Apparently the RAN prohibits sexual relations at sea. It would be interesting to see the uproar if lesbians or gays were reprimanded for this.

Last night I was discussing this and the rugby players scandal with my sister. Apparently someone intoxicated cannot legally give consent, therefore having sex with a drunk woman could be considered rape. However it's gray area and a jury would never convict. To make things clear ppl are suggesting creating a law making it illegal to have sex while intoxicated.

Its not really a gray area. Basically, the chic has to be so pissed she doesn't understand whats happening before its considered non consent. Which means virtually passed out. If the woman responds positively to sexual advances its regarded as inferred consent and by the same token, if she reacts negatively, its regarded as non consent. Just being drunk is no excuse for doing something you would normally consider wrong. If the law accepted that excuse it would open the door to all kinds of criminal defences. People get drunk by choice and knowing it may affect their judgement. They have to take responsibility for that choice.

Men in Australia are now being encouraged not to have sex with with women under the influence.

My sister has a PHD and works abused children, according to her responding to sexual advances while under the influence didn't amount to consent.

She also said that a jury never gives a conviction in a rape case, but had to back track when I asked how men ended up in prison for rape.

My father and BIB weren't game to enter the discussion unless it was to back up the ladies. In Australia going against the grain of political correctness is not tolerated and men will find themselves in trouble for it.

Your sister is talking out of her arse. Being drunk is no excuse for regrettable behaviour under law by either men or women. You make the choice to get drunk knowing it will impair your judgement and you are responsible for what actions you take after that. Turn it around and ask your learned sister if the woman was sober and the blokes judgement was impaired by alcohol, -- would it be considered rape if he regretted it in the morning? I'll bet she says "no, -- thats different".

If you were not, your sister would have told you that less than eighty percent of rapes are reported, of those less than fifty per cent of perpetrators are actually charged and of that, less than five per cent are convicted and even of the convicted only fifty per cent of them actually do any time. Of that tiny percentage of people who do time, it is not their first offence. If your sister doesn't know that or is not prepared to stand up for it, she is in the wrong job.
