was not serious enough to amount to grievous bodily harm under the Offences Against The Person Act.


    ‘Being sent to prison for 14 months for passing on herpes simplex is like being sent down for ten years for a parking offence,’ said Dr Colm O’Mahoney, sexual health consultant at the Countess of Chester Hospital.


    ‘This is outrageous. Will children now be prosecuted for “giving” their friends chickenpox?


    ‘Most people who have genital herpes don’t know it because, even if they do get recurrences, it is such a trivial genital infection that they don’t notice it.’
    He said genital herpes has the same implications as a facial cold sore.


    In Britain, about 6million people have genital herpes and up to 40million may have picked up herpes simplex (a cold sore) on the face.


    Ms Lee, who has met a new partner with whom she has had a baby, told Closer magazine: ‘The past two years have been soul-destroying. I get angry and depressed when the herpes flares up. Jail is what he (Golding) deserves. He’s given me a life sentence – he needs to pay for what he’s done.’

    With this and the Bribery Act 2010 which came into force last month I do believe the UK is aiming to imprison the entire planet.

    Next on the list are smokers for causing global warming.

    Well hang on a cotton-pickin minute here. There are TWO different and distinct types of herpes ....Herpes Simplex, or type 1........and Herpes Zoster, or type 2.

    Type 1 is the same type as cold sores on the mouth, but it can be passed through genital contact. I myself had it on the penis once (age 21), and never had a recurrence.
    Type 2 is the more serious as although many people recover and never get a subsequent recurrence, it migrates to the nerves and in some people sits there till the body's immune system becomes weak, and then flares up. Whereas in some people it recurs regularly.

    Which did he give her ? The doctor is referring to type 1. Was that a statement about this individual case ? Or a blanket statement about type 1, which this case may not be ?

    Seems to a lot of fear-mongering going on, with courts handing down verdicts of utter stupidity like this..

    If she had given him the Herpes, would she have got this sentence?

    Good point. Presumably at some time he caught it from a woman, so he now needs to track her down and she can go to prison too. She, of course, will then be entitled to track down whoever gave her Herpes and he can also go to prison. If the police work hard they can have all six million offenders locked up in no time.

    Does this not trace back to a snake in the Garden of Eden?

    About 15 years ago in the USA, some woman got the bright idea of suing her boyfriend through his homeowners insurance policy for giving her herpes in his bedroom, and the insurance company ended up paying. The next year virtually all homeowners policies were amended to exclude lawsuits arising from sexually transmitted diseases within the home.

    But some people get only a rash or small bumps on the skin that appear to be pimples. Still others have different symptoms, such as painful urination, and some women have fluid discharge from the vagina.
    Sores may appear four to seven days after a person is first infected. Flu-like symptoms, including fever and swollen lymph glands in the groin, may also follow the initial infection.
    Symptoms come and go with no set pattern. One person may have an outbreak once a year, while another may have one every few weeks. Before a flare-up, a person may notice an itching, tingling, or burning sensation in the affected area, and there may be sharp pains in the pelvis or down the leg.
    Herpes sores are usually worst the first time they appear. In later outbreaks the sores tend to be less painful and last for a shorter period of time.
    The symptoms of genital herpes can affect any of the following places on the body:
    • Penis
    • Scrotum
    • Vulva
    • Vagina
    • Anus
    • Urethra
    • Thighs
    • Buttocks
    However, many people with genital herpes never have symptoms, or they mistake them for another malady, such as:
    • A vaginal yeast infection

    Doesn't exactly tally with the definition of grievous bodily harm .

    When I look at some of the sentances being handed out to rioters ( none in some cases 4 years in others ) and this sentance of GBH it becomes increasingly clear that to qualify for the position of judge you need to be either completely doolally or else have your head jammed up your arse to facilitate divorce from reality.

    What a pathetic shower they are.
