| Apparently the RAN prohibits sexual relations at sea. It would be interesting to see the uproar if lesbians or gays were reprimanded for this. Last night I was discussing this and the rugby players scandal with my sister. Apparently someone intoxicated cannot legally give consent, therefore having sex with a drunk woman could be considered rape. However it's gray area and a jury would never convict. To make things clear ppl are suggesting creating a law making it illegal to have sex while intoxicated. |

My sister has a PHD and works abused children, according to her responding to sexual advances while under the influence didn't amount to consent. She also said that a jury never gives a conviction in a rape case, but had to back track when I asked how men ended up in prison for rape. My father and BIB weren't game to enter the discussion unless it was to back up the ladies. | I am an Aussie mate and I can assure you that consensual sex with a drunk woman is not considered as rape. The woman would have to be so drunk as to be incapable of giving consent to make it rape. Shit if they did what your sister reckons why the hell would blokes be buying the girls drinks all night? Your sister is talking out of her arse. Being drunk is no excuse for regrettable behaviour under law by either men or women. You make the choice to get drunk knowing it will impair your judgement and you are responsible for what actions you take after that. Turn it around and ask your learned sister if the woman was sober and the blokes judgement was impaired by alcohol, -- would it be considered rape if he regretted it in the morning? I'll bet she says "no, -- thats different". |
