NYPD Officer Daniel Pantaleo, caught on another video putting Garner in a chokehold, was assigned to work desk duty. A new clip posted Saturday shows an apparently lifeless Garner, whose head droops to the side as at least eight cops stand nearby or empty his pockets.

The eight-year NYPD veteran officer who was caught on video putting a Staten Island man in a chokehold has been stripped of his gun and his shield.

Officer Daniel Pantaleo was placed on modified duty Saturday as cops and the Staten Island district attorney investigated the case.

This comes after a shocking new video shows Eric Garner, lying handcuffed and unresponsive on a sidewalk, received zero medical help from cops who instead just emptied his pockets.

The seven-minute clip posted Saturday on YouTube shows an apparently lifeless Garner, whose head droops to the side as at least eight cops stand nearby.

“C’mon guy,” one cop says to Garner, the only thing on the video that suggests any of the officers was trying to help the man. “Breathe in, breathe out.”

But Garner, lying on his side with his eyes closed, doesn’t move at all — even when the officer slaps him on the shoulder. The side of his head remains flat against the concrete, and his eyes never open.

At one point, another officer is seen taking a cell phone and a pack of cigarettes from 43-year-old Garner’s pants.

Even after the arrival of an EMT four minutes into the video, no medical aid is provided to Garner. He’s instead just loaded onto a stretcher and wheeled off.

Cops say he was pronounced dead a short time later after arriving at a Staten Island hospital.

NYPD is catching a lot of flack for this one and I can understand why. The man seems to be putting up little resistance and is taken down very roughly. It's quite disturbing to see this father of six to be treated in this manner. Now he's dead.

All NYPD are scum.

Hope those punk cops get sent to prison where they might learn some respect.
They could be bubbas bitches.

I have watched the video a few times. He was an agitated big fat man who was waving his arms about. He was asked in a non confrontational manner to cooperate. He refused to comply and he started the struggle when he resisted arrest. Keep in mind that the police were there because depending on which version of events one accepts, that he was alleged to have been in a violent confrontation or was engaged in the sale of illegal tobacco.

The fact of the matter is that this man was morbidly obese and a smoker. I don't think it will come as a surprise that the autopsy will show that he had a pre-existing circulatory condition with blocked arteries. There is no evidence yet that shows the police action caused his death. Sources told the Daily News there were no signs of neck trauma, such as a crushed windpipe, on the heavyset victim.
The man was capable of breathing because he was complaining he could not breathe. If you don't talk in air, you can't talk. I expect that when he said he couldn't breathe that's when he had his heart attack.

Can't see much, but guessing cop breacded proccedure, choke holds are not allowed in most forces.
Big fat guy, agitated, prime candidet for positional death asphyixia.
All about force options, cop, jumped to life threatening/ real danger of harm force.
Other cops had to jump in, to late to back off, badly handled, big agitated, know by police, not the sort of guy you want to overpower.
Strange, yank cops seem to like to taz first, could be they had on other occasions, to no effect.

A choke hold doesn't stop you from breathing, it constricts your carotid artery and chokes off blood supply to the brain, done properly the victim will be unconscious in 10 to 15 seconds.
It also creates a massive spike in blood pressure.
Use it on someone with a heart condition and it's lights out for good.

These cases are always a hard call, no one questions until a fatality.

Guy had problems, but do you tie up resources for hours talking, next guy high or drunk and violent, sent 10 cops to have coffee with him.

You would need to know the guys history, cops knew him, guy said you are always arresting me.

Fact of life, obese, mental illness means problem, some drugs and or mental illness, very high pain threshold, massive dump of adrenaline, plus other things, make a very dangerous situation.

They used their judgement, guy died, so sad too bad, bet the bleeding hearts wouldn't want him as a neighbor. Jim

There is no justification whatsoever in grabbing somebody's throat, it is well known it as one of the most dangerous acts possible, there were plenty of police there and if 4 can't manage then they should have called for back-up or maybe resign.

As I said before somewhere, community gets the police force they deserve, many good community forces, Sheriffs departments etc.
Big cities are different, certain areas are for all intent, lawless, you need to carry a big stick just to keep the lid on.
If it wasn't that way, you could sent police to Afghanistan, but you can't, you need a bigger stick. Jim

Protesters in New York demonstrated on Monday against the deaths of Garner and others killed by the police

A New York grand jury is weighing criminal charges against a police officer in the death of a black man who died after being placed in a chokehold.

The prosecutor in Staten Island said he would present evidence next month in the July death of Eric Garner, 43.

Garner, who had asthma, was heard on a witness video shouting "I can't breathe!" as police arrested him for allegedly selling untaxed cigarettes.

A medical examiner has ruled his death a homicide.


'No fear'

Julie Bolcer, spokeswoman for the New York City medical examiner's office, said Garner's death was caused by "the compression of his chest and prone positioning during physical restraint by police", but said other factors contributing to his death included asthma and heart disease.

On Tuesday, Richmond County District Attorney Daniel Donovan, who has jurisdiction over the borough of Staten Island, said he had decided to call a grand jury following his own investigation and a review of the medical examiner's findings.

"With a full appreciation that no person is above the law, nor beneath its protection, I assure the public that I am committed to conducting a fair, thorough, and responsible investigation into Mr Garner's death, and that I will go wherever the evidence takes me, without fear or favour," Mr Donovan said in a statement.

New York City Mayor Bill de Blasio said he was "pleased" with the announcement.

"New York City deserves an investigation into the Garner case that is fair and complete," he said.

'He's breathing'

Garner's death provoked an outcry, especially after a video of Officer Daniel Pantaleo placing him in a chokehold became public.

A second video, apparently filmed shortly after, shows Garner lying on the sidewalk. Three minutes into the video, medics arrive and he is lifted into an
ambulance.

A bystander asks why no-one is trying to resuscitate him and one officer responds, "because he's breathing."


Garner died shortly afterwards.

Chokeholds are banned by the New York Police Department and Commissioner William Bratton has ordered an internal review of training.

Meanwhile, Mr Pantaleo has been stripped of his gun and badge while the investigation goes on, and another officer involved has been placed on desk duty.

A lawyer for the police officer said it was too early to say whether he would testify before the grand jury.

With the demographic of recruitment largely drawn from the blue collar element of their brutish society it's scarcely surprising the cops are thuggish, callous and quite disdainful of anyone they perceive to be lower than them in the American cultural food chain.

Why the underclass don't kill more of them is quite mystifying.

Assigning him to an inactive post ( gosh, where have we all heard that before ) is certainly a draconian step for their bureaucracy. Chap is certainly for the high jump and may be suspended without pay for a month.

Indeed. The media brainwashing and introspective view have created what looks to any outsider to be a personal jail hell.

Living here, no matter the warts, you look at this shit happening in the US and wonder why anyone - even from the worst war torn hell holes on earth are trying to get themselves a US visa.

If I was offfered 10 million dollars and a greencard for me and the family I would laugh at the offer.
